Two weeks ago i was going through my drawers looking for a document when i came across a old bank loan i had with Alliance Leicester which said i was paying PPI so i phoned up Santander who now own them, gave them my info and yesterday i got a letter saying i was getting £252.90p back :j:beer::T0

Two successes so far:
What were you reclaiming: loans
Who was the provider: HSBC and HFC
How much did you get back: £1850 and £1956
Did you get it back after a letter or did you go to the Financial Ombudsman: letter
And then write your brief reclaim tale: Used the resources on this site, spent about 30 mins in November digging out old paperwork to complain about a loan with HSBC. Complaint was was upheld and paid within about six weeks, just before Christmas. Spurred on by this, we dug out OH's paperwork to complain about a HFC loan and two HSBC loans in January. Turns out there are four HSBC loans they are going to investigate. Got HFC response today, about 7 weeks after initial complaint. Complaint was upheld so we just need to agree the decision and wait for the money.
Still awaiting the results for the 4 HSBC loans - they have about a week left of the initial 8-week period for investigating the complaint. Fingers crossed and we are definitely not counting any chickens but still v happy with the best part of £4k for an hour's work!0 -
And now i've just remembered about another loan i had,ive got no documents, only thing i've got is bank statements from 2005 which shows the money being taken off every month,so i phoned up RBS and they've told me i need to go into my local branch to see about it.:j0

I took out a M&S store card in 1995 that ran until 2006 with PPI on it and a personal loan from 1999 to 2006 that also had ppi insurance on it. I have already raised my complaint with M&S money and they have declined it as it was not covered by the FOS at the time. I have raised all the paperwork with the FOS and they have declined the complaint for the same reason but told me to pursue the insurance company Allianz which I have done. This has also been denied by the insurance companies so I have gone through the FOS aswell in August 2010. Every few months I get a letter from the FOS saying that they are still looking into my complaint. I have received another letter from the FOS as follows.
"We continue to consider the complex legal arguments involved. I am sorry, this is taking longer than we would like. But it is very important that we investigate thoroughly as we need to decide whether we are legally allowed to look into your concerns about the sale of your policy.
We will continue to keep you updated on our progress and we will write to you again by 30 November 2011."
Has anyone managed to claim against the insurance company vis M&S in the same way?
I still don't know how to progress with the above... I have re read the letter and have until the 2/03/2012 to reply.
The FOS are stating that they recommend my complaint should not be upheld as although there were shortcomings in the way that Allianz sold the policy to me they are not persuaded that I would have acted differently and would have taken the policy anyway...My defence was that the documentation was filled in by a salesperson in the store and I was told that I should take it out on the charge card and when I took the personal reserve out I took it out as I had done previously. Is there anything I can now do or say to help my case.I would appreciate any advice on this in any way as this is a substantial amount of money involved.
Ok I have contacted the adjudicator since posting this comment and thought I would update everyone as it may affect you too. As M&S were not covered by the FSA at the time of my claim it is now being claimed against the insurance underwriters. This is being called Project Atlantis at the FOS and the test case is due to go to court later this year. All my letters over the last 18 months have informed me to wait until this test case is bought to court. The adjudicator assigned to my case informed me in the letter that he was making a decision on my case and ruled I was not entitled to claim my PPI back. I queried why he had made a decision when Project Atlantis had not gone to court yet. At this point on the telephone call he explained he had made a mistake and would get his manager to call me back. The next day I received a phone call from the adjudicator not the manager saying that they had been given the go ahead to process claims against M&S and not to wait until the test case had been bought to court. He intimated on the phone call that he would still rule against me for the reasons below
1) I had ticked the box on the application form and signed it
2) I was not self employed or had a pre-existing medical condition.
I am going to challenge this on the wording of the form which states that M&S money strongly recommend I tick this box and sign the form
Also Am I right in thinking that if I had PPI insurance on the charge-card that I tookout in 1995 that would have covered me for the loan as-well so I did not need the cover on the personal reserve.
And is there anything else I can use to help me because I may lose this at the moment.
many thanks

Success!
After First Direct initially refused my claim without answering my main concern, they have now changed their minds and offered me £750.
I've still got 3 outstanding claims (2 with Tesco Loans and 1 with First Direct Loans) which were all front loaded amongst other reasons. Just 1 more week to go with these until the 8 weeks are up. Hopefully I should hear something soon.
I've also got a credit card PPI claim to put through. Must get off my rear end and get that done.0 -
We got successful letter from Halifax offering us £4100 or thereabouts. Only thing is it's the Mortgate Protection Payment, so if we accept this (basically refunding our monthly payments), we won't have this cover anymore.
Having a look around, but I don't know if we will find the same cover elsewhere... Therefore we may have to just refuse it, and carry on.Everybody dies, but not everyone truly lives0 -
Received a reply from MBNA stating they are turning down by complaint as I had ticked a box for PPI, thus it was a non-advised sale. They enclosed a photocopy of the agreement which shows that I have ticked the box.
I had raised a complaint as I could have sworn that this policy was sold to me over the phone...
They have also stated that this is their final decision and to go to the FOS should I wish to take it further.
What are my options now? As far as I can see, I have none : I ticked the box"I don't want to sound cold and un-caring, but I am those things so that's the way it comes out" - Bill Hicks0 -
Sent a letter (by recorded delivery) to MBNA on 22 Feb - no response yet. Does anyone know how long it took MBNA to reply to their letters? Thanks0
