  • How easy was this, ive been reading about claiming ppi for a while, but wasn't sure if i could claim or not, so I thought i had nothing to loose. so i rang the Halifax, they put me through to a department witch dealt with ppi claims they asked me why i thought i had been miss sold ppi, i told them that i was told i needed it when i took out my mortgage but turn out that i didn't need it. they said they would send me conformation of are phone call witch they did. then i didn't hear anything for a couple of months then out of the blue i received a cheque for £5700 could not believe it i didn't even have to fill a form in..:T

I think you need to realise that you are wasting your time with the Bank.

When they "invited" you to write back if you had further evidence to support your claim, they weren't inviting you to demand that they send you their evidence!

Lloyds is one of few Banks which tells complainants they can add to their complaints, but I've yet to see anyone actually persuade them to change their minds! I don't think they genuinely expect anyone to reply at all!

Basically, you have received a "full and final" response from them and your only recourse now which might be successful is to refer your complaint to FOS.

When FOS adjudicate your complaint, the Bank will be required to send FOS any evidence they have based their rejection on.
I sincerely doubt you'll ever see it, however.

I think you've wasted enough time in fruitless further correspondence with Lloyds, take this to FOS and stop concerning yourself with conspiracy theories about upheld complaints being a "lottery".

Hearsay complaints don't work "both ways", I'm afraid.
As the complainant making the allegations, the burden of proof is upon you, not the bank.
FOS is therefore very likely to side with the Bank in this respect.

Thank you for your reply. I appreciate what you are saying but I know for a fact that if you send further information they do come back to you. I am not convinced that my claim has been handled properly as information they put in my letter was false and this is why I am at the moment continuing to correspond with Lloyds Tsb all be it one sided at the moment. No where in my letter does it state that it is a full and final response. When I went in to the bank to start my complaint I was not told I had to fill in a questionairre they just faxed basic details to them I was expecting that I would have to give more details which is why I assumed that the letter they sent was just that. Thank you again for your reply

I have no doubt they'll "come back to you", but only with a reiteration of their initial rejection. In order for them to re-consider your complaint you'll have to provide them with significant new evidence. No point demanding their evidence as the onus is on you as the party making the complaint.

Not false enough for the basis of your rejection to be correct. Your complaint is hearsay which cannot be proven, unfortunately. I did inform you of this even before the Bank had replied.

    You don't have to.
The questionnaire is from FOS and is designed to bring together all information needed in one place. Not every Bank requires it in order to proceed with a complaint, though. Some will accept a letter, others even a 'phone call. The only time when you must full out the form is when you refer your complaint to FOS.

I admire your tenacity and agree no one should give up easily if they have a legitimate and verifiable complaint. However, in your case I think you are wasting your time.
Remember, you only have six months from the date of your rejection to contact FOS.
  • Hi,

How many of you have had a letter from HMRC asking for tax on the 8% interest you received?

They are being really thick with me. I just want to pay it in one but they keep putting me off! I do not want to register as self employed in order to make a one off payment because I know I will be hounded with SA filing reminders from then on. Grrrr!

Just wondering if I wait for a letter will it come??

Simplest way is to agree to your Tax Code being altered so that you pay the outstanding amount gradually.

Thanks, but Im not employed so I dont pay any tax at the moment. Thats why I just wanted to make a one off payment.

I thought it would be easier if they just wrote to me asking for the tax then I could pay it. Do they get the amounts from the banks?

If you're not a taxpayer at all, you won't have to pay tax on the interest!

Sorry, I meant as I am not employed I do not pay tax directly so cant get them to adjust my paye code. I have to pay tax on the 8% because I had incomes taking me over my tax free limit but am not registered as self employed because it was a one off. I just want to pay the tax due but the hmrc are not being very helpful! Bu
