    I knew that I did not apply for the PPI at the time I applied back in 1994 as I was a student at the time so no point in PPI (or Creditguard as they called it at Natwest), but I had no proof. After approximately one year of this letter I found while sorting a copy of the original Natwest application form I sent in and I clearly did not tick the box, and I also found a few statements that show PPI for the first two years was not on my credit card. This shows that Natwest lied to me in their letter and I know they sold the PPI in 1999 over the phone (but I have no proof of that).

    Most credit card PPI is sold after the application via phone.

    Were you borrowing on the card in those days or did you pay off the balance in full?
    I called the FOS and they said I can complain even after the six months but it is likely to be rejected.

    That is correct. There is nothing to stop you referring to the complaint to the FOS outside of the 6 months. However, Natwest have to volunteer to allow the FOS to review it. If they refuse, the FOS cannot review it without signficant new evidence that would likely change the outcome.

    Whether you were sold it at point of sale of card or later is a minor issue. it doesnt change suitability or eligibility checks.

    At the time I had a significant balance, I have worked out that based on when I think the PPI was taken out to 2006 when I stopped it plus the 8% yearly interest I should be due ~£10,000.

    Does the fact that Natwest lied on their reply stating that I had applied for the PPI on the original credit card application form count as new evidence? As I mentioned I have since found a copy of the application form (which Natwest sent me in 2006 from their records), that clearly states that I did not select to have PPI and I have statements that show a balance but no PPI charge (hence I did not have it when I first had the card), up to ~Jan 2000 when a PPI charge then starts to appear on my statements (until 2006).

    I do not think that Natwest will volunteer to allow the FOS to review it as in 2006 I fell into difficulties and ended up with a DMP through the Citizens Advice for 6years, before Natwest agreed to a reduced Full and Final Settlement of the order of 50%.

    Lied or mistaken (it was a long time ago). Either way it does not change the eligibility check or the suitability check they should have done when you made the complaint. it is an error that changes no material facts. i.e. your employment was the same, health the same etc. Where there is no evidence of failure, those things are looked at and that should have been done when you complained. One assumes, there was no issue in those areas which is why it was not upheld originally.

    Even if Natwest volunteer to review the complaint and lets say they or the FOS decide it was mis-sold, Natwest can use the redress against the other 50% you failed to pay. They are allowed to use redress against arrears, defaults and amounts written off.

  • Just want to say, never ever use PPI companies. Write to your loan or credit card provider. From reading the 1st post on here a few years ago have now had over 45,000 pounds back from lenders.

  • Following a full review of my past spending I requested statements from all companies I have had cards with in the past. During this review I found that I had PPI payments on a Cahoot Credit card between 2002 and 2006 totalling £646.00. Following advice from this site I downloaded the template and sent it off to Cahoot, Santander who own Cahoot wrote back within a week to acknowledge the complaint and then within a couple of weeks come back with an offer of £1945 covering my original £646 plus interest, I am very happy with this result and would recommend that anyone with credit cards check past statements, it is so easy to write a letter and only costs the price of a stamp, the results are very worthwhile.
  • Second Success - this time with Barclaycard!

    I filled in their online form, sent signed for, did NOT provide any info other than card details, stated it was a postal application, and I was civil servant when it was taken out. Already covered by my terms and conditions at work and no persoanl records held for over 6 years. Card was paid off in 2013 - account and card still valid.
    Taken 3 weeks, letter arrived today - upheld £8866.52. :j:j:j:j:j:j

    I need to agree it - then they should pay (letter is at home - told the person at home to open it )

    I reclaimed the ppi on a mint loan (the insurance was with RBS) after I was sent a form by RBS inviting me to put forward my concerns. It took 8 weeks exactly to make a decision - they upheld the complaint! The offer comes to £10558.60.

  • After putting it off for a couple of years, I finally got the push I needed to put in my PPI claim when a friend was successful. I have had an HSBC credit card since the late 1990's, and found a single old statement with an insurance payment on it. I put in my claim via the telephone. They were actually very helpful and asked if I would like to apply direct by telephone to save doing the form. I did this. 3 weeks later, I received an offer of £3,200 in settlement of my complaint. Three days after sending off the acceptance form, the money was in my bank account. Can't believe how easy it was! I have a bigger claim still to go now - HSBC again - this time for Small business loan insurance. I remember the seeing the pre-ticked box back in the mid nineties, and wondering what it was! I will be putting in the claim in the next few days, and will report back on how I get on. Thanks so much for the support on this forum. It really is worth the effort, and the satisfaction of getting money back that was wrongfully taken from you is great!
  • FOS have upheld my claim against Capital One twice but bank want it to go to Ombudsman. Is the uphold rate still 90% and is average waiting time still 18 months? I have been waiting for response for 17 months now so anxiety levels rising!
