I would definately E-mail them and also Amersall drafted a letter which I re-sent to Firstplus with re-defined reasons for the mis sale.
In all, it took less than two weeks for a desicion after the CEO was contacted.
As the loan is frontloaded with PPI, the FOS will pass in your favour as these loans have now been withdrawn from sale due to the very nature of them.
Don't give up, you may feel deflated now, but believe me, you will get the justice you deserve if you just persevere!

The rejection letter finally arrived this morning. It was 3 pages long. Basically it went like this:
We have reviewed the sales process and are satisfied that the sales representative would have followed the correct procedure. In addition we reviewed the telephone call recordings and are satisfied that the Account Manager explained to you the key features of the policy.
First of all you write back to them and ask for the recording
It then goes on to list timings and what was said between first plus and my husband:
At 38 minutes 42 seconds a breakdown of the costs were given. If you choose to take out the ppi the cost of this is added to you loan and the additional monthly payment is £157.72. Are you happy with the quotation and my recommendation for you to take the cover Mr XXXX? Yes I am repied Mr XXXX.
He did not say to you that the ppi will be on your loan to term end with interest and the total cost that this entailed,you thought that you were only paying this ppi for 5 years.
The next part of the letter goes like this: At 41 minutes 01 seconds the CAM states "the cover lasts for 5 years after that if you havent made a claim you can claim a refund equivalent to half of the insurance premiums. The CAM then asks later if there is any further information about the loan or ppi. Mr XXXX replied No I don't think so. Mr XXX does not ask for clarification on anything.
Again,he does not say that the ppi is still on your loan to term end with interest,just that you will get 50% of a refund.
What they failed to quote is the conversation where my husband initially told them that we were both in secure jobs that gives us 6 months full pay before going onto half pay and that we never take out ppi, not even on our mortgage. They also fail to mention the bit where my husband tells them to hang on while he discussess it with me. My husband then tells me about claiming a refund after 5 years and that FP say we can use it for what we want or put it back into the loan in order to pay some of it off. "At no time did my husband say to me that after the 5 years it would be worthless and we'd still be paying for it".

The final part of the letter reads: I cannot find any evidence whist reviewing the call that you were told to look on this as a savings plan. Furthermore at no point during the process did Mr XXXX or Mrs XXXX comment on the ppi as a savings plan. We will be happy to provide a copy of the call. After a full review there is no evidence the policy was mis-sold. This communication should be viewed as out final response.
At no point would I have commented on it as at no point did they speak to me regarding this.
So fellow MSE where do I go from here. Is it worth emailing the CEO still or am I chasing a lost cause?????? The anger has turned to deflation now.
Write back to them (save a copy of this ) say you disagree with their findings regarding this ppi and would like the telephone calls to send to FOS,tell them that at no time during the sales call were you told that the ppi would be on the loan to term end with interest,you thought that the ppi would be paid off the loan at the 5 year point,the sales person did not make this clear to you in either recording that they have that this was not the case,had you known the full cost of this ppi you would not have taken this and do not believe you were given enough info about this productto make an informed decision.
Put that you believe they have been selective with the phone calls,and have only chosen what suited them to refuse your claim on, as your hubby told the guy about sick pay etc.
Let them know you want a response in 14 days.
If they come back with a no,or do not reply within 14 days,send the original letter that you sent to them and a copy of this one,and go straight to FOS.

Thrilled that you have got money out of RBS but your case proves that they are not dealing with claims in date order as they repeatedly state. There are others in the same boat as me, and I'm glad you got your money so don't take this personally, who put their claims in LAST YEAR (August 2010 in my case) and signed the acceptance letter in August this year and have still not got a penny out of them. There seems to be no organisation of claims whatsoever.0 -

My acceptance letter was received on 3/10. A few days later I called the direct line 023 8072 3838 and was told I would have the money in my account within 15 working days of receipt of acceptance. Nothing has yet appeared!!. After numerous attempts to call the same number yesterday (engaged or 'other person has hung up' messages), I eventually spoke to someone who explained that they had to wait for confirmation that my loan was closed before they could issue the payment. Part of the offer was to close my loan and the balance of the redress would be paid to me (12k). The loan was closed on 18/10 and now it seems I have to wait another 10-15 working days for the payment to appear in my account or in the words of the person I spoke to 'you will be paid soon'. SOON :mad:
I emailed the CEO chiefexecutivehsbcbank.hsbc.com and got the standard response... will investigate etc..... All these delays are so frustrating and make the whole process exhausting. I just want my money!!!!!!!
