    This will have been a regular member of staff rather than an advisor. Filling in the form yourself would therefore be deemed a "non-advised" sale, as M&S point out.

    As for complaining that you didn't want your chargecard converted to a credit card (in 2003) that's a completely separate complaint to one about PPI.

    You can't approach the FOS about this (being pre 2005) and I'd say there is little to be gained by asking M&S to reconsider their stanc, although that remains an option..
    I think you may have to accept that this is the end of the road.

    Thanks for getting involved and I am delighted someone managed to have some success and get their money back.

    They cover in their reply about pre existing health issues saying that I should not have takent he cover and they also cover being self employed, saying that the policy covers this.

    I guess it is slightly ironic that I am off with the pre existing illness now.

    I think I'll just have to accept Marks & Spencer are not my heros anymore :(

    They are just a money-making shop selling financial services! No better (and no worse) than Tesco and all the rest.

    So it was "non advised" but they "strongly recommend" you take the insurance. How can they "strongly recommend" without knowing your circumstances or giving advice?
    By all means don't give advice, but then don't recommend the product either. It's surely one or the other.
    Had I been "strongly recommended" to tick the box for insurance, I would read that as "no insurance, no card." Even cancelling the PPI after receiving the card could mean them withdrawing it.

    These loan and card providers must have made so much money from PPI.
    I know for a fact that when finance is sold for double glazing for example, the profit is from the finance company, not the DG. The DG receive say 2% of the interest. Then PPI is sold to cover it and around it goes.

    Nearly all lenders used this phrase, it doesn't mean that they had done a full investigation in to the individual's particular financial position!
    It was just marketing hyperbole and they are currently paying a (very expensive) price for such past activity...

    Glad you won against them, they're big enough to take the hit.
    You would I take it, have read the T&C as laizydaisy did before you signed. Exemption of pre-existing ailments, self employment wouldn't allow for unpaid wages etc, so why did you take the insurance, or were you advised?

    Except it's not marketing, it's selling.
    Strongly recommending someone to pay for insurance is selling, and if not applicable, or inferred as a need to be granted the card or loan, surely it's misselling?

    Does anyone have any contact numbers for Mint and Capital one? I sent of my questionaires over 3 weeks ago but not had any acknowledgement letters as yet. Sent off Nationwide and MBNA at the same time and had theirs back within 2 weeks. Are they know to take a long time?

    Marketing a product IS selling.
    However, I disagree that simply putting that phrase into a leaflet should be classed as mis-selling.

    I also think arguing semantics isn't likely to help anyone seeking redress of mis-sold PPI.
