    If you still have the rejection letter then send a copy back to them and ask that they look at this again due to the news item today, if they won't, then send this to FOS, explain the rejection and the news item today as a reason you did not go to FOS in the time of 6 months.

    Hurray!! I've posted on the other PPI thread on whether or not it was worth carrying on after having my claim for mis-selling rejected by Lloyds TSB (I had no paperwork and, as it all happened about 10years ago, no recollection of what happened but knew I didn't need PPI and couldn't remember asking for it) and after encouraging replies I went ahead and eventually put the claim in to the FOS. Last night I got home to a letter from them saying that after their intervention Lloyds would be sending me an offer of compensation :)) No idea how much and have to wait up to 12wks for Lloyds to respond but proves it's worth persevering.
    In total it's taken me 9 months to get this far! Hope it's worth it :)
  • RBS wrote to me to advise I may be have been mis-sold PPI. I filled in their forms as I knew I had been mis-sold it. Two weeks later they have sent an offer as a 'gesture of goodwill' for £385.55 but this is 'without any admission or liability'

    Does anyone know what would happen if I pushed it and got the bank to admit liability?

    Also the offer would be used to clear any arrears on my account first and seeing as i am now on a repayment plan with them to pay the loan off (have been doing this for several years now with reduced interest) I wouldn't actually see any benefit of the money...yes £385.55 would be paid off my loan earlier but I dont expect to pay them back in full for at least another two years. So my question is; what if I wrote back to them stating that i am willing not to take it any further and willing to accept the offer plus no admission of liability but I would want a cheque sent out to me that I could cash into my new bank account (that is not with them). The way I see it is that why should I not get to decide where to place the money that I at the time had to fork out extra for! Yes I acknowledge I am in debt to them but at the time that was my money!

    They haven't upheld your complaint, they have offered you a gesture of goodwill which means either they didn't investigate it, or they are auto-paying you.
    This means they can also offer what they want to.

    The only thing you can do now is rejet their offer and take your complaint tot he FOS but if theyhave offered you what you paid in premiums, you won't get a better offer no matter what you do.

    Yes, it was your money to start with, but then you didn't actually pay back what you owed,and they are allowed to offset your redress against your debts first.

    How do you propose to do that exactly? It's a "goodwill" payment which means they haven't actually upheld your complaint! If you complain further the Bank can actually choose to withdraw the offer entirely!

    "At the time" perhaps it was yours, now though the Bank have the right to off set against your arrears.

    You appear to think you can somehow haggle with this offer. I'm afraid you are not in a position to do anything other than accept that the redress goes towards your debt.

    Do you know what the original PPI amount was and are they taking the whole PPI amount from the loan balance?

    It's usual for even "goodwill" payments to redress the whole amount of PPI. Unless the amount being offered is considerably under what was originally paid, however, I can see no reason to reject the offer which will simply see the OP entering the FOS queue for up to eighteen months.

    As I said in my earlier post, the Bank can choose to withdraw the goodwill payment if the OP goes to FOS. If FOS then don't uphold the OP's complaint then there will be no redress for the Bank to off set.
