I am at such a loss now.
Burtons say that because my policy began in October 2003 that I cannot claim back anything because this was before the 2005 FSA fine.
    Has anyone else encountered this?
If so, what did you do?
I don't want to back down but i feel i may have to.

Don't give up! My husband claimed through Burtons and although it was a long drawn out process they finally paid up. He got a letter from his GP confirming his medical history (It cost him £15 but it was worth it) and therefore giving proof that the PPI would be invalid. He also continued to chase it up over the phone. They paid out approx 9 months ago and he took his policy out in 2000. The whole process from start to finish took about 3 months.

    Hi there

They are entitled to 8 full weeks to respond, if you hear nothing at all by then you are entitled to move this on to the Financial ombudsman service to see if they are able to take over to investigate this for you.

If you do receive a response within the 8 weeks and they fob you off, or do not resolve this, then send letter 2.;)

Good luck, hope you hear soon. X

successful ppi reclaim against Bank Of Scotland 07/04/2009
I have today received a cheque for nearly £6000.00p from Bank of Scotland and will receive another cheque shortly for the 8% that a court would award on top of this in the near future.
I took a loan out with Capital Bank in 1998 which was for £11000.00p and the ppi was just over £4000 over the 5 year term.
After visiting Martins website at the beginning of Jan09, and reading about the successes other people had, i decided to look through my old loans and see if ppi had been added to them, because as an ex member of the armed forces, i had taken loans out in the past, but never asked for payment protection insurance as my wage was guaranteed. To my horror i found that ppi was added at the beginning of this loan, just over £4000 in total and this was added to the loan amount of £11000 then interest was calculated on top of this amount.
I wrote one letter to Bank of Scotland, in Jan09, using the ppi reclaim template letter from this website, but altering it to suit my particular circumstances, and got a letter back 8 weeks later saying that based on what i had said in my letter, they would agree to put me back in a position i would have been in had i not taken the ppi, that this was not an acceptance of liability in any way, but as i am a good customer they will pay me out.
I waited approximately 4 more weeks and my cheque arrived this morning with one more on the way. I am so glad i checked out this website, and would like to say a big thanks to Martin Lewis!!!

    1. :jI took out a loan of £12000 with HFC in 2002. They sold me PPI but did not state how much this would cost anywhere on the agreement. After viewing this site I decided to try and claim back the PPI. It has taken over a year but I have finally received over £9000 including interest after the financial ombudsman became involved. I couldn't believe it even though I was told ppi from HFC was very expensive I never guessed I would receive such a large amount but I am going to have a holiday and enjoy a worry free christmas. I would urge everyone to try this, it's about time the banks got a taste of their own medicine. :j
    :cool:really pleased for you , well done:j:j:j:beer:

I had a feeling they wouldn't respond, oh well on to the ombudsmen. Funny how they've received lots like yours eh!!!!???? Their compliance manager has been suspended I think, I'm sure that was in the news so that probably doesn't help.

Hopefully the FSA will be getting involved soon, I think I read on the FOS website somewhere that when a company drags a case out for longer even when they've had the same result on similar cases then the FOS will look into compensation also. Welcome are clearly doing this, drives you mad!!

Mine still doesn't have an adjudicator and was also March last year, hopefully wont be much longer. I have checked my letters that I initially sent to Welcome and I also requested they cancel the PPI which they haven't done!!! I'm paying them over £500 a month for my loan and car HP so the sooner this is sorted the better. I really could do with some good news.

Maybe Welcome are dragging this out because of all their other problems at the moment?

Oh well, fingers crossed for you and everyone else waiting for some good news. Have a good long weekend everyone.

    Hi

Thanks again for your support, I really hope you get a response from the FOS soon.
I also requested my PPI be cancelled from the remainder of my loan which wasn't done, then when I spoke to my local branch in September 2008 they said there was no reason this shouldn't have been cancelled and if I sent them a letter confirming this is what I wanted they would cancel it!! Even though I had already done this nearly a year before and been refused I sent the letter anyway not expecting a response but then funnily in October 2008 when my policy was due to end I got a letter stating that as I had cancelled my policy in September 08 and it ended in October 08 that they were refunding me one months PPI an amount of £50.60 !! I couldn't believe after paying it for nearly a year when I'd already tried to cancel it they then do this. Anyway I sent all of this to the FOS as evidence of just how this company works. Im not sure if any of that helped my case be looked at a bit quicker but as yours was sent around the same time its the only reason I can think of.
