    I used to follow a trail on MSE but doesn't seem to be this one amersall, but I recognise your name from before from that. I would be interested in trying to make contact with a guy called Paul who eventually did take a legal route to resolve his PPI claims and was successful - don't know if you know who I am referring to but if you know how to make contact with me outside this blog site to give you more information, then I would appreciate that.

    My wife and myself have had some success reclaiming PPI ourselves after I had a bad start with the Lifestyle Claim rogues.
    We have some left that I can't resolve after following the normal routes.
    FOS say they can't do anything outside their regulation remit.
    The repeat offenders for me are GE Money and Creation who seem to take great delight in telling me the claims are time barred or it's nothing to do with them.
    Although Santander have coughed up on some claims they refute claims of store cards they have taken over from other lenders and blame them.
    Some claims rejected on "when you phoned to renew the card we offered you PPI and you accepted it and you didn't cancel during the cooling off period"
    Basically, the only way forward is to take a legal route from what I can see although I've tried a punt at the Financial Compensation Scheme and waiting for acknowledgement of receipt of letter let alone a reply!

    Question - has anyone had any success going through the small claims court - seems to be very coverage on this?

    Question - has anyone gone legal properly - again - very little coverage on this.

    Comment - there is a lot of hype about PPI claimbacks but very little about what must be a lot of claims that are unsupported by the FOS, claims that legitimately fail or some that just hit a brick wall like mine.......so where is the advice on what we all do in this situation.

    Comment - where do all the main stores sit in all of this as they sold PPI policies with sales people with no training and little idea what they were selling - do they not have any liability and is there no way of seeking compensation from them. I have an absolute shocker that my wife got done with JJB Sports with a Duet card in conjunction with Creation .......the limit was £3,000 but now stands at £9,000 although being worked down - the killer was the ongoing PPI payments when the limit was hit and my wife fell into the credit card trap and got in problems. Again very little on whether people can go at the stores themselves.

    Still angry about all of this but feeling better now I have got my rant out to everyone!!!!!!

    you join experian or noddle or something and check your credit history. If it's not on there, it's up to you to remember tyhe rest, no-one else will know apart from you.

    No-one is 'entitled' to anything, correct, but there's nothing stopping her complaining about PPI, or taking it to the FOS if she disagrees with their decision.

    Store cards sold prior to regualtion - complain to Santander, wait for their refusal, then complain to the insurer.

    Not everyones PPI complaint will be succesful, it's not as simple as asking for your money back, and depending on who what and when, then sometimes, people don't complain successfully, and that's it. Once you've exhausted all the avenues, all you're doing by trying to take it to court is giving yourself a bigger debt for nothing.

    You just have to accept that your PPI was not missold, wehter you think that or not otherwsie you'll just end up bitter and twisted.

    I've not seen or heard of anyone who was successful in court because it's not a legal matter. In fact, all the evidence seems to point towards people being completely unsuccessful in court.

    Hi, I cannot bring to mind a thread re legal action to be honest, when was this? as taff has said, the court route could be unsuccessful.
    If you let me know how long ago this was I will try to find info for you.
  • I started my claim in December 2010 with Life style claims ,as we all know they went into Administration in October 2012, i had paid an up front fee of £950 to fast track my claim. Once Life Style had gone into administration i contacted Red Hawk Legal who told me that as i had paid up front they would not be continuing with my claim as they would not get anything from it.I was contacted by the Administrator and advised to claim my up front fees back from my credit card company, which i did . I was contacted by a legal firm Ultimate law and was told that they would be acting on my behalf against Lloyd's, i explained about Life style and Red Hawk legal and they said they would be acting on my behalf not Red hawk legal. all good i thought. Last Friday i got an offer from Lloyd's which i accepted,Ultimate law would claim they fees back from Lloyd's great i thought.Today i got a phone call from Red Hawk legal saying i would be receiving a bill , i asked why and they said that my case had been won and i had a contract with them . At no time since Red Hawk legal took over Life Style claims have a received a phone call or a letter, funny that once the claim a has been won they get in touch.I told them i had no contract with Red hawk legal it was with Life Style claims, they claim that having bought Life Style claims and all there on going claims i owe them , yet i have a letter from the Administrator saying Red Hawk Legal have closed all my claims as they have been unsuccessful , to me it sounds like all these company are in it together , should i pay up

    Just wanted to say I successfully got a cheque (already cashed) from halifax for 797.00 quid on a Halifax credit card they mis-sold me PPI on!

    Just one form in the post - took no more than 1 hour to write and post it! Yay!! :j:j:j (only sent it off at the end of September as well!!!)

    Some people on the board told me they didn't think I had a claim but I did it anyway! Where else can you get 800 quid for a hours work? :cool:

    So I say - fill out the form and send it - what have you got to lose? I can now put it towards my credit card debt! whoop!! :j:j

  • Put a claim in towards the end of September for 2 loans which were at the very least 10 years old.

    Don't really know how much the loans were for or how much PPI was on them, but confident one was for around £11k and the other maybe a little less.

    Anyway had a letter today offering £3624, which includes taxed interest. :beer:


    Just asking, do I accept this or is it best to ask for more? I don't know what the general rules are?

    Will they try and offer me less than they are worth because I dont know the amounts? Or will they just pay the full amount.
