I had a case with HFC at the Financial Ombudsman for 2 years which was passed to the Ombudsman. I FINALLY heard from FOS yesterday to say HFC will be refunding all PPI plus interest. I faxed them the settlement form today. Could I ask if you went to the FOS and if so how long was it before HFC contacted you after settlement form was sent. Kind Regards.

Hi All,
I've just got off the phone to Halifax's PPI claims department.
I believe I was mis-sold ppi when I took out a loan with them in June 2005. The loan was paid off in 2009.
I still have all of the paperwork with the agreement number, policy number etc. However, when I called them to lodge a complaint, they said that none of the details could be found.
After a pretty lengthy conversation, giving them previous addresses, d.o.b, phone numbers etc, they said they still could not find any record of this loan.
I was basically told there was nothing more I could do as they may have deleted the loan details because it was paid off 'so many years ago', as they put it.
I really don't know where to go from here. This is my first and only PPI claim and suddenly it doesn't seem as easy as I was led to believe it would be!
Any advice would be much appreciated!0 -

I've had a NO from Halifax....say that we phoned after taking out the loan to take out the ppi none of which I recall. We do have an agreement for the loan that has the ppi box ticked. We were very much pressurised into taking the ppi as it's a secured loan and were terrified we were at risk of losing our home if we missed payments. My argue net is that only the fist named on the loan was covered, which we didn't know until we tried to claim last year on the ppi under my name and claim rejected. Also I was working for nhs and still am so have heard this is another reason not to need ppi.
About to fill in ombudsman complaint but fear we won't win. So cross!0 -

Is this loan finished or still running? if it is still running, make sure they take the whole PPI off the balance and reduce the monthly payment by the PPI monthly amount.

If you paid this PPI in one payment each month with the loan payment, this is Single Premium PPI and this (plus the other reasons you stated in your post) are what you use for the mis sell, this was in fact loan on the loan to term end with interest, the full cost and unfair rebates of this PPI would not have been explained fully at the point of sale, ask for the recording of your acceptance of this PPI as had you known the ful terms of this PPI you would not have taken it, contact the bank again and see what happens, tell them you disagree with their reasons for not upholding and ask for a copy of the recording.
If they won't help you then take this to FOS.0 -

Money was correct, I just sent a letter off to each of my creditors. I didn't fill out one of the forms as such but went through it to make sure that my letter answered every question. It was June that I sent my Hsbc complaint off but didn't actually get round to sending the others until August I don't think. HFC responded quickly confirming they had received my complaint and then within 6 weeks to say it had been upheld. I am still waiting on the cash but hopefully not for much longer. It states on the letter that they will 'try' to refund within 28 days....HSBC put the money into my account 5 days after receiving my acceptance form so fingers crossed HFC will be a similar timescale.0 -
