  • Hi everyone this is my first time posting but its through this site and reading this forum i learnt how to make a claim for my missold PPI. Today i have had a letter to say that my complaint has been upheld and that i should sign and send back the acceptance letter. My query is that on my letter it says that on receipt we will arrange for payment to be made, subject to clearance of any arrears or indebtedness you may have with the group. Does anyone know if this means that if i am not in any arreas but still have an amount of a loan outstanding that they will use the money to be paid to me to pay part of the loan off please ???

    The next part of the letter goes like this: At 41 minutes 01 seconds the CAM states "the cover lasts for 5 years after that if you havent made a claim you can claim a refund equivalent to half of the insurance premiums. The CAM then asks later if there is any further information about the loan or ppi. Mr XXXX replied No I don't think so. Mr XXX does not ask for clarification on anything.

    What they failed to quote is the conversation where my husband initially told them that we were both in secure jobs that gives us 6 months full pay before going onto half pay and that we never take out ppi, not even on our mortgage. They also fail to mention the bit where my husband tells them to hang on while he discussess it with me. My husband then tells me about claiming a refund after 5 years and that FP say we can use it for what we want or put it back into the loan in order to pay some of it off. At no time did my husband say to me that after the 5 years it would be worthless and we'd still be paying for it.

    The final part of the letter reads: I cannot find any evidence whist reviewing the call that you were told to look on this as a savings plan. Furthermore at no point during the process did Mr XXXX or Mrs XXXX comment on the ppi as a savings plan. We will be happy to provide a copy of the call. After a full review there is no evidence the policy was mis-sold. This communication should be viewed as out final response.
    At no point would I have commented on it as at no point did they speak to me regarding this.

    So fellow MSE where do I go from here. Is it worth emailing the CEO still or am I chasing a lost cause?????? The anger has turned to deflation now.

    We had the same reply, but after emailing the CEO, we got the complaint upheld, I know that Redpeppers was in the same position as me and she did the same, both of us have had sucess this way and are both awaiting big payouts.

    I would definately E-mail them and also Amersall drafted a letter which I re-sent to Firstplus with re-defined reasons for the mis sale.

    In all, it took less than two weeks for a desicion after the CEO was contacted.

    As the loan is frontloaded with PPI, the FOS will pass in your favour as these loans have now been withdrawn from sale due to the very nature of them.

    Don't give up, you may feel deflated now, but believe me, you will get the justice you deserve if you just persevere!

    No, only if you have arrears.

    Another success in the squirrel household today - DH got letter from MBNA - a refund of £1,611 for credit card PPI. Cheque to be sent within 28 days. (I'm still waiting patiently for my cheque from Mint for £3798!)

    Once again i'd just like to thank you all for your helpful stories/posts/templates which prompted me get off my backside and do the reclaiming!!

    Long time reader, first time poster. First, congrats to all that ones that already have got some of their own money back from the banks. Well done.

    My story is similar to a lot of ppl here.

    In between loans and CC, found myself owing the banks £25.000 +/- a few years ago. Had to go to a debt managing agreement to repay all (tahnks Payplan)

    Anyhow, in September this year, my debt was roughly £8000.00, and after reading Martin's guide, and all the experiences a lot of you guys had, contacted Lloyds and Halifax regarding PPI.

    Halifax CC was taken on line, so no claim. Fair enough. Lloyds (2 loand and 1 credit card) was another story. First call I gave them all details of CC and loans. Fine, we will start your claim. Letter received a week later, the usual bla,bla, but only acknowledging CC claim. Another few phone calls, and eventually all claims noted (at the same time they send you the £0.01 letters when there is a payment adjustment. Priceless, as this letters cost more than the £0.01...)

    Anyhow, to cut a long story short, received 2 acceptance letters;
    1st, dated 15/09/10 - CC acceptance for refund of £8318.43 (still waiting payment, no dates given, so on the same boat as everyone else waiting the dreaded 8 weeks or more...)
    2nd , dated 07/10/10 Loans acceptance for repayment of £5948.58, that they will have to sort out in 21 days....


    So hopefully, all will be done soon, once money is received I will sort out my remaining debt, and hopefully have a very nice Christmas...

    By the way,if you have a loan,the ppi monthly payment includes the interest for the ppi over the term,when you win mis sell,these payments are given back to you plus the 8%,so you do get the interest back.

    Credit cards i have not got a clue about how they do the interest on these.:eek:

    Long time lurker; first time poster. Interesting reading on how the banks are completely unable to cope with this situation. However, just hope I might be giving some glimmer of hope to those claiming from RBS. I applied in May, two lots of figures received and acceptance returned, first one received by them 25 August and second acceptance received by them on 5 September. My first payment should have been sent to me on 7 October and the second on 14 October. After phoning everyday; sending regular emails to CEO and then on Monday finally complaining to the FOS. I phoned RBS today again as usual to be told ...........wait for this, my two cheques were sent yesterday:beer:. Let's hope this is true, I will update once they have been received, but hang on in there they have to return the money they stole from us. However, not going to completely celebrate until I actually received the cheques!
  • Well finally.... we got some of the money today, just to recap we originally filed our complaint in September 2010, originally got a letter from RBS saying they had no record of the loan!! even though we had enclosed a copy of the loan agreement with the letter, and then got the usual we are going to a judicial review delay letters from the RBS, we knew we wouldnt get anywhere without a fight so like the rest of you filed with the FOS, then nothing for months, got an upheld letter from the RBS on July 19th, since then one letter saying another 4 weeks, my other half who was a rottweiler in a previous life and hates banks and is very good with figures has been back and forth to the RBS and FOS, the FOS have been brilliant and reiterated that they have had so many problems with the delaying tactics from the banks, the RBS have now finally paid us some of the money they owe us, £1300 last week and today another payment of £5,500, however they still owe us £2,000, the FOS are now contacting RBS on our behalf and getting all the paperwork together and putting it in front of an adjudicator we have to ring back in two weeks to find out the result, but like the FOS said if they owe it they have to pay it and we are sick and tired of them pulling a fast one on people, so hang in there guys they will pay up but feel free to threaten them a lot!!... :j
  • Finally got an offer today for my Direct Line loan that we took out years ago but paid it off in full early. I sent this form off in July, I had more or less forgotten about this one as we have had problems with others. But at least its been upheld and another £1400 is coming my way - but I know not to hold my breath where RBS are involved.

    Still waiting for my Nat West payout, they received my acceptance on 2/9/11 and told me that the cheque was requested on 20/10/11!!!

    But all good so far!!!
