    Hi all, bit of a newbie to these things but just wanted to share this story. Been paying into an IVA for just over 4 years and have held off chasing ppi despite increasing pressure from my IVA company Debt Free Direct.In July this year I received a letter from Barclays saying I may have been missold ppi so I went on their website, filled out a form for my loan and also my baclaycard. To my amazement I was awarded just under £19000 pounds but after a brief period of glee my IVA company are trying their hardest to make sure I see none of it. Sound a bit sus to anyone else? If they had offered this to me before my IVA started I would have had no debts at all!!

    As you owe money to creditors, they can take it I believe.

  • cheers for that but theres been another development, it would appear that DFD have received another payment ( possibly HSBC, more PPI !) and after paying everything bar the statutory interest there appears to be a £22000 balance in my fund so watch this space as there will be a creditors meeting soon about waiving the interest as they have done so for 80% of their clients but we shall see :-)
  • Thank-you so much to MSE, I have just received a letter from MBNA offering me £1696 in respect of my PPI claim on a short term loan going back to 1998.


    Whilst a friend of mine signed up with a broker , I was determined to try myself ( and avoid a fee of 30% of any successful claim) and the advice on MSE made everything just so easy. I didn't even have any of the paperwork from the loan as it was so far in the past.

    Just received payments from Lloyds...

    My payment £4.5K on two of four loans. They also paid on a loan with no PPI as it was a consolidation loan, so to pay off the PPI on the first loan, the second loan was larger.

    Wifes payment I said would be double as she had 7 loans...I was happy to be wrong as she has £12.5K. Again her loans were consolidation.

    Due to our work, we did not need the PPI but it was sold to us anyway. Just by looking at our employers they should have recognized it was not required.

    As for how I claimed, I went into a local branch and asked about another complaint, which I have since made and have been given £2K interest refund from the balance of the loan... the branch made a print out of the loans taken (dating back to 1997) and I phoned the PPI complaints line. They sent the paperwork to us, only one set each, which was completed and returned. FOr my loan it was sorted at around week 7, for my wife's they took the full 8 weeks and although we didn't have the letter at the 8 week point, we did have the settlement figure.

    My advice - work at it yourself don't pay someone (PPI claims company) to make the phone call and complete the form.

  • Spoke to HSBC yesterday who have informed me that they have sent out an offer letter for £2,800 :j just waiting to hear back from Canada square now about my egg card and that will be everyone contacted and settled!
  • Hello, just a bit of info on my claims. I phoned up MBNA to find some info on my old CC and they were very helpful. I found out that I was paying ppi on one card from 99' to 2009 and on the other card I had with them I was not!! I never mentioned making a complaint at that point but the nice ladie I was talking to said she had lodged a complaint and the ppi complaints team will be in contact soon. She then said out of the blue, that we pay refunds to old account by cheque.


    I was a bit surprised at how quick and helpful the start of the process was for me.


    Anyone here had any success with MBNA?

    Also I've started the process of trying to recoup ppi off of three accounts I had with welcome finance, im not sure how lucky I will be but its worth a try, they did sting me for a lot for ppi on these loans that I had around 10 years ago or so (not sure on the dates).

    The other week I had a refund from Lloyds for 13 years worth of bank package fees, I emailed them through the resolver website on Friday and on the following Monday they told me I was going to receive £2500 refund :o)

    Anyone here had any success with mortgage arrears default charges?...I have applied for them of a company called Kensington !!! ...fingers crossed...

    Hi i had an mbna credit card through to 2009 and i was turned down due to time barring. Ive appealed to omburdsman.

    I didn't think there was a time limit regarding ppi claims to banks!!

    There are statutory time limits for complaints.

    For PPI you have to complain within 6 years of the event being complained about, or, if later within 3 years of becoming aware there was a problem (or you ought to have reasonably been aware there was a problem) however applying a time bar is not compulsory.

    I think the no time limit on the banks you are thinking about is that because they were regulated with other bodies before 2005 they can't use the pre-regulation excuse for not considering a complaint that car dealers or insurance brokers for example can use.

    I suspect the OPs complaint reasons were such that MBNA believe they can apply a time bar for example they might have said PPI was added without their knowledge but actually cancelled it more than 3 years ago and it was taken out more than 6 years ago - they should reasonably have known there was a problem when they cancelled it.

    FOS can of course overrule the MBNA rejection
