Do not waste money by using third party. I simply downloaded forms and sent off and within 4 weeks Santander and MBNA have both upheld and I have just accepted offers totalling over 7,000. By the way it is worth going back as included ppi on loan in 1999. I am so grateful for the advice Money saving expert!

Got my Barclaycard refund yesterday, over £1700, so that's Natwest 5800, Egg 2300 & Barclaycard £1700.

Just the CPP one now left, if I get it, then it will be over £10k back in PPI refunds.

Another fast payout from Barclaycard, got my refund cheque yesterday.
  • Here follows a tale of PPI Reclaiming Success which I hope will encourage everyone to have a go!

Followed the Money Saving Expert forum advice and put a PPI Claim Letter together to Lloyds Bank for my Dad who is now in his 80's but had a loan in 1996 which he still had the paperwork on. Due to the length of time that had lapsed I wasn't sure if it'd work but guess what it did and my lovely Dad got a cheque for £1600.00! :T

The moral of this story... don't hesitate, write the letter today!

    Hi

I took two car loans out in 1996 and 1998 respectively through my bank. Back then you typically had to visit the bank and go through an interview to get loans which was what i did on both occasions. About 2 years ago I contacted them to ask if I had paid ppi on these loans. I was certain that I would not have agreed to this as they were for small amounts and I was in secure employment with no overheads as I still lived with parents. The bank wrote back to me to say that yes I had paid ppi on these loans but that as it was so long ago they did not have the paperwork. They also said that it would have been explained to me during the verbal meeting with the bank so I was not missold.

I reported this to the financial ombudsman nearly 2 years ago and they came back to me today to say that they were not upholding my complaint as whilst they could confirm I paid the ppi because the meeting was face to face and the bank had no paperwork they could not prove that I was missold. I explained that I felt the fos were siding with the bank and were making assumptions without evidence. He confirmed that I met all the criteria set out by the bank to not be required to take ppi!!! I was told that a letter was being sent out to explain there decision and that I could appeal this if still unhappy.

I need advice? What are the chances of them changing their decision if I appeal?

It is possible but unlikely that an Ombudsman would decide differently to the adjudicator. The reason I say this is because they work to the same procedures so its only really the borderline judgement calls where they may look at it differently. The other thing is you've talked about evidence but under English law as the party alleging wrong doing its up to you to provide the evidence to substantiate your claims, not up to them to disprove it.

Okay, stupid question probably, but what if you don't have any of your previous loan or credit card agreements to hand? I have had various loans from TSB (original) and Lloyds TSB, I know I paid PPI on these but have in more recent times got more savvy and said no to it. Am I best writing a letter directly to TSB and Lloyds?

As far as I am aware Lloyds inherited the liabilities of the old TSB and when they separated it retained them. So you'd direct any complaint to LLoyds. Do be aware that trees nothing wrong with having PPI. You can complain but it would need to have been missold to you.

I contacted Natwest using the Financial Ombudsman form with the only information at hand my Natwest account number and asked them to investigate whether any PPI had been attached to my loans and mortgage I have had over the years with them. I was in full time employment at the time with life and sickness cover and therefore did not require PPI cover. I was surprised to receive £1950 back and although I am no longer with Natwest I have been impressed by the speed and efficiency in which they have dealt with my complaint although I am a little disappointed that I paid for something that I didn't need. 8 per cent interest was nice though.
Having seen my cheques come through the post I eventually managed to persuade my wife to also put in a claim. She is really organized and retained all her documents from the past. She has just received a cheque from Lloyds for just over £2300 and is waiting for a response from Halifax, which I calculate to be £4000-£5000. So the morale of this article is don't be afraid to claim it's easy as explained by moneysavingexpert, and even if you don't get anything back all it costs is the price of a stamp, envelope and paper that you print the FOS form on. Good luck everyone.
  • I have had success claiming back PPI on my Marks & Spencer Chargecard !!!

I first wrote to M&S back in 2010 after watching Martin Lewis on Lorraine Kelly’s show. I contacted them in relation to a couple of loans I had with them and my M&S Chargecard which commenced in 1987. They responded saying they were unable to clarify the position until the result of the Judicial Review. To be fair to M&S, once the Judicial Review had been settled, they then contacted me again and made fairly prompt settlement on my loan PPI. However, they said they were unable to consider the PPI charged to my Chargecard, as I had made a postal application and had chosen not to tick the box to opt out.

    Following the advice given on here, I then referred this matter to the Ombudsman. It took a while but just before Christmas, I received confirmation that my complaint was being upheld on the grounds that although my application was made by post;

    a) I was not offered the option to actively confirm I wanted to take out the policy in my application (ie by ticking the box).
    b) I did not have to sign separately for the policy. If I had done so, this could have highlighted it was a separate product.
    c) The policy was taken out at the time I took out the Chargecard, but there was not enough evidence to suggest M&S made it clear to the me that the policy and Chargecard were separate products and therefore based on the evidence provided, the Ombudsman was not satisfied that M&S made it clear enough to the me, that the policy was optional.

The Ombudsman said that I was entitled to be put back in the position I would have been in if I hadn’t taken out the policy when I opened my account in 1987. It took a while for M&S to come back to me with a figure. Initially they miscalculated their figure based on my account commencing in 1991 but eventually they were able to calculate on an average balance from 1987 and last week I banked a very nice cheque!

The advice I have both gathered through other people’s posts and advice offered to me by individual contributors on MSE over the last few years has been invaluable and it has encouraged me to approach several other providers without the need to use a third party and as a consequence both myself and my husband have had great success with Santander, Natwest, Mint (RBS), Barclaycard & Lloyds.

So thank you all very much.
