    Hi all,

I claimed for 2 Santander loans I had years ago, 1 in 1999 for £7k and cleared with another loan from Santander in 2001 for £15k all have been paid off now. I recieved a letter from them stating they could not uphold my claim as there was no reason given for the complaint, even though this was done over the phone and I did say on there that I still had the paperwork (luckily) which shows a pre-ticked box on the agreement. Nothing was explained to me which I also stated, It was just there! I keep ringing them every week to see how my claim is progressing and they just say it's being dealt with....how long should I give them and any idea what I should be looking at for a refund (if any)....just so I know if they decide to try to fob me off as I have heard this happens quite often.

Thanks in advance for any help or advice given

    Lilminx x

If they haven't upheld your complaint, and you have had an ombudsmans leaflet, then go to the FOS.
If you think they haven't fully investigated or taken into account your original complaint reasons, write to them.
Any redress is the original amount paid, plus the interest paid on it, then 8% after on a sliding scale.

  • At the time I applied for the card and the PPI was applied, I was employed on a fixed term employment contract. As part of the KYC procedures, the information was checked with the PPI provider and so they would have been completely aware of my employment status and that this would have rendered the policy void, although they went ahead and took the premiums anyway. I know now that I could never have claimed against the policy, because of the way I worked as the policy specifically excludes this type of employment.
I applied for the card by phone and was advised that I could not get the card without PPI so when I returned the application form by post, I ticked the box to include it.
I never received any policy documentation or was advised of a policy number. In fact when I first tried to make a claim, Barclaycard stated they had no record of any policy and I had to dig out old statement to prove that the premiums were being paid.
I the course of my claim I provided Barclaycard with supporting documentation confirming my employment status and my contention that I also had a number of pre-existing medical conditions, which I was not asked to disclose upon application and would have severely restricted my ability to claim.
I have had to submit 6 complaint letters and make numerous telephone calls to get to this stage. They appear to regularly lose correspondence and each letter required a follow-up phone call to spur them into any action, which is far from satisfactory customer service
Barclaycard have now rejected my claim on the grounds that “my application was made by post and that I wasn’t given any advice, the process required me to select the type of cover I required.”
They have apparently “conducted a review of the documentation I viewed during the sales and are satisfied that the documentation accurately described the scope of the policy and was sufficient to provide me with all of the information necessary to inform me of ther terms and conditions of the policy.”
I am now planning to contact the ombudsman

The financial ombudsman service (FOS) is a waste of time. Anyone who has used them knows this.

Many many people who have had success with FOS would disagree with your assertion. It's important to realise, though, that they are not a consumer champion and so they can side with the Bank just as easily as with the customer.
I'm not sure a link to a site which champions potentially expensive litigation over the free complaints process is very constructive.
  • Just to let everyone know about my recent successes with PPI reclaim...recently submitted a claim for a Smile (Co-op) credit card. Sent off the FOS questonnaire, received a letter acknowledging my complaint & apologising for poor customer service a couple of days later. 2 weeks after that I received a letter detailing my claim & telling me they owed me £6.5k!! And my 2nd successful claim was for an HSBC loan - same process with Smile & a cheque for £4k! So thankyou very much to Mr MSE & everyone on here who posts & encourages others to claim. Have submitted a claim to Marbles but am being given the run around but I have detailed that in a different post.

They have 8 weeks to give you a final response, they may ask for more time, have they acknowledged the complaint? if they have then all you can do is wait for them, fingers crossed you hear sooner rather than later and they uphold your claim.
