Hi, sorry if this is a dumb question. Im going to claim ppi from Capital One, can I include late payment and other charges on the same letter, or does it have to be seperate?

Enter them as separate complaints for a number of reasons:

1 - you dont want to complicate your complaint with several factors which may make things harder when it comes to pinpointing their errors.

2 - they will deal with one complaint letter from you, with one complaint letter back so it would be treated as one and they will use these several factors to confuse you further and even try to play one complaint off against the other

3 - PPI and charges refunds are also administered differently and are subject to different rules. - PPI can be paid to you by cheque/cash if you so choose, they are not obliged to make a direct payment to you for charges so they only reduce your balance and they wont accept it as a "payment"- it goes as a credit reversal.

4 - generally anyway, the clearly and simpler and more direct and to the point you make your letter, the harder it will be for the bank to answer to.

I can envisage some office clerk at Lloyds arriving at his/her desk every morning at 9am and at 09:30 the internal mail man turns up with a sack load of PPI reclaim letters.

Thanks. I still have a balance on my capital one card although I havent used it for over two years (I had some financial problems two years back)

Will they take any money I reclaim off my balance? or pay direct to me?

I just want to get the balance cleared then get rid of Capital One, they have caused me so many problems in the past.

  • I posted last week about recaliming PPI, at the same time i got in touch with a certain claims company. This company are just off the phone and have told me that there are flaws in my loan agreement so they could claim my PPI but also get the remaining balance on my loan cleared and compensation, interest, etc.. paid back to me. Problem is they charge £495!!

Is there a way i could do this myself? I know how to reclaim PPI myself but not how to get my remaining balance cleared.

    Hi Paul Mitchell

I would keep right away from them. The 495.00 you pay up front you pay whether they can take the case on or not. You can claim the PPI back if you feel you have been miss sold by following the advise on this site.:D

Agreed. PPI reclaiming is fairly straightforward to do on your own.

Getting debts wiped out is another matter and I said how I see it on many threads - it is not as simple as writing a few template letters and waving the CCA 1974 photocopy in their face. Its more complex and unless you know what you are doing, then you risk being liable for costs etc.. from the bank for losing a case.

There are claims firms, and then there are "claims firms". Alot will charge upfront, but some offer 100% refund upon unsuccessful cases and tbh - Iwould personally weigh up paying a few hundred quid to get rid of say a loan workth £10k - 5% is not alot to invest when you get a law firm doing your work who are covered with insurances and know what they are doing.

    Tread carefully.
