  • Thank you soooo much Moneysaving expert, we received £1378.90 refund from a missold PPi, My Husband is self employed & PPi only covers you if your business becomes bankrupt NOT if you have no work & can't meet the loan repayments.
It took just 2 letters to Santander, 1 to ask for the T&Cs of the loan as we could'nt find our copy & a £1 cheque, then another to ask for a refund because we had paid it on our £6000 loan.16days later we received a letter stating we were missold PPi, we returned the forms out just 15days the money was refunded directly to our bank account.
It was very welcome but still really annoys me that they did it in the fist place.:j

It should just be the Rebate Refund of £773.85 you declare for tax.

Thank You for your reply. I will phone HMRC and advise them. :j

I have just had a confusing letter back from HSBC regarding my Credit Card PPI complaint. It reads 'With regards to your HSBC Cardholder Repayment Protector, as a result of my investigation I am prepared to uphold your complaint.', so I am thinking that I am going to get some sort of settlement, as all my other complaints have been upheld and I have received money. However the letter then goes onto say 'As your complaint has been upheld, I have not addressed the individual issues raised. As previously mentioned HSBC is only required to retain records on your account for six years. As your policy was cancelled in December 2005 I have been unable to locate any evidence of your paying any PPI premiums. If you have any statements showing PPI was paid, then please forward for my attention, which I will be happy to review.

This has confused me, first of all if they are upholding my complaint, I thought (based on my other complaints) that that meant my claim was successful and that I would be due a refund? Secondly, they say the policy was cancelled in December 2004, my card is still active to this day (zero balance though)! And thirdly, December 2004 is more than six years ago, so how would they know this information if they only keep records for six years?

So I just wish to know, do I have a case to ask them to re-open this investigation, any feedback would be brilliant, thanks :-).

Obviously they want you to provide documentary evidence that you paid PPI for this period. If you don't have any, you could send a SAR letter

and see if this provides any.
I certainly wouldn't give up. Take it to the Ombudsman if necessary.

Your query about your card still being active today is irrelevant. They mean the PPI policy on your card was cancelled in 2005.

Ok, but how would they know if a policy had been cancelled in 2004 if they only hold records for 6 years? Also the Credit Card number on the letter is a different one to the credit card number on the card (although the Credit Card is a new one as I lost my old Credit Card a few months ago), even though surely the number on the letter would match the card I currently have?

Also, I thought if your complaint was upheld, that meant it was successful?

I can only repeat my earlier advice to apply for a SAR. You'll then be able to see what the Bank has on file for you for at least the last six years, but sometimes more.
The Bank have upheld your complaint because it agrees you were mis-sold the policy. They are withholding any redress because they do not have evidence that you actually paid on the policy. They are putting the onus on you to provide some.
If you get no joy from the Sar/Bank, take it to the Ombudsman.

Just to let anyone with RBS claims know, they paid out my PPI exactly 1 week after I posted my success on here and accepted their offer !

Thanks again to everyone here for their support during my claim
