    Hi, this is my first post on here and Im looking for some advise. I have had my complaint rejected from Barclays and to be honest I am quite shocked at their reasons for doing so. My complaint was that I was mis-sold PPI when I took out a credit card from who was then Morgan Stanley back in 2002. Basically I was approached by someone who asked if I would be interested in taking out a credit card. He completed the form for me to take out a credit card, he said the PPI was not optional. He did not explain any terms and conditions. I cancelled the PPI when i realised it was optional. I was very specific in my complaint letter and can remember the location it was mis-sold. The reasons for the rejection are that there is no evidence of mis-selling, they also said that at the time it was company policy to explain all terms and conditions(whose Barclays or Morgan Stanleys?). They say it is their final response but at the same time they ask me if I can provide any more evidence such as statements etc, but I fail to understand how that will help. I rang them to ask exactly what I could provide which could prove I was mis-sold but the person I spoke to could not say, and I got the impression he was quite suprised himself that the claim was rejected. I am going to contact the ombudsman as I feel my complaint is a genuine one which should be upheld, can anyone tell me how long this usually takes? Also do you think it would be a good idea to write to barclays asking them to reconsider as I dont accept their reasons for the rejection? Any advice will be greatly appreciated.

    I wrote to Tesco, complaining that I felt that I had been pressurised into taking out PPI when I telephoned to register my credit card with them. (No other option was available).
    I received a letter from Tesco Bank today with an apology and refund of my insurance payments plus interest. Total of £300.15. This can either be added to my account or sent to me as a cheque.
    Off to telephone Income Tax helpline now to find out what tax
    I need to pay on the interest. Whatever it is I am grateful to have the insurance premiums returned and anything else is a bonus.
    Without the encouragement of your articles I would never
    have thought I had a chance of being successful. Thank you

    thankyou to the people on here for all the info and to those that helped me.
    i found out this morning that egg have upheld in my favour (egg loan) and a letter confirming that and my refund will arrive in post shortly....thats all i know,no amount.

    unfortunately....and this is what i'd appreciate a bit of advice with please...

    barclaycard gave a final response refusing me.
    now....they refused me because they said it was a postal application for ppi after the card was taken so i would have asked and understood.
    COMPLETE LIES!!!!!! as i stated in my claim and paperwork i got the card,complete with ppi in branch and was basically told i had to have it or i couldnt have a card.....i vividly recall that day as i literally went in travel agents,booked a last minute hol then went a few doors down to get a credit card for spends!!!! and told the man this!! and was young and niave so believed i had to have it.

    i rang barclays back but they say now that final reponse letter has gone out it doesnt matter if a mistake was made my only option is the ombudsman.

    so where i would like help is in phrasing this to the ombudsman,im so damn fustrated and angry that its a complete lie that i want to compose myself and fully think it out and what to say before i contact the ombudsman....i do not want to cry on the phone,neither do i want to get too angry!! help please x

    Some of these success stories are fab!! and give people like ourselvs lots of hope, my husband and I recently sent out a PPI claim form -(dowmloaded from this site) to RBOS for misold PPI for a loan of £6000,but with an added £1700 for PPI - we hadn't a clue at the time what this added figure was for, as this was back in 2004, today they wrote to us and said the form we used was not acceptable and we have tro do it their way! Any one else had this?

    This is my first ever post - eeek!:eek:

    I sent 2 ppi requests to Halifax two weeks ago and got a letter of acknowledgement confirming that they will investigate and respond within 8 weeks. Fingers crossed!

    Things like this never happen to me, my hubby and I are in severe financial hardship and reading these stories is making me really emotional because just getting a few hundred back would make such an enormous different to us, I can't bear to think about actually getting any money back in case it doesn't happen :(

    Your story is exactly the same as mine!!! I am dreading but excited about getting replies to all 7 of the companies we have claimed for, I am also scared of getting my hopes up as like you my husband and I are in financial difficulties and any form of compensation would make a massive difference in our lives!

    Also had 2 successful claims from MBNA...

    The only time ever in my life where being an excellent debtor has paid...

  • I'm a wargamer - have been for years, a huge geek and proud of it. My wife was taken ill a couple of months back, which had a serious impact on our finances as she could no longer work. We'd gotten into debt but could cope with it if we were both working. Now we couldn't cope.

    So I went to war, in every aspect of my life.

    I've budgeted, scrimped, saved, claimed, questioned every purchase, queried every price. I'm biking to work every other day - it adds up to about 60 miles every week. I've sold £100's of my stuff. I'm painting models for people on the side to make extra cash.

    Everything has been a tactical decision. Everything has been a battle. Thinking about it in these terms has helped me get through.

    Finally, I've won the first battle. Lloyds offered me £2800 this morning for my mortgage PPI claim. I claimed back on several points - It didn't cover me for a pre-existing condition, it was single cover PPI on a joint mortgage, I already had medical insurance, and it was pressure sold.

    This site, this thread, gave me all the ammunition I needed. I've sent letters that if they were people would be aggressive, bolshy nutters, with a broken bottle in each hand.

    I cannot thank you all enough. I've been lurking here, reading this thread every day, and it has kept me sane(ish), stable, and on the bounce, ready for a scrap.

    Keep fighting, all of you. It's your money. It's your life. No-one has the right to take your money or your life away from you. If anyone tries to take what's yours, fight them tooth and nail.

    They should never have tried to take what they couldn't keep.

    over 12 months ago we put a claim in via a claims company(was that a bad idea!) to Welcome Finance, this went to the FO and we were given a payout of just over 7K, of this the claims company took nearly 2.5K (told you it was a bad idea) ALSO (and didnt realise we had done this, but they has paperwork!!) a referal company took just over 1K... so we ended up with a little over 3K.. a huge amount of money to us but not as much as we had been awarded... (live and learn eh)

    learning from this mistake I made a call to HSBC with regard to loans we had taken with them well over 7 years ago, didnt have any paper work, not reference number or amouts nothing...
    the lovely chap I spoke to gave me an address and told me to just write in asking for the PPI back...

    they wrote back saying that they would look into it and get back to me....

    today they have.... offering us £6005.78p. non of this is going to a claims company or referal agency..

    all from one phone call and one letter with a 1st class stamp (not even recorded)

    had I know JUST how easy it was the claims company wouldnt have got a penny..

    happy days and a new kitchen on the way :)
