Hi well done on your successes
can i ask how long the capital one claim took i have sent off to them i did recieve a letter to say they would look into it which is nearly 8 weeks ago now.
    Thanks Lyn

Lyn - sounds like we submitted them at same time (8 june), i not heard anything other than the acknowledgement stating 8-10 weeks. Claimed from MBNA on same day - took them both to post office at same time, that one done sorted paid out and nearly spent. took them less than 7 weeks start to finish. Had same grounds for the Cap One as MBNA, and applied for the cards at same time - they must have more claims to handle than MBNA or less staff!

i look at it every day! I couldnt have done it without the help and advice on here and to be honest probably wouldn't have bothered. Now looking at it to see how to fight a rejection just in case, I got 2 more claims in besides Cap One - GE Money and Barclaycard and i wasnt going to claim against that one - i purely rang to cancel it and a few days later got a letter confirming its cancellation and said they were investigating my claim and sent me a form to fill in - so i did to the best of my memory, i applied for the card in 1997 according to their records - was due a response from them last week

I also think that LloydsTsb should start dealing with their customers complaints themselves and stop pushing it on to the FOS to sort.
You do realise it costs Lloyds £750 for every complaint referred to FOS?
    Still think it's lottery?
  • Looking for some advice

My husband and I took out a loan with GE Money in Jan 2004 for £15,000 we contacted them by phone and everything was done over the phone they then sent out paperwork by courier and asked us to sign all the places that were marked with a x which we did and it was returned by the courier and after a few days we had the loan it was to be paid back over 60 months, ending in Jan 2009.
We struggled with the payments and spoke to our mortgage lender who agreed to give us a loan against our morgage to pay it off in full we did this in june 2006.
After reading about PPI being miss sold we decieded to contact GE Money to find out if PPI was added to the loan we took out in 2004.
I phoned them and they confirmed that it had, I asked them to send out a claim form to claim it back they asked why and I explained we never asked for it (I have health issues and it would not have paid out even if we knew it had been added on).
I recieved a letter confirming that we had PPI on the loan but as it was taken out in 2004 we were too late to claim it back:mad::mad:
If we had not paid the loan off in full in 2006 the loan would not have been paid until 2009, it seems we are being punished because we paid it off early.
I then sent a letter back to them requesting a copy of the loan agreement and the terms which I have just recieved they added £2,500 for PPI!!!!!!:mad: which we never knew about.

Would it be worthwhile writing back to them and trying to get our money back or am I just wasting my time I feel we are being punished because we paid off the loan early.:(
Any advice would be appreciated .

My favourite subject, the lloyds lottery!

One of my claims is only for £400 ish. This was a front loaded loan from 2002. Repaid early.
Rejected, send further info if relevant.
I am no expert but would suspect if my claim had been succesful my payout, £400 + interest, would have been in the region of £700-£800 pounds.
If lloyds assume that if rejected I will go to FOS it would make financial sense to pay me out.

Logical thinking implies that lloyds would have just paid me up and cleared another claim.
So maybe they are investigating every claim thoroughly and basing their decisions on available info.
Im slowly coming round to the opinion that it totally depends on how you present your evidence. Give them a reason to uphold your claim and not 3 or 4 "wooly" reasons that are easy to reject

Im off to fos and prepared for a 12/18 month wait.
If i had relied on facts and not emotions i would have been spending my dosh and not waiting for it!

Totally agree, banks uphold when they find a reason too. So even though you might say it was because you felt pressured but actually they realise that you was only working x hours a week and therefore did not require it.

You have to ensure that you have a valid reason, good evidence and more than anything else realise that it isnt your right to have PPI back, you get it back if there is a reason you should not have had it in the first place.
    CC 1 :- £5800/ £5,800 CC2:-[STRIKE] £4513 / £4513[/STRIKE] CC3: £4622.53/ £4622.53[/STRIKE] CC4:- £8971/ £8971[/STRIKE]
    Loan:- [STRIKE]£1785.63 / £1785.63[/STRIKE] 0

Actual total debt January 2011 £39,451.30 Paid to date 39,375.77
 PPI from HSBC = £4172

Question for you ..was PPI no good if you didn't work full time?
    Thank you
  • I had a reply from Barclaycard who listed the thirteen reasons why I thought the policy was mis-sold, but then told me that -

    i) As I applied via post, I would have had to tick a box saying I wanted PPI

ii) They have reviewed the documentation at the time (1994!) and it adequately explains the t&c of their PPI.

Consequently, they felt they had covered themselves and would not be refunding the PPI charges. They said if I was unhappy with this decision, I could try the Obudsman.

Is there any point pursuing this further given the above?

You have to be working over 16hrs per week and in permanent employment before it would pay out in the event sicknesss etc. So if when you took out the loan you were working less than 16hrs this would be a reason for mis sell.
