PPI Reclaiming successes and failures

    Ive been doing my homework using this wonderful site and decided to have a go at reclaiming myself thanks to all the great advice, we started looking out old paperwork we'd luckily kept for our records and found old mbna cc statements back to 2001 when the card was originally taken out, and then paid off and closed in 2007.

    Filled in the standard fos claim form and did a covering letter and SAR req as no original agreement then sent off to the address on the lenders website, grounds for reclaiming were that my fianc! worked and still does for a well known company that offers 6 months full pay and 6 months half pay, bupa health care and great redundancy package in the event of accident, sickness or job loss & also that he would not willingly take out such an insurance that he would have no use for.
    14 days later a conformation of receipt letter arrived saying they were looking into it and would aim to have an answer within 28 days, much quicker than the 8 wks we were expecting, then to our surprise about ten days after that came another letter advising the claim was being upheld, reason not given just that they had calculated all the amounts charged since the agreement was started and the refund to be paid via chq to us within 28 days totalling £2430 ish!! Inc associated interest and standard 8%.

    As you can imagine we were very pleased as the process was so quick and simple, the chq arrived three wks later, happy days but shortly after the upheld letter the info from the SAR I had requested when filing the compliant arrived and shockingly the 2001 agreement was enclosed clearly stating 'no' and a big cross for ppi!!!! How these companies got away with this is beyond me for so long, my point is also that although most say the time frame re documents etc is capped to the 6 yrs mbna at least swiftly recovered an 11 yr old document, so good on them!

    It's amazing reading everyone's stories so good luck all of you, we also had a success with barclays and reclaimed £2200 from a personal loan also speedy as they have a 40 day response period, and we still have claims with natwest and northern rock which should be nearing the time of decision soon so will update with the news!

    Monday morning and double success !! Halifax cc and MBNA card both been upheld in our favour !! no idea of amounts but its sunny despite the rain !!:j

    had offer letter from CT Capital
    Full repayment of Life insurance and payment of proportionable rebate of PPI plus interest :j
    All in all £7k

    However offer letter states payment will be made by 31st October
    (interest has been calcluated based on this date):(

    Can I accept the offer but amend it so that payment is made in a more reasonable time scale i.e. 4 to 6 weeks
    3 and half months to raise a bank payment sems excessive.
    I have spoken to them and not surprisingly they said this is the best they can do given the 'backlog' they have.

    Any advice gratefully received

    Might be worth firing off a further complaint to the CEO of the Bank!

  • Hello, I have today received a letter from M&S Finance saying as my loans are over 6 years old they do not have the relevant paperwork to see if PPI was paid or not. I am pretty sure it was as I was told it was a condition of having the loans. I had and still have a fantastic sickness, death in service policy at work so never needed it. Is it the end of the road here or is there anything I can do? Thanks.

    It's the end of the road unless you have comprehensive documentary records of payment from your own records.

    You could send them a SAR letter to ensure that they definitely don't have any records, but is this likely to be worth the £10 when they already say they don't?

    Banks generally have records going back up to six years for closed accounts. The ones you hear about here for older loans are usually still being paid or are part of consolidation chains etc. In other words they are the exception, not the rule.
    Marks & Spencer are no better (or worse) than other lenders in this regard.

    Hi all, just rang Barclays for update on four claims from circa 2000, was told that refund calculations are now been made, great news considering only one questionnaire sent in without any loan account details on simply and old Barclays bank account number that payments were made from! Am on day 20, any idea how long 'refund calculations' will take?!
