I had two Barclay cards (VISA and MasterCard). Both were taken by me many years ago. I submitted a reclaim for PPI. The VISA they repaid - a success - but turned down the claim for the MC because:
"We have identified that your application for PPI was submitted by post. At the point of applying for PPI, as no such advice was given the process required you to select the specific type of cover required.”
Excuse my ignorance but can anyone tell what this means in plain speak? I asked for proof (a copy) of what I signed to accepted any PPI or terms. Also I don't recall applying for PPI on this card same as the VISA. They refused a second time citing the same paragraph again an that they had fully investigated. I have to fork out £10.00 to get a copy of my "records" they say.
I have gone to the Financial Ombudsman who say it could go either way.
Anyone had similar issues? Any advice?0 -
The Bank is saying that your purchase of PPI was "non-advised" and, as such, you mis-bought the insurance rather than were mis-sold it.Excuse my ignorance but can anyone tell what this means in plain speak?
Anyone at FOS you speak with about your case (other than an adjudicator or an Ombudsman) won't be qualified to tell you anything about the chances of your case being upheld. Instead, they simply hedged their bets and told you nothing useful.I have gone to the Financial Ombudsman who say it could go either way.

Hello all
I didnt think we had ever had any PPI, as we have always had good sick/redundancy cover through work, so I was surprised to find four very old loan agreements with PPI on them with First Affinity/Avco Trust from the mid 1990's, when I cleared out the attic. I had multiple original copies of each of the loan agreements (I think they sent you an extra copy at each step of the loan process in those days) and so was able send Citi Financial (who took over Avco Trust) an original copy of each loan agreement along with the template letter. I received a letter very quickly saying they could not trace our account, and asking for further details. I wrote back, repeating all the info I had already sent in, and reminding them that I had sent original documents with our account number on it.
The 8 weeks are now up, and I phoned today, and was told that they have rejected our complaint because they cannot trace our account. I reminded this rather unhelpful lady that we had sent in original agreements with our account number on it, and she said they hadnt received this. I pointed out that they of course had received this info, as they had acknowledged receipt of my complaint, and these documents were attached. She continued to repeat that we have been rejected because they cannot trace our account.
While I appreciate that these are very old agreements, and I could understand being "knocked back" because they were not regulated at that time, or one of the many of the other reasons I have read here, I was under the impression that because I was able to provide original documentation, with our account number on it, it didnt matter if they still held records.
I wonder if anyone has had a similar experience, or can offer any advice on whether there is anything further I can do?

In order to successfully complain about loans from almost twenty years ago you'd need COMPREHENSIVE RECORDS detailing not only the original agreement (which could have been cancelled before any PPI was actually paid) but also statements proving you paid this loan to term end (or early settlement).
So, unless you can find these statements, there is nothing you can do.

I have statements detailing the payments, but unfortunately, they simply state the company, not the account number, and each of the 4 loans, a year after the previous one, clearly state repayment of loan 1, repayment of loan 2 etc, so there is clear evidence of the length of time each was paid.
We claimed on the basis of front loading and the fact that we didnt need it due to the sick/redundancy/death benefit from work. I wouldnt mind so much if we had been turned down for one of these reasons!0 -

Even if you were to have the comprehensive records I outlined in my earlier post, it's still possible for the Lender to time-bar such old loans.
Why not take your concerns to FOS? You may have enough there to convince them. Do be aware it currently takes more than a year, though.
Do wait until you receive your "full and final" written response from the bank.0 -
Yeh - I know! Was never really that hopeful when they were so old, but just frustrated that their reason was they couldnt find out account!
I will wait for their final letter and see where to go from there. Appreciate your help and suggestions!0 -

hi, yes i have been knocked back on both my claims one for credit card and one for mortgage, seems they are playing ostrich as one of the reasons i was knocked back for CC was i filled in the form and they sent the t & c's. I have replied saying they have not investigated fully as the application form was not in my handwriting and according to FOS they cannot use the reason they sent the t & c's for me to read.....will keep you posted0
