    Received my letter from FOS yesterday, with a copy of the Braclaycard credit card application form. Firstly the application is typed. Secondly, all the dates at addresses used on the application are not true. They relate to when I opened a Barclay account and when I informed Barclays of change of address, all information on the Barclaycard application form was obtained using the personal details from my Barclays account, without my consent. There is a PPI question, which asks for a tick in a box, there is a massive hand written cross in this bit, which looks exceptionally suspect, since all information is typed.

    Also FOS, said this was filled in following a meeting with Barlcay's, no such event ever happedned. Also, all the address's used are not complete, no post codes, I would definately have put these on the application. Not even a post code for where I work. I have written to FOS, highlighting all these points. Im hoping this may go somewhere to proving that I never applied for Barclaycard, and that I never knew or accepted the PPI policy. Please bear in mind, that I never saw this application form, until yesterday, didnt even know that PPI was on this application form.

    Please comment, and tell me what you think, is there any chance this will go in my favour?

    I bought a car from a used car dealer about 15 years ago who set me up with a product from Forthright Finance. I'm pretty sure that it had PPI on it but we didnt need it (or even use it) as I had cover from my employer. We were pretty young and I remember feeling railroaded into the agreement from the car dealership.
    To complicate things I dont think I have the paper work anymore or the Ref number. Can these be obtained from somewhere else? Credit check etc?

    You have to complain to whoever sold you the PPI, so you have to complaint to the card dealer.
    To do that, you need the account numbers. This you get either from any paperwork you may have left, or from sending a SAR and £10 to the car dealer.
    As this was 15 years ago, the used car dealer probably hasn't got any info left now.
    The car dealer also won't have been regulated 15 years ago so in the event you do find the account number, they can dismiss your complaint
    If the car dealer is no longer trading, you have no one to complaint to.

    Forget this complaint, it has nowhere to go.

    Thanks for the speedy reply. For info, the dealership is very much still up and running but, as you say, if they werent regulated then they can dismiss my claim. Just to wring every last ounce out of this, is there anything that the FOS can do as the dealership kinda forced us into it?

    Hi All
    Just wanted to let you know of another success story.
    Out of the blue in February 13 I received a letter from Canada Square Operations advising that they took over Egg Loans, and a previous loan I had MAY have been effected by PPI being mis-sold.
    I completed the questionnaire they enclosed with the letter and sent it back,, was not really sure what would happen, as the Egg loan was repaid a few years and I no longer had any info or documents.
    Saturday I received a letter to say that they had recd my complaint and would update me into the investigation within 8 weeks. However, 2 days later (yesterday), I had letter to say they have now upheld my complaint (to my surprise over 3 x loans I had with Egg - it would appear that I had several loans, which I repaid and took out another egg loan to get the cheaper interest rate etc)... With the interest on premiums paid and 8% compensatory interest, they are refunding me over £8K!!!
    Best Monday ever!!! especially as they contacted me! So now just waiting for the cheque (which should be here within 20 working days!) My acceptance letter has been sent back today recorded delivery!
    Don't give up anyone,, I kept reading success stories on here, and never thought I would be writing one -- Good luck all :(:T
  • After following the advice and forms on this sight we claimed for my wifes deceased fathers ppi.
    We received cheques totalling over £9000 from Lloyds TSB. Great.:j
    But, they have made them payable to 'The Executor' of his Estate.
    He died intestate and had no property so no Executor and only £300 in his bank account which they allowed my wife to close..
    Lloyds TSb are now refusing to re-issue the cheques in my wifes name and she is the only relative. :huh:

    The FOS can do nothing because they weren't regulated. You could phone the dealership and ask them, but don't be surprised if nothing happens.

    my claim is kind of similar to yours. i was informed i couldnt have credit card if i didnt have ppi with it. they filled out form in branch ,but barclaycard rejected my claim on grounds it was a "postal form" which they filled in and sent off themselves. FOS went in my favour as info barclaycard sent to FOS was such a bad copy,they couldnt work out if i had ticked ppi box,or even if it was anything to do with my account.
    just waiting for barclaycard to get back to them with either an offer,or if they still reject claim. if they do reject it for a third time,then its the ombudsman court for a final decision, either in my favour or theres.
    but seeing as its been in my favour twice now,i'm very hopeful. but who knows what other excuse barclaycard will come out with not to give me my money back????????????. good luck,and dont give up.
