    Should I claim for mis-sold PPI through the mortgage advice company or the bank who supplied the mortgage?

  • Took out a mortgage with A&L in 2005 and was told that I needed to take out PPI with them for them to give me the offer. Paid for years before really understanding what it actually was and cancelled it.
    Sent off a claim to Santander mid november, got a letter back about a week ago offering me £4000! That's going to be transferred into my bank in the next few weeks which is fantastic!
    I'm now also waiting for a claim I've put in with capital one for a credit card from back in the day when I was a daft student.

    Just a quick question. I have had claims against MBNA and Barclaycard upheld by the FOS. They were due to respond to the FOS with the settlement offers by 5th December and 13th December respectively. I have spoken with the FOS today and neither party has yet responded....

    Anyone have any experience of this? I just wondered how long it's now likely to take as the FOS said they could do nothing until they had heard from the firms...both claims were with the FOS for 11 months so another few weeks delay won't really matter!

    Have recently had my complaint upheld and have sent back form signed - So realise its too late now but just a question....

    I was reading through the breakdown details today and noticed that they are only paying interest up until the credit card was paid off which was 2006.

    Should they have paid interest up until now?

    I was so happy at the time, that just signed and sent off offer straight away, without reading breakdown properly!

    If this was the case, just to warn others, make sure you read the breakdown properly before sending back form.:eek:

    No you weren't done - interest is worked differently on a card opposed to a loan.

  • It was sites like this one that made me look closely at the PPI that I was paying on one of my credit cards

    The provider was M&S Money, and I took the card out originally in 1985. And after an exchange of letters, they've just sent me an offer to repay premiums totalling £3,132.50 including interest, which is approx £2,000 before interest

    This is how it went. I had a letter from M&S Money in May asking me to confirm my employment status, which they had down as "unknown". I called them up to confirm that I was self-employed - as I had said on the original application form - and also told the call handler that I wanted to stop paying PPI because I didn't think I would be properly if I became unemployed

    The call handler volunteered to raise a PPI mis-selling complaint with M&S Money and I agreed. After about 6 weeks I received a letter turning me down, on the basis that I'd had plenty of opportunities to read and query the Terms of the many years. I won't go through all the paragraphs - would just say it was partly boiler-plate, partly relevant to me, quite thorough but a pretty standard response

    However, I saw that the reply referred to "my letter" and said I'd complained because I wasn't aware I had PPI, that that PPI wasn't explained to me. Both statements were incorrect

    I then looked at the Financial Ombusdman's website and found two case histories which were quite similar to mine, and which had succeeded on appeal

    So I wrote M&S Money another factual and polite letter saying that I'd originally phoned, not written a letter and that my complaint was not as they stated, but rather about the poor unemployment cover offered to the self-employed. I also said that whatever boxes I'd ticked or Terms I'd been sent, I'd only recently become aware of the limited and inappropriate cover. I added that I'd take the complaint up with the Ombudsman if I didn't hear back with an offer within 14 days

    It actually took 5 weeks but today I received a very professional letter from M&S Moneyupholding my complaint and offering me a full refund with interest

    I have yet to receive the loot but I do urge anyone receiving a response letter from any provider to look at it carefully and see if it reflects every aspect of the original complaint, including the way it was made. Though I'm sure my complaint was justified in its own right, I also reckon M&S Money would have looked a bit silly if I'd taken it to the Ombudsman, because of the mistakes in their first letter
  • I keep getting letters from banks saying i have asked for ppi refunds. I have not asked anyone or complained to any bank? Has anyone else had this problem and how have they stopped it happening?

    Contact the banks in question, don't call the phone number that is on the letter.

    It is possible you had PPI and may have been mis sold and the banks have contacted you, check with them.

    If the letters you have are bogus then contact the MOJ as they may be from claims companies, find out from the banks direct first.
