    Question for Di or Amersall

Hi, can you help me. Rang MBNA today to see how my claim for PPI on my credit card is going and they said there was a letter sent out yesterday refusing claim.Took card out in march 2002 till the present, but cancelled the ppi in jan 2011 once i realised it was pointless having it. we had good cover from our jobs, and wouldnt have needed the ppi. I know that when we rang up with a query about filling out the application form it 2002 we were told that without taking out PPI we were unlikely to have our application accepted.

what would you do now. once ive received the rejection letter should i go back to them and ask them to reconsider? is there a certain letter i should send asking them to do this? im sure i read somewhere once i had to threaten with the fos? is this correct? or should i give up

sorry to be a pain but i want to make sure i follow the correct procedure, am really gutted they've not upheld it, the company i work for is about to go bust and i really could do with anything, even if it's just a goodwill payment

thank you so much, hope you can help me do the right thing next

but no mention of compensation and also no mention of how much interest.
The 8% simple interest IS the "compensation".
  • I wrote to my lenders using your template letters, i received a cheque from the halifax for £473.70 within 6 weeks, I have just had a letter back from Santander saying it wasnt going to uphold my complaint because of an apparent telephone conversation I had with them in 2001 when they sold me the PPI??? I am going to take it to the Ombudsman. Do you think it is worth doing this?? Had this card for 9-10 years.

PS Very easy to claim using your forms I have recommended you to others as it is a lot better than paying somebody 30%

    Hi there

Try not to worry, not everyone's are upheld at first shot, they often try fobbing off with standard fob off letters in hope customers no longer fight or take it further.

You could write back and tell them you do not agree with the decision, give them any further information that you think may help, and ask that they send you concrete evidence of why they do not believe they mis sold you PPI (of why they came to that decision of rejecting your complaint.

Sometimes even on a final decision they may reconsider, so if you were given the final decision with enclosed details - leaflet of the FOS, you are free to go this direction now, or as said above, write and ask them to reconsider by 14 days with any other info you can forward them, if nothing is heard, or if they do not change the decision, move on to the FOS.

The FOS will look at 2 sides and you still have a good chance of being successful with these.

    Stand your ground now.
    Good luck.;)

Thanks so much, I was a bit impetuous and went straight for the FOS..... I may write to Barclays and give them additional info and inform them I have made a complaint to FOS as I was unhappy with their response and see what they come back with.

Hopefully maybe get a result in the end, thanks again Di.
  • Has anyone had any experience of Santander and claiming back PPI????

I'm in shock! Bad news and good news today:

8 weeks to the day (give or take 2 days because of the Jubilee Bank Holidays) I have had responses from two companies:

Liverpool Victoria have rejected my claim, saying that I was paying for Card Protection rather than PPI. I will investigate that, as I had blanket card protection with my Bank Account so would not have knowingly agreed to pay £15 a month for more!!!

The GOOOOOOD news is that Egg have upheld my claim for 2 loans taken out in 2004:
Total PPI Premiums (original loan + a consolidation one) £5009.90
    Interest on Premiums paid £530.03
    8% Interest £775.56
Less previous rebate paid £2937.02. (going to investigate that as I don't recall getting any rebate!!)
    Total award £3381.47

They go on to say "As your account is still open (???), .... your loan will be credited with £404.92 to put your loan in the position it would have been had you not taken PPI. ... The remaining amount ....will be sent to you in the form of a cheque, ... £2976.54"

Now, this account fell into arrears and was sold to a 3rd party ages ago (therefore technically no longer open as far as Egg are concerned, surely?) and I have been paying it off via CCCS on a DMP each month, which is why I want to find out about the aforementioned rebate, because that could impact on how much I actually owe.

2nd question is therefore why the whole amount is not being offset against the balance outstanding (which is £3,487.49) instead of just £404.93. I am thrilled that I'm getting a payout, but now I will have to pay tax on it, and then send the balance to the creditor.

Bottom line, I shall be virtually able to write this debt off now, thanks to my daughter for pushing, nagging, and insisting I claim, and for this website and forum members (too many to mention) for the encouragement during the whole process. ;)

DO NOT let a Claim Company handle this for you. DO IT YOURSELF! It is SIMPLE, and EASY and costs no more than a stamp and a couple of hours of your time!
I incurred the debt, I repaid the debt - all of it!:o DMP started with CCCS 20/07/2007 Was £32,735. Paid off all my creditors (June 2013) 7 yrs ahead of original DFD.
    PPI claims won against Barclays x 2/ Egg x 1/ LV x . PPI claims rejected and then upheld Barclays/Egg x 2

    Hi Guys!
Just wanted to say that I sent off a letter for me on Friday and one for my Fiancee, for loans we both took with Egg in 2004.
I had my original paperwork but as my Fiancee's ended a few years ago we had no details, but I still wrote anyway just giving his name, DOB and address.
Today, a week later, we've both had a letter saying our complaints have been received, and they have 8 weeks to make a decision.

So, I just wanted to let you all know that it doesn't matter if you can't find your account numbers! :T Fingers crossed we get the outcome we want!

Thanks money saving expert. I received a check for over £14,400 this morning from MBNA. I used your guide, sent in the form and after a few weeks along came the settlement. I would not of thought of doing this if I had not seen your post.

I had cancelled the card a while ago and did not even know the number!

Please go for it on your own it was simple and the instructions easy to follow
