hi guys great thread. im new here so plese be patient with me as i need some advice on where to go next with my claim.
i opened a dispute with lloyds tsb on feb 7th over the phone with their dedicated ppi team and in that phone call i told the advisor that i wanted to complain about the restrictions and limitations on my ppi when i took out the policy as i was self employed at the time. they didnt ask me any questions about how long i had been self employed and didnt tell me of any limitations should i need to make a claim. I also insited that i wanted to complain about the manner in which the policy was sold to me as i asked the sales person if i needed the ppi and she said that i would "need" it in case i became unemployed. they have since sent me a letter to tell me that they have considered all the evidence regarding my claim and that they are unable to uphold my complaint on the grounds that the features of the policy were adequately presented to me. they have based this on the fact that they gave me a policy summary booklet. however not being a legal expert a lot of the jargon in this booklet is very confusing and not completely transparent.
here is a quote from the letter i have recieved
"the documentation provided both at the point of sale and after purchacing your ppi policy, such as the policy summary and policy booklet, fully explained the benefits and limitations of this policy. Iam also of the opinion that this was brought to your attention at the time of sae"
no i cant understand how someone sitting in an office at lloyds head office can have an opinion on a sale that occured face to face between me and a branch staff member when they werent present at the time?
i was thinking of asking lloyds for a copy of my origonal policy terms and policy summary along with any information that they have used in coming up with this response before persuing this any further as when i spoke to them yesterday they said that i should contact the ombudsman and i want to have all necessary info and evidence available before continuing. any advice would be greatly appreciated and soory about being so long winded about it all.
Hi and welcome
I have left a post on the other thread for you (PPI discussion thread).

Hi all, Hoping someone can advise me on what to do next... 6 weeks ago i sent off the initial letters (5 in total) asking for copies of my agreements. I sent them all a cheque for £1 and expressed i would await 12 days for a reply. All the cheques have been cashed but 6 weeks on and no replies. I'm not too sure what to do now...
Thanks in advance Laura0 -

Hi Laura
That is a very long time.
Contact them and make them aware of what you know, cheques been cashed and still no copies of agreements etc.
You can still make a reclaim though, as long as you know you were sold and mis sold PPI, by just completing a reclaim questionnaire as on step 3 below, send to the ones responsible for setting up your account and keep copies for yourself as well.
Good luck and keep at them.;)

If you had PPI and were mis sold and have the account numbers, then put the claim in for mis sell, you do not need a copy of the agreements to do this.
If you need the agreements to find out if you had PPI and the accounts are closed they will not send you these, you would have to a request for all info they hold on you this will cost £10 per bank.
PPI agreements may sometimes not show PPI as this could have been added at a later date.0 -

I received a letter from MBNA to say that my first (and only) letter of complaint regarding PPI was being upheld and they have offered me £4700. I took the credit card out around 10 years ago and when I wrote, I followed Martin's advice of including a £1 cheque for a copy of the application form. There was a box relating to PPI (which was very vague and did not explain exactly what it was) and I had ticked to say yes, I want it. I only sent my letter off around 2 weeks ago and they have settled including 8% interest. Do not be put off, it is worth trying.
Thank to Martin for his easy step by step guide. :T0 -
:beer::beer: Brilliant wins so far :j:j:j0
