how come a bank employee could take a commission and deprive customers of money by foisting an unsuitable insurance on them and never get investigated under the Theft Act 1968?

1 - they do not get paid a commission
2 - they are not individually regulated for insurance (only investment class business is)
3 - the employer has the liability and its up to the employer to decide what action they take - and they may well be taking action against some
4 - Banks did wrong but also they have been forced to treat pre-regulation complaints the same way as post regulation sales. So, a lot of the time the staff member didnt do anything wrong based on requirements when it was sold.
5 - There are also a lot of auto-payouts where it is cheaper to settle rather than argue the case. One bank was auto-paying out on PPI redress upto £3000 until recently. So, do you penalise the individual in those cases?

  • Success! Claimed from Cap 1 initially via agents (foolishly). Got £450 less expenses. Took to FSO and got £4.5k! This despite having claimed several times on it. When I took it out, knowingly, jobs for both of us were insecure, illness and general cover from work not available. Now I've had one success I shall try others. Just wanted to test the water, took several months, but what the heck. GO ON DO IT. All it will cost is a stamp! DON'T DO, DON'T GET!
  • I reclaimed PPI on a Halifax Credit Card, after tax deduction I got £2040

I June 2014 I contacted Halifax myself and said that I believed I was miss-sold PPI, They took my claim and after 6 weeks I received a letter saying that they did not believe that this was the case and that I had knowingly agreed to take PPI on my credit card.

I didn't contact the Financial Ombudsman, but I know I should have. Last week I received a letter from the PPI Team at Halifax, stating that as a annual review, they had reassessed my claim and decided in my favor, and that I would receive the funds within 28 days in my Halifax bank account. the next day the money was there.

PPI Reclaim - £2040 :) So my advice is do it yourself, do not use a PPI Reclaim Company, its really easy using the templates and advise on MSE, and a rejection in the first instance doesn't mean you won't get money back.
  • Barclaycard
I have been trying to claim PPI back from Barclaycard for a number of years without success. At first I used a third part to act on my behalf and then I tried contacting them myself, the reply was the same on both occasions. Recently I was contacted by the same third party who said there had been a new ruling on claiming PPI and could they try again for me with my Barclaycard, of which i agreed. The rejection letter came back even quicker from Barclaycard this time. The reason I cannot claim anything back is because I completed a postal application and ticked the box for PPI as I assumed it would help me get the Barclaycard. I have had other credit cards which were completed either on-line or by post and they have been successful, its just Barclaycard who have been adamant that my case is a non starter! I even tried the Ombudsman and they upheld Barclaycard decision. Has anyone else been successful with a similar case?

You chose to have PPI, no one sold it to you, so your complaint was pretty much destined to fail.
You've gone through all the channels you can, so just forget about it and move on.

Some companies auto payout below a certain threshold which may account for your previous successes.

I've had 2 good successes so far. A couple of years ago I received a letter about an Egg Loan I had years ago, saying that I may have been missold PPI. I had been told on the phone at the time that because of the size of the loan they wouildn't offer it to me without PPI. I filled in the form and they upheld my claim and received a cheque for nearly £8k.

Earlier this year I had a letter from HSBC regarding a personal loan we had, again many years ago, I couldn't even remember what it was for and that we had actually paid PPI on it. Filled form in and received nearly £7k within a month of filling the form in.

I am now actively trying to pursue a claim on an Alliance and Leicester personal loan through Santander, not really holding out too much hope as they have already said they cannot trace anything, even though I had at least 2 loans with them that I can remember.

Well done to everyone who has had success, and to others..........keep going!!

depends. They probably werent regulated prior to 2005, and if there are no payemtns for insurance related gubbins on your statements, you probably aren't paying it.

  • I was looking on google the other day and happened to see that lombard direct was taken over by RBS ,i then had a thought that i had taken out a loan with Lombard in the 90's so i looked at the RBS page to see how to check, called them up, they said yes you had a loan in 1997 with ppi, so i filled in the forms on wednesday, they acknowledged it via text on friday and texted me on monday to say they will give me £400,all done in less than 5 days,Now Lloyds on the other hand rejected my claim, then i saw that the FOS had advised all Lloyds customers to get them re-investigated as Lloyds were doing it all wrong, so i did, they accepted my complaint to re-investigate my original complaint,15 weeks later !!!! still nothing.Useless.
