  • Had a call today from a place i got a car from back in 2007, i dug the p[paperwork out and when over it the sales guy completed a questionnaire and when i reviewed it i said i was adequately covered but still recommended the PPI, So i made a claim to Blackhorse i got a letter from Blackhorse saying to contact the retailer as they did not sell the insurance so i did then came the call
The guy started to grill me about the questionnaire i completed i said i did not complete it but you signed it , so you sign stuff without reading do you he then became very rude i said i was not going answer any more of his questions as it as all down in front of him in black and white.
He then when on to say you heard a radio advert saying you can get your money back and its immoral and he does not know how i can sleep at night and he was not going to bend over backwards for people like me and do l i thinks it immoral is said if you’re not happy contact the FSA and ask the questions to them why are you grilling me on the phone.
He then went on to say its people like you at which point i asked him to give me a definition of people like me and he refused so i ended the telephone call.
Was his call against FSA Regulations.

    Hi,

After LTSB decided to reject my complaint last week, I sent the CEO an email as I knew I had a genuine case and today got a letter back and they are refunding all PPI.
A big thank you to beamerguy who helped with the email, probably couldn't have done it without him.

The rejection letter finally arrived this morning. It was 3 pages long. Basically it went like this:

We have reviewed the sales process and are satisfied that the sales representative would have followed the correct procedure. In addition we reviewed the telephone call recordings and are satisfied that the Account Manager explained to you the key features of the policy.

It then goes on to list timings and what was said between first plus and my husband:
At 38 minutes 42 seconds a breakdown of the costs were given. If you choose to take out the ppi the cost of this is added to you loan and the additional monthly payment is £157.72. Are you happy with the quotation and my recommendation for you to take the cover Mr XXXX? Yes I am repied Mr XXXX.

The next part of the letter goes like this: At 41 minutes 01 seconds the CAM states "the cover lasts for 5 years after that if you havent made a claim you can claim a refund equivalent to half of the insurance premiums. The CAM then asks later if there is any further information about the loan or ppi. Mr XXXX replied No I don't think so. Mr XXX does not ask for clarification on anything.

What they failed to quote is the conversation where my husband initially told them that we were both in secure jobs that gives us 6 months full pay before going onto half pay and that we never take out ppi, not even on our mortgage. They also fail to mention the bit where my husband tells them to hang on while he discussess it with me. My husband then tells me about claiming a refund after 5 years and that FP say we can use it for what we want or put it back into the loan in order to pay some of it off. At no time did my husband say to me that after the 5 years it would be worthless and we'd still be paying for it.

The final part of the letter reads: I cannot find any evidence whist reviewing the call that you were told to look on this as a savings plan. Furthermore at no point during the process did Mr XXXX or Mrs XXXX comment on the ppi as a savings plan. We will be happy to provide a copy of the call. After a full review there is no evidence the policy was mis-sold. This communication should be viewed as out final response.
At no point would I have commented on it as at no point did they speak to me regarding this.

So fellow MSE where do I go from here. Is it worth emailing the CEO still or am I chasing a lost cause?????? The anger has turned to deflation now.

First of all so sorry to hear your claim was not upheld, Amersall will be on here sometime today and she is a Firstplus expert.

From what I know from dealing with Firstplus you need to write them back a letter, which if just worded correctly will help you win your case. This will then stop you having a long wait with the FOS.

    DOH!!!!! Sorry lol, blonde moment!
Ah, they are full of s**te  I could phone up now and would get told a completely different story by someone else, who is supposedly working from the same song sheet. The only consistent line that is coming from them is 'Your claim is being processed, but unfortunately we cannot give a timescale for repayment, you just need to be patient!'
    GIVE ME MY MONEY LLOYDS!!!!!!!!
  • I have recently started looking into PPI after looking it up on martin's website. On monday, I sent away 3 of the template letters to various lenders to try to claim back PPI that I had been mis-sold.
The next day, I nearly died when Santander called to day that they were refunding the PPI that I have paid plus 8%. I am just waiting on a letter to tell me the amount.
Was not expecting a next day answer.:money:
What a success, here is hoping I have as much luck with the other lenders. Thanks for your advice Martin.
  • Hi All

I just wanted to say a huge thank you to this site and the clear instructions on how to claim PPI

I started my claim off in June and I've been awarded over £16,000 of which £6,738 will repay my existing loan and the rest is being refunded directly back to my back account. :j

My loan was paid off last week and am just waiting for the refund, which I understand to happen in the next couple of days because my branch hadn't notified the office that the loan was closed and therefore the payment hadn't been processed!

I am sooo happy and not only will I be saving a whopping £371 a month from not paying my loan, but I am also in a position to pay off my store and credit card so will have NO debt what so ever...

Thank you, thank you, thank you soo much MSE!!!

    :D :T :p :j

Assuming half of the population are like me, checking the post and phoning Lloyds on a daily basis???

Nope, still nothing forthcoming. They are still on a "backlog" although I have now had two conflicting timescales on the so called "backlog". One said a month, and another two weeks.

Calcs sent to me on 11th September, interest paid to 5th October. Spooky eh, its nearly the 5th November. Did Guy Fawkes have another plan this year ;) ????

I just wanted to let others know that since June this year I have received a total of £5645 in PPI repayments. I wrote to Santander regarding a loan ppi and received £2333, Barclaycard £1910 and so far M&S £1042. The only one I have had refusal from was MBNA and I have now taken this to the Financial Ombudsman. Thank you Money Saving Expert for all your help.:j
