    I think the no time limit on the banks you are thinking about is that because they were regulated with other bodies before 2005 they can't use the pre-regulation excuse for not considering a complaint that car dealers or insurance brokers for example can use.

    I suspect the OPs complaint reasons were such that MBNA believe they can apply a time bar for example they might have said PPI was added without their knowledge but actually cancelled it more than 3 years ago and it was taken out more than 6 years ago - they should reasonably have known there was a problem when they cancelled it.

    FOS can of course overrule the MBNA rejection

I found out on this web site about the mis - selling of ppi a couple of months ago and that if you thought you were miss - sold it you could put a reclaim in and I never cancelled the ppi it just ran out when I paid the card off ! Do I have a case do you think?


    I had the card from 1999-2009 which had ppi on it and I also had another credit card with mbna and there was no ppi on that account!!

    I stopped using the credit card in 2009 and was rejected, however i have had successful claims with other bankss with ppi pre 2009.

    I don't know if you have a case because you haven't given any complaint reasons however I can't see them successfully (from their point of view) applying a time bar based on what you have told us. They have to be able to link your complaint reason with a specific event that happened more than 3 years ago that would strongly indicate you should have known at the time you had reason to complain. PPI ceasing because you paid off the card would not be any indication at all that you knew you had reason to complain at the time
  • I had a claim with MBNA for ppi applied 1997 they rejected my claim and were rather nasty and cynical in any communication I had with them. I contacted F.O.S they upheld my complaint and paid me nearly £26,000 after tax what joy, months later they sent me another check for £600 as they had mis calculated.


    My advise is don't give up !
  • I never said anything to them about the ppi at the time of the account being open and the ppi was just added on to my account when I opened it!! I had another account with mbna and that didn't have any ppi on! My argument is why was it on the account and why wasn't it made optional? And also why if I needed ppi at the time ,why was it not put on the other account. I didn't think there was a problem intill I started to investigate the matter a couple of months ago. Most of my findings were from this website

  • Hi all. Good news story for those with old claims.

    I recently claimed for 4 loans, dating from 1991 to 1999, all from Yorkshire Bank. Have just received compensation offer of £4100, which I'm very happy with!

    All for the sake of 1 letter, 1 form to be filled out, and 1 telephone call to be answered (had a query about something on the form).

    Bank found details of 7 loans I'd had between 1991 and 1999, all of which had PPI. It did take them about 3 months from my initial (template) letter, in fairness they did advise me when they went over the time limits and told me I had the right to complain to the Ombudsman (I chose not).

    It's going to be a good Christmas this year :)
  • Hi Maggy P how long was was your complaint with the Fos before they upheld it against Mbnna, im going through a smilar case to yours, mines with F0s right now.

    I cant remember exactly but I know it was a long time I will try and find all the info regarding dates tomorrow but I know it can take years my case with the FOS and AMEX has taken over 4 years.

  • Hi. Thanks to your letter templates, I applied for a refund of Business Loan Repayment Insurance paid to Lloyd's Bank for several loans over the period 1997-1999. It took about eight months, and several follow-up letters, but I eventually received a refund of nearly £6000.

    I would just like to thank you for this advice. We are now able to afford our first holiday in four years!
