Received a letter from the Clydesdale yesterday, 7 and half weeks after I put in the complaint about 2 loans. Brilliant news they are upholding the complaint. Better still they themselves have refunded for 2 extra loans that we hadnt claimed for.....Amount £5723 WAHOOOOOOOOOOO. They have also restructured our existing loan so we are paying less every month!!
On 3 of the loans they have stated what the refund is and the interest that is to be paid, but for the very first loan there are no calculations apart from the £900+ they are refunding. I was wondering how this one would work for paying the 20% tax as there are no calculations for that so I assume I would have to contact HMRC myself to pay it.
A big Thank you to everyone on the site for their help and information, and for giving me the courage to go for it.0 -
I used Belmont Thornton (my bad) to make a claim against LLoyds. I started this process in April 2011. I got an offer from LLoyds in Aug which I accepted £1495.86, happy lady.
The fun then really begins!!!!
I received £1036.26 into my account at the end of Aug, Belmont wanted paying their fee of £448.76, I paid them in Oct after asking them about the outstanding monies that I was owed £459.60, they told me that Lloyds would get that to me.
Lloyds then sent me a letter in Nov apologising for the delay on my payment and explained that I was yet to receive the 8% simple interest, due to the delay they recalculated my offered and the breakdown was: original 8%offered £191.07, additional 4 weeks at 8% £3118.00, total payment to me £3309.07?????????This was going to get paid into my account in 21 days, I then received a cheque to settle my claim for £210.86 (no idea what the amount is)
I rang Lloyds and they said the the £3118 was a mistake and they couldn't see a copy of the cheque on their system. My claim was going to be put back into refunds to get sorted out. Belmont have then continued to ask me for payment of £935.40 as they think that Lloyds have given me £3118. I have made numerous phone calls to explain to Belmont that I have not received this money and all I am owed is £448.76. I have also been receiving notice before action letters etc and I have to keeping ringing Belmont and explaining the situation over and over.
I informed the Financial Ombudsman of everything that has happened, they told me to wait 8 weeks which I did, i informed them again and they took it on saying it may take 4 weeks and I have just received a letter from them now saying it could take upto a year. I am at my wits end as I have to keep informing Belmont otherwise they will be be coming to collect the outstanding debt, which I DO NOT HAVE.
One day it might get resolved0 -
Just had a letter from Halifax upholding my complaint
My loan was 3k so was expecting much back so was surprised to see £1335.63
Now the break down was
£742.50 Premiums
£237.18 Refund of Interest
£355.95 Interest at 8%
So the 20% I have to pay is that just on the interest at 8% or that and the refund of interest ?
Also do banks have to refund by chq as it looks like Halifax will take 28 days to issue it.0 -

Had ppi on loan with Picture loans, who went under. Thought I had lost the £2700 I paid in. Then through this website, found out that capital one had taken on Picture and pursued a refund through capital one. This took ages. First of all, wrote to them, waited the necessary time, then phoned and they said they don't take queries by phone but did tell me that I had used the wrong address.
Tried again, but very frustrating because they will not discuss any aspect of PPI by phone. I kept writing letters- they took longer than legally allowed but yesterday got an offer of £3500 in the post. Yippee!
Thanks Martin- nice to know there are folk helping that aren't in it just for themselves. Restores faith. :j"To exercise power costs effort and demands courage." Oscar Wilde

The tax is on the 8% amount only, have Halifax paid this 8% net or gross? if it is net then they have already taken the tax.
I'm assuming gross as on the letter it states

Just had our rejection letter from barclaycard and just wondered if anyone can tell me what we need to send to FOS, is it copies of the forms we sent to barclaycard and the rejection letter from barclaycard and a covering letter from ourselves? Thanks in advance for any advice.0
