Guess that would be my opinion then. Would have thought that if i was accusing someone of taking money off me every month without agreeing to it(statements to prove this was happening) and the other person cannot provide any evidence (signed agreement/application!) for them to take this money then this would surely be classed as theft? I could see your reasoning if they provided me with the signed agreement for PPI and it was just a case of my word again against the advisor.
It will certainly be interesting to see what FOS say and will look forward to their response in 2013.0 -

All they actually suggest is that you had an agreement for money to leave your account. It's certainly not evidence of "theft".

Hi all,this is my first post and i'm hoping i may be able to get a bit of advise.A few years ago i had a loan with BlackHorse Personal finance.I know now the PPI on this loan was missold to me,i did feel very presured into having the PPI when i applied.The thing that is worrying me about making a claim is that i did use the policy once while i was sick from work.Iirc they made one payment and i think it made my loan a month longer at the end!Can i make a claim or would i just be wasting my efforts?When the loan was sold to me the guy was asking me if my mother would be able to keep up the payments if i became terminally ill or had a major illness or accident.Its a substantial amount.Any advice would be very much appreciated.Thanks in advance,Chris.0

Hi all,
I received a questionaire from ocean almost 4 weeks ago asking me to fill it in as I may have been mis sold ppi. I filled it in and received a reply saying they are looking into it.
I took out a secured loan over 25 years for 25k and paid a single payment added to the load of 15k!!! which I didn't realise only covered me for 5 years and cost 5k and the other 10k was interest added on!!:eek:
Does anyone think I'm in with a good chance of receiving a refund? Any advice would be much appreciated, especially if you have been through something similar.

hi i put in a claim for ppi about 6 weeks ago to lloyds, have had no letters we no they have the forms as my husband has spoke to them bout it on the phone. We had a letter yesterday from obudsman asking to check details bout claim n send it back. Does this mean lloyds have rejected our claim and passed info onto obudsman i thought obudsman only got involved if claim was rejected many thanks0

received offer of £7k from tsb on 3 loans dating back to 1997 but other 3 loans rejected saying no ppi unless i can prove otherwise decided to do sar hopeful might find some useful information

Big thanks to everyone who's contributed to the helpful info available on the forum. Taking advice from the forum to have a go at reclaming myself rather then using a 3rd party:
What were you reclaiming: Loan
Who was the provider: Cahoot
How much did you get back: £2008
Did you get it back after a letter or did you go to the Financial Ombudsman: Sent one letter and received one letter confirming the refund
And then write your brief reclaim tale: Using the templates available via the forum I send one letter describing how there wasn't enough info available at the time to make a valid decission on my own personal requirements and I was unaware cover I had from work would mean the PPI wasn't really of any use to me. Took about 6 weeks to get a letter back from them but they agreed the decission went my way and offered my premiums + interest giving a total of £2008.46

hi all im a newbie and hope someone can give me some advice. sorry it s a bit long but thought i'd give as much info as possible. i initially used a claims company for my claims and have had a rejection letter regarding my ppi on a natwest cc, there reason s being..i signed a similiar form to the specimen enclosed and i recieved a certificate of insurance with a full explanation and credit card statements showing pp ipremiums with 2 statements showing this, they have said they would reconsider if i had some new evidence. now when looking at this form it took me back to when i first applied for the cc, it was a joint application for a advantage gold account, this was the reason i filled in the application as the woman explained that this would lower the apr on a current loan i held with them nothing about the credit card was explained, i was in a secure job with full sick pay at the time and as for the statements it doesn't mention ppi it was credit card repayment proctector and i being naive thought this was a stardard payment protecting the card not myself. i also rang the cc last year because although i was paying the monthly bill it never seemed to go down and the 'nice' gentlemen explained that he would stop the cc repayments. if i present them with this information would it make a difference or should i pass it onto the fos as they suggest. as for the claims company i tried to contact them and have heard nothing so my other question is this if i take this further can they claim back anything i may win.0

However, it doesn't seem like any redress will ever be forthcoming from this as your complaint is very weak and there seems to be nothing you are adding that strengthens it.
