 Ombudsman phoned today, unable to uphold complaint over mis-sold ppi with hsbc. HSBC say they don't have a copy of the credit agreement and neither do we. My husband was a serving soldier and did not need the insurance but because this was a managed loan we were told it was mandatory. Loan was taken out 2001 paid off 2010, £12000 total but massive interest. Bank can only give me statements back to 2007, and the ppi was front loaded. Does anyone have any advice or do I just go get drunk?
    Thanks

It's time to get drunk, If you don't have paperwork supporting your claim and the bank does not have anything it will be very hard to prove.
  • I just wanted to hopefully give some confidence to some - I pursued a claim myself re an initial free policy for a year via our mortgage years ago. When the end of the year expired, it simply renewed and we didn't notice as it was included with the one mortgage payment. MY husband poo pooed and said waste of time but I thought differently. It has taken a long time with not a lot of effort but eventually we heard via the ombudsman that they had rejected our case. However, I think due to the amount of cases they were dealing with they didn't really read our form and I highlighted a few facts and asked them to look again, which they did. Months later, they have now written to say that have agreed that they originally made an error and I am now waiting to hear from Nationwide. Ours isn't a huge sum prob about £500 but better in my bank than theirs! you just have to persevere if you think you have been misunderstood. will let you know when we hear from Nationwide, they have until 22nd - cross fingers
  • After one letter asking my bank (First Direct) to investigate any ppi I may have had on previous loans. I am ecstatic!!

Only took 3 weeks from writing up until today and they confirmed that they are refunding £4,076.14 WOW!
over four thousand pounds from one letter and almost half that amount is the interest they are paying me.

I am totally gobsmacked thank god I found this site and did my own claim and not get a third party to do it.

Great news to report for my very first post on the forum!

    Lez.............
  • Out of interest, did you keep any of the documentation yourself dated back to 1995. Similarly, we paid PPI through our bank account that was with HSBC in 1995 (a statement would be the only documentary evidence that we paid it from that date!), but they have said there is no way they can help as all documentation for the past six years has been destroyed.
  • What were you reclaiming:A loan

    Who was the provider: LTSB

How much did you get back: £10,430.80

Did you get it back after a letter or did you go to the Financial Ombudsman: A phone call from Lloyds TSB before the letter with the offer.

Anyone who has any doubt - try it anyway. To get this amount back at the cost of 3 1st class stamps. Very worthwhile.
  • I successfully claimed just under £1100 from HSBC for the PPI on my credit card. The process couldn't be any simpler and thanks to MSE team. People in MSE are providing a stellar service; PPI reclaim page was my one-stop to complete the paperwork, the bank paid in little less than 6 weeks after my submission.

I am one of the non-budget conscious (or rather was) who just trusts the banks when they sell me stuff that I don't necessary need and get them because its a safer option.
I got the PPI (in another guise) for the credit card (which I didn't really need) that HSBC offered when I opened an account in 2006. I started using the card for all my regular expenses which meant that the statements were too long and I never get around looking at individual entries. I stumbled onto MSE multiple times, but never looked at the site in detail. I am glad I did one evening and a quick check on my statement confirmed that I did have an active PPI on my card.
The paperwork was straight-forward as the account was active and HSBC have good supporting information on their website. I got back all the money I paid towards the insurance with interest, which is a great. I was really surprised that the process was this simple:j

A further update on my Goldfish claim (now with Barclays) which admittedly I had almost given up on! Received a phone call yesterday from them asking for more information and they've now advised I should be hearing of their decision within the next couple of weeks. I resubmitted this claim in February after claiming in August last year and receiving a rejection. I am aware this does not constitute an upheld claim, but at least things are moving forward. This is on the back of a letter received last week from the Ombudsman advising Barclays are to make an offer as a gesture of goodwill against a Morgan Stanley card I held. Again, I know this is not an upheld decision but these cards are very old so something retrieved is better than nothing. I guess it depends how far down the line and how mucht ime you have to invest in these claims. For the more recent claims I have had success! Just waiting on Nat West now which has been with Ombudsman for almost a year. I'm adopting the policy of all good things come to those who wait...and if they don't..well there's always wine!!! :rotfl:

    Success Story.

Loan 1. Taken out in 2000 Refund £1034.00 (paid)
Loan 2. Taken out in 1998 Refund £ 350.00 (awaiting letter to sign)
Loan 3. Taken out in 1996 Refund £ 550.00 (awaiting letter to sign)
Loan 4. Taken out in 1994 Refund £ 750.00 (awaiting letter to sign)
Loan 5. Taken out in 1991 Refund £ 850.00 (awaiting letter to sign)

Although bank is dragging it's feet in sending the offer letters for the 4 oldest loans, I have spoken to them and the letters are apparently on the way 2nd class. That service is soooo slow. When they eventually do arrive, I will sign them and deliver personally. The offices are only 35 miles up the road. No ridiculously expensive solicitor firm used this time. You don't need them, do it yourself. Why pay them a third of your payment for just sending off your letter.

  • Didn't take any action initially with regard to PPI refund as never took out PPI with any loan or mortgage. I new the requirements for claiming would probably exclude most people. Guess what, my mortgage provider contacted me to say I did have PPI for an additional small loan I had taken out, which was probably sorted over the phone. As I know I never take out PPI, they must have ticked the box On my behalf. Received £700.

Same bank have recently written to say that letters sent out with regards to interest rates on said loans, were not correctly worded and they have just sent me another £700!

    Bring it on.
Have you done everything right in life. If not will you learn and have you changed?
  • I've got a claim in with Barclaycard which dates back a fair few years. Barclaycard have upheld my complaint, agree it was missold but claim that as no premiums were paid, there is nothing to refund me. What??? I had a balance on that credit card for years. Something smells fishy here. Asked them to look into it again and following a chase up call from me was told the same thing as before. I phoned on 25/07/13 as am still awaiting the letter they claim was prepared on 24/07/13 to tell me this. Anyway, I have sent off an SAR - lets see what that brings up!
