PPI Reclaiming successes and failures

I sent off my claim to MBNA for a credit card I'd got from Abbey National, where I'd been sold PPI over the phone weeks after I'd applied for the card. They sent me a letter back inside a month, telling me they'd upheld the complaint. A month later, they wrote to tell me I was due a repayment of just over £1300 (which I'd worked out would be about right) and three days later I got the cheque!
I was stunned it was so easy.0 -
Have posted previously on this one. I had a Goldfish card against which PPI was charged and I am in the throes of reclaiming back. The first time this was sent to Barclaycard they rejected it saying they were unable to locate a policy under my name. Not good enough I said and re sent the copies of statements I had already sent. After this allegedly being misplaced by them, they acknowledged receipt and advised the complaint would be reopened. This was at the end of Jan 2013. Numerous phone calls later and they are informing me they are still looking into this and that they do not have a timescale to work to. They have told me to ring up when I would like an update...:mad: Has anyone else suffered with their stalling techniques?? I already had a claim rejected with them and is now with the FOS...I am concerned that they will reject this current claim and I then have to add this to the waiting list!!!Debt at Sept 2006 £63,500:eek:

As they are treating it as new evidence ion your original complaint, they don't ave to stick to a timescale.

Thanks Taff...I'm not really that impatient...I've noted they do not have the best track record in upholding complaints and really just curious to see if this is a stalling tactic...I'll carry in being an intermittent phone pest;)Debt at Sept 2006 £63,500:eek:

Hi Everyone
I was wondering if I could get some guidance on this.
I phoned Bank of Scotland at the start of February armed only with a single loan reference number and the knowledge that when I took out the loan back in 2002, I begrudgingly took out PPI when the telephone seller insisted I required it to qualify for the loan. Unfortunately I do not have the original loan paperwork. Over the phone I stated simply that I was complaining I had been missold by virtue of the fact that I was misled into thinking I HAD to take the PPI out to qualify for the loan.
I received a letter from BOS dated 5 February stating they were investigating the matter.
St Andrews Group then wrote to me on the 5th March (a month later) with a Questionnaire, not too dissimilar to the FSA one mentioned here. I have not yet replied to it, and was considering my options and seeing if an SAR I submitted at the end of February came back promptly.
They have also now written to me on the 12th (just arrived today) saying that they reject my reasons stating that the PPI was not compulsory and that the brochure they sent to me AFTER I'd agreed to it on the phone spelt that out - regardless of the fact I was told on the phone that I wouldn't qualify for the loan without taking the PPI alongside.
My original phone call was 2 February, they send me a questionnaire 5 March and write a week later saying "we have not received the questionnaire back yet so we find no reason for misselling?" Are they trying to force me down the ombudsman route? Or hoping that I'll be easily dissuaded?
They also mention that prior to 2005 (this loan was dated 2002) PPI was not regulated by the FSA. Although they mention the GISC and their standards.
IS this really a lost cause? Bear in mind that I have no original paperwork... (although the SAR may rectify that it is not guaranteed since the loans go back to circa 2000-2002). They say I should call them if i disagree with their assessment (which I clearly do) or write to them "providing further supporting evidence" - of which I have none except my testimony.
What should I do? I'm inclined to fill out the questionnaire, and call them to let them know what it says, spelling out:
1. I said no to the PPI over the phone, only to agree to it under the duress that if I didn't take out PPI I wouldn't qualify for the loan.
2. The fact that paperwork may have come through after the phone call doesn't change the fact that I believed what I was told over the phone by the representative.
3. Also, having now learnt my stuff, it is clear that the PPI would have been single payment - never explained to me that I paid it up front and incurred interest on it throughout the loan term.
4. I also was never told over the phone that I could shop around for PPI, and if i wanted it (which I never did) could find it elsewhere.
In their refusal letter they state that because the exclusions, the fact that it wasn't compulsory etc was spelt out in the brochure which arrived two weeks after the loan was signed, that means that they didn't missell the PPI.
However, my compliant is on the knowledge that was provided to me at the time of me agreeing to it, ie over the phone when I was misled.
Any help or suggestions are most welcome.

Well, firstly, why didn't you send it off when amersall advised you to earlier this month?
And your points in order
1 - There probably is no record of this phone call now
2 - You should have read the paperwork
3 - Excellent complaint reason
4 - They are not required to do this
Fill in the questionnaire as you should have done originally instead of fannying about, send it to them, and to please re-open their investigation concentrating on single premium and the problems with it.Non me fac calcitrare tuum culi0 -
Wow taff, while I appreciate your help you have got your facts wrong and have a snotty attitude too.
Amersall told me to wait for the SAR which still hasn't arrived. He did NOT tell me to reply immediately, much the opposite in fact. And also, only a week has gone by since i received that questionnaire, which wasn't sent out til four weeks after my initial complaint.
As far as I am concerned the fact there is no record of the phone call is their problem, not mine.
So basically, I was missold the PPI but on the basis that there will be no phone records now, I have no claim on that basis?0 -
Yup, you're right, it was a bit short. And she said you can wait, not you should wait. She also gave you the basis for your complaint which is provable.

Sent off 6 PPI letters about 3 weeks ago and got my first reply today with a cheque from Ikano - the Ikea store card. All it took was one letter and the cost of a stamp. The cheque was for £83.46 - full PPI repaid plus interest at 8%. It might not be a huge amount but it was money I didn't have before so I'm very happy. I am wondering, after reading so many success stories for various ppi if a policy that I have running would come into the category. It is supposed to cover me for unemployment and critical illness. Can someone please advise me what I would be looking for in the wording etc. thanks0
