    Sent a claim to Halifax claiming PPi back on credit card since 2004. Had a letter rejecting my claim they said that the issue of PPi would have been discussed when card taken out (not to my recollection, as i went to bank on receipt of first bill asking what additional payment was for!!!!). In addition they said that on 4th March 2004 (approx month after i took card), i agreed to PPi on the phone. I have no recolletion of this call but find it strange because i dont likr agreeing to anything over the phone i prefer face to face meets.
    Is it worth forwarding to Ombudsman as it seems its the word of the bank against me. Anyone else experienced similar and how did you progress.

    Hi Andy

    Do not give in

    You can try by asking them to reconsider by about 14 days, if you hear nothing or if they do not change the decision in your favour, complain to the FOS then, it's up to you of course.

    Sometimes they will also change a final decision - depending on what further info you forward to them to consider.

    You could write back, tell them you do not agree with the decision you made, and not satisfied and would like to them reconsider with the further information enclosed.
    Tell them you remember clearly that you went back to the bank to check what it was and as a respectable bank they should have note of this on file.
    Then ask them to provide you with details of concrete evidence of the phone call - as they stated that you agreed on the phone, and you wish to be provided to evidence of this, and understand they must have it to have told you this on the letter.
    Tell them you are not in a habit of accepting any product on the telephone, and you feel they've totally overlooked your complaint, and wish them to reconsider.

    And anything else you feel that would help.

    My letter did not mention interest at all, this was as an whole standard offer.;) They sent by cheques.
    If interest was involved, they would have to confirm but in these standard cases there's not.

  • i am trying to claim back 7 years worth of PPI from MBNA & capital one. I've had no reply from cap one but MBNA wrote back saying as it was a postal application and I'd ticked the box therefore I don't have a claim and this is their final response. Is there any point in taking it further, I don't remember ticking the box but I took out the policy in 2000, I cancelled it in 2007 when I realised it was on there, I explained this in my original PPI application. is there any point in persuing it? any advice would be much appreciated!

I have today received a letter from MBNA confirming that my claim for PPI has been upheld and to expect a cheque for £8,300 in the next 28 days.Your articles - and coverage on Radio 4's Moneybox programme - prompted me to take action, which I did just over a month ago. The effort required on my part? 1. Get over my inertia and get active. 2. Dig out as many of my credit cards statements as I could find and then use your templates to write a letter to one store card and two credit card companies where I had accounts but no longer. 3. Download the official PPI claim form and fill in a separate form for each claim. Then post them! The process took maybe 3 hours in total. So one positive result thus far, I'm awaiting for two more.
    I would encourage everyone to check their credit card or loan statements and if they feel that they were mis-sold PPI, or just query why PPI was necessary, then make a claim. I should have done this years ago! Once again, very many thanks!

    I would go ahead with your claim. I've just had (today!) notification from MBNA to expect a refund of PPI. If they still resist, let them know that you will be in touch with the FSA etc. There is a helpful template letter on this site about contacting the FSA. Good luck!

    Hi, just to provide an update on a success with Black Horse Finance on a loan. We wrote to them months ago, they refused despite my mum being self-employed and havign chronic health difficulties. We challenged it directly with them (using the templates on this site), they again refused again so we wrote to the Ombudsman earlier this year. They have had a huge backlog, but have kept in touch with a couple of letters, we finally today received a letter from black horse admitting that they had made a mistake in their original judgement, and are awarding £3700 in mis sold PPI! Thanks for the guidance on this site, I have been able to support my mum in this claim and another one totally nearly £5000, and my partner in reclaiming PPI on barclaycard sold as a student, totalling nearly £7000 - very grateful for the templates and guidance on MSE

    Hi everyone,
    After months of procrastination, i finally decided to go ahead and put my claim to HSBC and HFC bank. I have received letters today from both banks upholding my claims and i will receive just short of £15,000. It only took 4 weeks from start to end. I am absolutely floored, still in shock. Thanks to reading all your successes and advice, it gave me the courage to go ahead!! Ta!!

    Just had a very similar scenario, postal application in 2001 and cancelled last month etc -

    Someone on this board kindly suggested I ring MBNA to check if they'd actually pay out if I'd have had to claim in the event of sickness. (I also have good sick cover with work NHS).

    No they woudn't was the answer! This is on telephone record now and MBNA advocate advisor suggested I ring FOS straight away and begin the appeal.

    I feel a bit more optimistic now even if the wait is a year!!
