PPI Reclaiming successes and failures

    My wife has recently tried to reclaim ppi on a capital one credit card, printed a ppi reclaim form from the capital one website, filled it out and posted it. 10 weeks later a reply from capital one saying that they couldn't repay the ppi as they have a phone call conversation recorded which my wife can be heard saying yes to ppi. In my mind, that doent prove its been sold correctly, my wife to this day still doesn't know what ppi insurance is.

    Are capital one trying it on? Should I try again with a different approach?

    Ask for a copy of the recording then you will know what was actually said by both parties.

    If this call was done when the card was activated your Wife needs to ask why no PPI was asked for on the application but applied after the phone call, what was said to make her think she should take it after the event.

    If your wife had no need of the PPI, good sick package from work, life insurance or other means to repay the debt, let them know.
  • She tells me that she had the card for maybe a year or two before ppi was applied to it, it's this phone call that the bank they have, they must have said something to her to make her change we mind.

    She had means of paying the debt back, she's married to me for one. She also works for the NHS who are good at sick pay and she also has a medical condition.

    I'm not sure that capital one have considered her case based on all the information. Like I said, the reclaim form was a fairly basic form from their own website which my wife filled out without really knowing what to say. Should we try again?
  • I took out ppi in 1995 on a 4 year loan with the Coop Bank. I haven't got any paperwork but wrote to them quoting my address at the time and stating I had a current account. They wrote back stating they could find no details of my loan account after a thorough search and therefore could not investigate. This is rubbish and although the loan finished in 1999 my current account was active for a few years after. Anyone got any advice on what I should do next? Should I write again or go through a ppi company to try and progress this?

    I was clearing out old papers etc a few weeks ago when I found some old credit card statements for an Alliance & Leicester credit card, these showed PPI payments on each.

    Id always thought I had no PPI on anything so I called up Santander and they sent a letter asking me to send copies of the statements I had as these went back to 2000-2002, I only had some and not all of the statements in that period, so in total I sent 12 statements in.

    Less than two weeks later ive now got an offer of £1127, surprised how easy it was, but their letter says they have refunded from the date of the first statement I supplied until 2003 when they sold the business to MBNA and that if I wanted to claim from 2003 id have to deal with MBNA which is fair enough.

    However I had this card before 2000 (the date of the first statement I still had) and was looking for advise as to whether Santander should be able to establish when I took the card out, particularly as ive supplied 12 different statements so they have the account numbers etc. My nearest estimate is that I took this out around 1997 and would obviously like to get that PPI fee refunded until then if at all possible.

    Any views appreciated.

    Neither.
    Unless you can find documentary proof of this ancient finance from your own archive your complaint is over.

    A Claims Management Company cannot provide evidence if you have none.

    Send them a SAR and £10 - if they send nothing, they have nothing, and cannot establish any of the above.

    Write back to Cap One, tell them you reject the reason they gave for not upholding and ask for the phone call and why after having the card for 2 years, would she then take the PPI during a call, list what you put above as you don't think all points were considered.

    If it was a final response from them, take this to FOS using the reasons above, ask Cap One for the phone call to send to FOS.
  • I recently phoned HSBC to enquire about any PPI policies I may have had with them over the last 10 years ( I genuinely was unsure if I had taken any out ).

    They informed me that I may have taken PPI out on my HSBC credit card and asked me would I like to have a PPI questionnaire sent out. So I received this, completed it and returned it too them.
    Shortly later I receive a letter saying they agreed I had taken out PPI but they claim I wasn't misold, and if I disagreed I could take it to the Financial Ombudsman.

    So I phoned the Financial Ombudsman and they sent me a form to fill out which I proceeded to do. Many weeks later I receive a letter from the Financial Ombudsman saying they ruled in my favour and agreed I had been misold PPI. They added that they were forwarding this assesment to HSBC and that their response could take weeks.

    As I hadn't heard anything from either party in 6 weeks I decided to phone the Financial Ombudsman today, and they said, they had just received an e-mail from HSBC today stating.

    " they still do not believe I was misold PPI as I had signed for it and would have received the standard T & C's "


    So as it stands, I am having to wait for this to progress further and to see whether this is ruled in the customers or HSBC's favour.

    The really frustrating thing is.

    No, the only thing it suggests is that you had simply forgotten all about it. Banks didn't automatically add PPI without the knowledge and permission of the customer. To be mis-sold, the PPI either had to be mis-represented to you (for example, you were told that it was compulsory when it wasn't) or be completely unsuitable based on your circumstances at the time.

    Regardless, the Bank obviously feel they have enough evidence to appeal the initial FOS decision and it now goes to an actual Ombudsman for adjudication.

    Expect this to take several months.
