The fact there is no record of a phone call is your problem, because you are the one saying that the PPI was missold. You are the one who has to prove it.
Hey taff, I was told similar about this aspect of my claim, not by you though. That sounds to me like a recipe for firms doing away with their phone records and telling their customers to f off. Doesn't seem right to me, these firms have been caught bang to rights in many cases and for once the burden of proof ought to be on them. Especially when their products or sales techiques have been proven to be 'institutional' mis-selling (my term!) - don't see why from then on all of their PPI sales shouldn't be assumed to be mis-sold.0 -
Because UK law, the prove of guilt is to you now the bank.

A few words to say Thanks to Martin & staff for the advice given to us all. I happened to be clearing loads of business paperwork from the 'loft' and thought I would just check if I could find an original agreement for a loan taken out in June 1999. Success, I accumated 27 pages of evidence, aggreement, statements etc and emailed this over to Lloyds, together with advised wording from Martin.This was followed up with forms to be filled in and a direct phone call from Lloyds last week. Today I have received a responce offering £2590.59 repayment. I know that I originally read these forums trying to establish how much I could expect in return so here are my facts if it will help someone else.
Original loan £15000
Term 6 years
PPI added up front to my loan total £1053.75
Total loan amount £16053.75
monthly payment £294.19
Interest 9.60%
The offer is made up as follows
refund of ppi premiums £1053.75
Debit interest @ 9.6% £336.55
Interest @ 8% calculated until 15th March 2013 £1200.09
Total repayment £2590.59
Thank you Mr Lloyds TSB, it was a hassle free experience for myself although time and effort was spent gathering information to submit. I started my claim in January 2013.

Btw: As regard phone records, under the DPA banks should by best practise get rid of all customer data as soon as possible (ie as soon as the data is no longer required).
Some banks operate as little as 3 months recordings before overwrite, some 1 year and some 3-5 years, its all down to the client relationship (ie active, dormant, closed) and how much an institution wants to be held for data retrieval.
If there is an enquiry by the AG /FSA arrow visit etc then most banks don't want to have to trawl through years of recordings as this I administratively expensive. Thus they set their own data retention.
The FSA does not dictate a period, only that its relevant to the customer and banks situation.0 -
Further to my previous post I googled 'simple interest' and entered my dates and £ amount and the result is £333.38 more than stated in my offer. A phone call tomorrow will be made but how reliable are these calculators or do Lloyds just pluck a number from anywhere? The dates I entered are from the start of the loan 4th June 1999 until 15th March 2013 @ 8%. Any advice please would be appreciated. Thanks0

Sent off my claim form that I got off Money Saving Expert about 4 or 5 weeks ago and just recieved a letter throught the post this morning from Santander offering me £2800 plus interest and they'll pay it straight into my current account! I didn't think it would be this easy, and I wasn't sure if they would pay as it was 7 years ago I took PPI out on my mortgage. Just a big thank you to Martin and MSE, you made it so simple. :T0

Following on from the 6k from RBS, I received a letter today upholding my complaint from Sainsburys. Nearly 2k isn't to be sniffed at.
My nephew is one happy bunny though as I promised him a nexus 7 if my complaint was upheld with Sainsburys.
That brings to an end my PPI adventure. The whole PPI thing had bugged me for years and it is nice to get back what I had paid for no reason.

I am sharing my story now that all of my reclaims have been closed and finalized, the latest one (and biggest one) received just yesterday after 17 months of starting the claim off with the company - there are various claims from me for PPI on a loan, credit cards, store cards and a catalogue.
Once I started I thought I might as well cover everything!
Most of the smaller money claims were given straight from the lender after just one or two letters but others I had to progress through the Ombudsman who I found very helpful - to those who havent yet started reclaiming I assure you this can be done fairly easily if you keep on top of each claim and also have some patience when using the Ombudsman as they are very busy. The Ombudsman are very efficient and dont use jargon the everyday person couldnt understand - it can be life changing sums of money for some people - it has to be worth a try, right?

Barclaycard Reject
Hi, I wonder if anyone can help. I recently had my Barclaycard ppi claim rejected. They have forwarded back a copy of the agreement i had signed, after an internet application. I have obviously signed this, but on looking there is a Section 10 - Payment Protection Plan, which just says : yes I want my Barclaycard account to be covered against unemployment etc etc. I can honestly say I dont remember noticing this on signing the agreement back in 1997. So was this a pre-ticked box on the internet?? Is there anyway forward with this claim do you think??? Thanks Joanne0 -
Second claim upheld from Lloyds - after initial refusal and then three months trying to get even an acknowledgment, we finally emailed Osorio and, within a couple of weeks, the money is in our account. Many many thanks to whoever suggested it!0
