    Get all the details that you can regarding this debt and then put a complaint into Welcome and ask them to look at the balance you should owe, if they do not comply then take this to FOS.


    Hi, when I sold my flat, Welcome took everything, I was using CAB at the time and have been advised that as they took copys of everything at the time this should also be in the archive (fingers crossed), unfortunatly i did not keep any paperwork.

    I will be calling welcome in the morning and letting them know i am not accepting there offer and then off to CAB first thing.

    I have a few questions though,

    my mum has had ppi claims refunded and they did try and off set her payments but she got all of her ppi back to her
    as she was advised by CAB that mis-selling is technically fraud by false misrepresentation (section 2, fraud act 2006) and any premiums paid are technically classed as stolen property. the law is very clear that the ownership of any stolen property remains vested in its original and legitimate owner.


    would you know if this is correct, also my loan was 2002 and when i called about ppi, FSCS told me they could not deal with claim as it was pre 2005 and I would have to deal with Welcome directly, that is what i have done so why is my decision letter telling me my claim has been based on fscs rules.

    sorry, I'm really confused

    all i know is i thought my loan was paid off, i only ever had one loan and i have 2 ppis on this form.

    There is no way i will basically be paying 30.000 back for a 7500.00 loan, when they left me with nothing and in financial hell the first time around

    Any way i will be calling welcome in the morning and off to CAB, to see where I stand, i will let u know how I get on

    Hi, I'm still fairly new to this site if this is the wrong place to post a query please point me in the right direction! Anyway, a few weeks ago I sent 3 claims to Halifax, two for loans and one for a credit card using the letter template from this site and the questionnaire. Within one week I had a letter saying that the loans claims were being investigated and a second letter saying that the credit card was not being looked into because it sectoin 79 states that they only have to look into a live account? So my question is:
    1. In your experience in relation to Halifax loans claims, how long has it taken them to investiate the matter and come back with a final response? I know I was definitely missold on one loan, but not certain on the other. Both were cleared on time.
    2. Should I be fighting them re the credit card or are they correct? Surely it shouldn't matter if the account is live or not (I paid it off around 2007) the fact is I believe I was missold ppi?

    hi everyone, i'm new to here but was hoping for some advice on my ppi nightmare! trying to claim back from santander on a live loan, they sent letter back saying account number does not exist even though it is live, and since receiving the letter has been confirmed as a loan account number. I have asked for assistance from the ombudsman but since then i keep receiving letters saying, sorry for delay we will contact you again in 4 weeks time as your case is still being investigated. my claim was started on april 3rd and i'm starting to feel exasperated!!!!
  • I've just had a thought, and would llike some advice:
    As mentioned in an earlier post, Liverpool Victoria rejected my claim on the basis that "no CPPI premiums have ever been charged ... Please see enclosed selection of statements confirming no CPPI premiums were charged."

    They duly enclosed 4 statements and on one is an entry "Card Protect Tel" for £15.00.
    If this is for insurance against theft or loss of the card or fraudulent use, why on earth would I have agreed to that? The card company itself covers that, plus I had a Bank Account package which included insurance of this sort.

    So surely that is mis-selling a policy, albeit not payment protection?
    I incurred the debt, I repaid the debt - all of it!:o DMP started with CCCS 20/07/2007 Was £32,735. Paid off all my creditors (June 2013) 7 yrs ahead of original DFD.
    PPI claims won against Barclays x 2/ Egg x 1/ LV x . PPI claims rejected and then upheld Barclays/Egg x 2

    Im after some advice x 2.

    1) we have a loan with nemo the ppi is a single policy so Im assuming were paying intrest too, we only found out this fact the other day.
    As said we phoned nemo the other day regarding the ppi, my husband is a civil servant(police) and was also at the time we took out the loan,I assume we have a very good case?? Also a company called Relax brokered the deal for us at the time, when we spoke to nemo the other day they said Relax are at fault but considering they no longer trade we would have to apply to some goverment compensation scheme, is this true????

    2) we wrote to black horse regarding some finance we took out a few years back we recieved a response saying it was the company who is at fault so pursue it through them, is this true??? this company no longer trade either???

    sorry long winded but any help is appreciated.

    I've never heard of this!
    If you have valid complaint reasons they have to respond to them whether the account is closed or not.
    Are you certain you didn't just send them the template letter requesting terms and conditions? This might have produced the response you got, since you are only allowed to request T&Cs for open accounts.

    If you feel you have valid mis-selling reasons, you can complain about ANY insurance. The result is uncertain of course. As ever, they have eight weeks to respond to your concerns after which you can go to the Ombudsman.

    You can, of course, refer your case to the Ombudsman-but it might not be wise as this can take a year or more.
    At least they've conceded that your complaint is a valid one and is being investigated, so patience!

  • Can I confirm then with nemo Im still paying the ppi over the full term of the loan. I asked to cancel and they said theres nothing to cancel as its all into the one loan. I thought a single premium was not aloud???

    I take it this is not going to be straight forward, surely nemo are at fault somewhere????
