They truly are useless thank goodness I don't bank with them.

I received an offer today, with RBS. .
In the letter they state that any refund on a closed card, such as this, will be paid towards any 'arrears or indebtedness you may have within the Group' - I have arrears I am paying off on a Natwest loan - are they within their rights to apply this refund to that loan? I could understand if it was a refund on the loan PPI, but this is a separate card, and therefore surely up to me where I choose to repay the funds? I apologise as I believe this question has been asked before but my search on the threads couldn't locate the previous answers!
Any advice would be most welcome. Thanks in advance.
3.9 Other matters concerning redress3.9.1 G Where the complainant’s loan or credit card is in arrears the firm may, if it has the contractual right to do so, make a payment to reduce the associated loan or credit card balance, if the complainant accepts the firm’s offer of redress. The firm should act fairly and reasonably in deciding whether to make such apayment.
Plus they should only be able to use redress from a complaint on a particular loan or credit card on the card/loan that has arrears, plus if you've asked for your agreement and they say they couldn't give you it, you would have them for a breach of the DPA as they may have told you they didn't have it anymore.
Hope this helps for starters:D

Thanks for that,i had a feeling they couldnt do it but was unsure.0

Well done on your success!
They should have been resolved by 16 weeks, although the news is that this has not been the case, they are still having difficulty in keeping up.
Have you also emailed the customer service team, plus the CEO?
That may push them a bit hopefully, good luck.
Hi, Had a reply from customer care who are about as much use as a chocolate tea pot, they said could not help due to data protection and to phone them, this I tried to do but after an hour of waiting to be answered gave up as I am disabled.
I am beggining to think they are taking the mick. I need my money back because of a family crisis, I should never have been forced to pay this PPI on my loans as because of illness I cannot work. It is now 20 weeks since I made my complaint.:mad:0 -
Well, I signed up to say thanks to you all - I had a few PPI requests in and managed to get a cheque from Egg for £698!
Just waiting on the Halifax now - have signed the agreement form saying I am happy with 'all PPI payments with 8% interest' being refunded. Strange thing is, I would of put money on me saying no to the protection on my mortgage.
So fingers crossed I hear off them soon.
So thanks to you all for the inspiration to make me get up off me bum and claim it back!0 -
Barclays have not got back to me about the missing letter and cheque, and again nothing in the post. Have emailed CEO but doubt it willl iilicit a response.0

I rang them before I sent off the acceptance letter to confirm I could be paid into a 3rd party bank account, they said yes that wouldn't be a problem. How the hell could they answer my questions when all along I did not have PPI?
They truly are useless thank goodness I don't bank with them.
Not sure what to do yet but I think you are right, they will be more of us.
Hope you don't mind me asking when did you open the account and when did you close it because i think mine was 1998-2002 and because they don't seem to be keeping files for longer then 6 years i think that maybe thats what there going by.Someone posted on here that they no longer had he's file before 2002 so they went by a basic assumption when they worked out he's redress because he's still using the card.0 -
