Hi. I have a question. Will try and keep this as brief as I can. As my previous post said I had a masterloannwith Barclays. Not sure how much or how long.ncalled them. They sent me a form. I filled it in 8 weeks later got a letter with and offer for £1800 pounds and a cheque enclosed. The offer letter said this" our customary process is to offer a full refund of the insurance premium plus interest paid on the premium to date plus 8% per annum simple interest. However as the sale of this policy was so long ago we no longer have any records of the premium you paid. It is therefore impossible for me to calculate any redress that might be due to you . As a gesture of goodwill I am prepared to offer you a refund of £1800 ...(now the important bit)..if you have any records that will give me the information I need to calculate an accurate offer I would be very happy to consider them.
Fine.
Today I received a package from Barclays from a SAR request i made 4 moths ago!!. In it was my credit agreement for this loan. The amount of loan was £10,000 . Plus charges was £13,466. Monthly payments :£224.11. PLUS...premium loan of £2124.28 plus credit charge of £731.72 total premium loan £2856.00. Monthly payment £47.60 for 60 months. According to the credit agreement the premium loan is a ppi payment!!!!....
I have 2 questions 1. How much more can I expect to be returned bearing in mind I've had £1800
2. Why can I get this information but Barclays who took 12 weeks to investigate my claim could find no info?e written back to the person who dealt with my claim with this new evidence so will wait and see what they come up with.
Thanks

I Sent 2 questionnaires on 2nd April to Rbs regarding 2 lombard loans.
Had a reply dated 25th April for one of them they could not progress any further because not provided them with enough information
Please provide more information so we can proceed.
Start date, end date, loan number and loan amount and any other information. You can apply for SAR at the following address.
I found more info and sent start date, end date, loan amount, last 4 digits of account number and monthly payment.
Had a reply Saturday same letter as the first one.
Phoned them - Because it was a lombard loan they don't have any information so told me I would have to write to Lombard direct finance
and get more details. This is not the same address stated on the 2 replies. While on the phone I asked them to check my other loan and gave them a reference number, a letter sent out on 24th with offer. So if they can do this for one loan why not the other:(
And how come letters take over a week to arrive0 -
Hi everyone I hope someone can help please.
I made a claim to Santander after discovering that I opted for no Ppi on my original Debenhams card application. I have received a letter today stating that I opted to accept the Ppi via a telephone call some years after the original
period and that the advisor explained the features of the policy. It also states (I quote)
'As to ascertaining the personal onfoation from a customer to determine their suitability for the product , this is a requirement of an advised sale under the FSA regs and our insurance sales have always been non advised. '
What do I do next I have been told premiums paid are approx £ 1350
So how do I prove now that I was given full information? The call to sell to me came from their telemarketing dept .
Any advice would be welcome thank you0 -
Had reply today.
'Having checked your account details.I can confirm Account cover. I have enclosed a copy of your credit Agreement.
I note that you say that you were not told that the policy was optional when it was taken out in 07 September 2002, but I also note that the process that we had in place was to make it clear that it was not compulsory. I can confirm that on the agreement you signed it required you to sign if you required Account cover which you did.You could have cancelled after 30 days.
In relation to your reference to the sales process in store there was no requirement upon us to record sales process and so we have no way of knowing what took place. However if any of the matters that you suggest took place you would have been able to call at any time in the first 30 days and we would have removed the insurance from your account. Since the insurance has been clearly shown on your statements you could have cancelled at any time.
I can find no evidence of mis-selling therefore I am unable to refund the premiums.
If you remain dissatisfied with our responce refer complaint to FLA'
Not going well with our claims.
sent letter to them to say I reject the reasons, not given any information regarding ppi cover nothing explained to me etc
Had a reply today dated 21st May
'I have enclosed a copy of credit agreement for your reference, which shows that you had requested insurance.
I note that the process that we had in place was to make it clear that it was not compulsory. You signed for the account cover. Therefore it seems it was made clear that the policy was optional.
In relation to the reference to the sales process in store, there was no requirement upon us to record the sales process and so we have no way of knowing what took place on 7th sept 2002. This is our final responce if you are dissatisfied you may refer to the FLA.'
Do I take this to the FOS?0 -

Why can't they just transfer??? Within an hour someone had rang me back from Chester customer relations apologising and that I had misunderstood the 28 days....a cheque was issued on the 23rd (the day before) 2nd class post (bet it doesn't arrive today though even though 2nd class is 3 working days incl Sat!) I have a direct name & no to contact them back x:rotfl:
Hi OobieDoobieDoo, could you tell me address for the CEO for the Halifax just wondering if he is also the CEO for the Bank of Scotland
since they amalgamated. Thanks MADCAT1130 -

I have had my reclaim for front loaded ppi turned down and I have written to voice my disapproval of this but would also like to copy the CEO in on everything as in the letter I rec'd was an interesting quote:
' The policy was provided on a non-advised basis therefore Nationwide was not required to ascertain your circumstances with regard to health, existing insurance,e,pliyer benefits, savings or alternative means of repaying the loan nor was the Society required to assess the suitability of the policy for you'.
At no time did I request ppi, it was not explained that it was optional (Nationwide had filled it in on paperwork and I assumed it was a condition of the loan) and now, by their own admission, they say they did not assess my circumstances.
Surely this is mis selling?
this was a loan on the loan paid to term end with interest, if you cancelled the PPI they would have given you a pro rata rebate of the PPI and the remaining PPI is still on the loan to term end.
If you settled this loan early then, as above you, would have a pro rata rebate and you would have paid back the remaining PPI in with the settlement figure.

Was looking for some advice I got an offer from Halifax yesterday but unsure if it is correct. I opened the card around 2006 but got into some financial difficulties about end of 2011. I was offered the below
Refund of premiums:242.44
Refund of interest applied to the account because of the ppi:218.33
Interest at 8% calculated until 20 June 2012. 11:13
So a total of £471.90
I am not sure this is correct as I had the card for a number of years before going into financial difficulties and I have paid more than this in PPI over the years.
Should I contact Halifax and ask them for copies of all my credit card statements from when I opened my credit card.
You may be better sending a Sar request for £10 and request all info they hold on you, give them 40 days to respond, but let the Halifax know that you are rejecting the offer, pending the information from the Sar.

Do I have to accept this or am I entitled to the cash?
I am not in arrears with the credit card and as I didn’t ask for the policy I didn’t sign to say I agreed to terms and conditions of refunds so If I would like my cash am I not entitled to Cash???
Sometimes they have to pay the refund to the card and then send you a cheque, as you have no arrears you need to ask why they are doing this and if you get the money back once they have done the credit to the card.0
