I made a claim to Santander after discovering that I opted for no Ppi on my original Debenhams card application. I have received a letter today stating that I opted to accept the Ppi via a telephone call some years after the original
period and that the advisor explained the features of the policy. It also states (I quote)
'As to ascertaining the personal onfoation from a customer to determine their suitability for the product , this is a requirement of an advised sale under the FSA regs and our insurance sales have always been non advised. '
What do I do next I have been told premiums paid are approx £ 1350
So how do I prove now that I was given full information? The call to sell to me came from their telemarketing dept .
Any advice would be welcome thank you0 -
sent letter to them to say I reject the reasons, not given any information regarding ppi cover nothing explained to me etc
Had a reply today dated 21st May
'I have enclosed a copy of credit agreement for your reference, which shows that you had requested insurance.
I note that the process that we had in place was to make it clear that it was not compulsory. You signed for the account cover. Therefore it seems it was made clear that the policy was optional.
In relation to the reference to the sales process in store, there was no requirement upon us to record the sales process and so we have no way of knowing what took place on 7th sept 2002. This is our final responce if you are dissatisfied you may refer to the FLA.'
Do I take this to the FOS?0 -

Anyway, I just wanted to say that I wouldn’t have had the confidence to make this complaint in the first place if it hadn’t been for the superb advice and encouragement of the terrific people on this forum (and Martin’s guide of course), so thank you very, very much. Never underestimate the fantastic work that you’re doing. I don’t think it’s putting it too strongly to say that you’re changing people’s lives.0

reply to amersall.
Thanks, I tried FSCS but it's 1997 too old for them. Phined Ombudsman and they going to try and help me. Fingers crossed but I don't hold out much hope.0 -
Just thought i'd let you know that i made a claim for ppi from Blemain on 12th April for a 15,000 secured loan which was over a 10 year term, but we paid back a year later. PPi was added on in a lump sum. (main reason for claim and the fact that we didn't ask for ppi it was just added on) They sent me a a letter and a form a week or so later which could be completed and posted back or done online. I did it online the same day. I got a letter back from them on 24th May saying that there was not enough evidence for him to be sure we had all the relevant information to make an informed decision and as they could not locate a recorded phone call for the sale of ppi, he was upholding my complaint. The ppi added to the loan was approx £2600 and they are sending a cheque for £5126!!
Always have a go at claiming if you think it was missold.
I am still waiting on MBNA, Barclaycard, Welcome Finance and Vanquis, all letters sent same day.
Good luck with all your claims0 -
Hi All
I had a smile CC from 2001 which had PPI and ran into trouble and could not afford the repayments in 2008 and after loads of threating calls and letters The co-op offerd me a loan in 2009 which was the CC outstanding amount plus over £3,000 interest so basically around a £12,000 loan the PPI I paid over the years is that right for them to put that in the loan amount ? (Thinking about it a bit of a silly question) .0 -
