PPI Reclaiming successes and failures

Have just received a reply from Nemo, they state the loan was arranged via a broker called loanmakers, i completely forgot, anyway they are sending my letter on to them but they have also spoken to norwich union who do the insurance and they said
'it is not accepted that the policy terms and conditions are unfair. The terms and conditions reflect the risk that is accepted by the insurer to provide the cover and represent NU legitimate commercial judgement in considering the risk, and the terms and conditions that shopuld apply to that risk'
They also pointed out that i had the opportunity to cancel the cover without charge within 30 days of receiving the policy if i were unhappy with the terms and conditions. (i never received any terms and conditions book)
They said i can go to the FOS but norwich union have however provided me with this additional statment.
'as the terms and conditions of the policy represent our legitimate commercial judgement as to the risk involved, we NU would ask the FOS to consider dismissing any complaint about this issue under their rule 3.3.1 (11), which reads ''the ombudsman may dismiss a complaint without consideration of its merits if he is satisfied that it is a complaint about the legitimate exercise of a firms commercial judgement''
Now what i want to know is do i just wait for the broker to respond to me and then just send a second letter if needed, also i didnt speak to norwich union direct as the broker arranged the loan/ppi but they never gave me anything about rules etc.
Any advice appreciated as i am very confused0 -
:j Yayyyyyyyyyyyy!!! After three letters First Plus have finally agreed to refund my full premium plus interest. My premium was £7836.80 so am really chuffed. Thank you to everyone who has posted on this forum, it just shows that perseverence really does pay off.

CLAIM AGAINST-Nationwide
AMOUNT WON - £1,500
TIME TAKEN -about 5 weeks
Did all template letters then followed up with a strong letter made up by little old me, basically saying that they had 7 days to pay up otherwise I would contact the ombudsman. Worked a treat, after several letters denying having missold us the PPI, eventually admitted that we had not ticked the box!!! Fibbing B"%!*?*%S!!!!

well done what did you claim on misselling? or unfair rebates im chuffed that firstplus have to pay out hope i have some luck:beer:
The main point which seems to have been the one that won it for us was that we felt we were pressurised into taking the PPI. I originally sent an SAR but there was a recording missing when I remembered asking for the docs to be sent without PPI added, but the Sales Advisor talked me out of it. I sent a further letter asking for this call recording and then my three complaint letters. They only 'found' the call after the third.
Keep going is what I say. They did try and fob us off and then only offer 78% at a pro rata enhance rebate but I'm really pleased I stuck to my guns.

can I ask what sar is? im waiting for the recording my ppi was the same as yours more or less i just cant believe how they get away with things

S.A.R - Subject Access Request.
If you are awaiting your recordings I imagine you have submitted a S.A.R even if you have used different terminology. Make sure you ask them to send everything they hold on you. HI guys just wanted to ask if anyone has had a success with welcome finance, i took out ppi on a 5 year loan. and became ill, and called to make a claim on the insurance that would cover me for anything that i had wrong with me, and got told it does not cover stress. so i now beleave i can make a claim. I was also told i had to take the insurance in order to get the finance.
I am trying to get £1500 of charges of them in another issue, as i got behind when i was ill. but was wondering how people had fared with getting this mopney back off them.0 -
