Home from work this evening to a lovely letter from Lloyds upholding my credit card complaint!
No calcs are per usual but no worries as I know I've won :j
That makes 4/5 on the complaints I made - just need MBNA to change their mind and it'll be a full house!

I then went on to ask him why even though all these letters had the same reference number on them they had different account numbers on. He told me that the latest letter was the correct account number on, so I said well then the other letters had the account number on which was actually the PPI policy number that you are now telling us that we having got!!! He went off the phone for a bit and then came back and said my husband would have to speak to the person who had researched the account as it was in his name they couldnt speak to me (although this last letter was in joint name). Now my husband works long hours and is still at work when they leave but he does start a 4 day week on Friday so this guy I spoke to is arranging to get our "reasearcher" to ring my husband on Friday. I have now had the task of going through it all with my husband - he just looks at me blank!! Anyway I have said if he gets confused get them to ring me at work and say he has given them permission!! Do you think we have a good case on this or are we just wasting our time?
Another question too if you dont mind I was suppose to hear of a decision from my old Morgan Stanley/Barclaycard account by the 6th September but I still havent heard. I am just wondering now if this has been "upheld" or not and if I should ring them or just leave it another few days = what do you all think?

Hi again - well I am even more confused today with regards to the two loans that we had!!! I thought I had sorted it out yesterday (see above) but then something clicked in my brain and I decided to look at the letter from Bank of Scotland with regards to the AA loan and low and behold this was the same account number that was on the letter from Halifax (same address I then noticed) but different reference numbers. The Forthright Finance loan was just in my husband's name but the AA loan was in joint name. I again telephoned Halifax to ask what was going on and to which loan were they telling me that had no PPI on. The guy I spoke to tried to be helpful but he sounded as confused as I was. All the letters from the Halifax had the same reference number on but referred to the same loan as the one from Bank of Scotland. He said he couldnt discuss the Forthright Finance one with me as that was just in my husband's name but could discuss the AA one as that was in joint name. But on reflection all I deemed from this conversation was that the Forthright Finance loan would be dealt with by Black Horse and I should ring them!!! We have never had any correspondence from Black Horse regarding this loan - so now I really dont know what is going on.
The frightening thing is this "researcher" guy from Halifax is supposedly ringing my husband tomorrow and I have had to try and explain it all to my OH so that he can tell this guy and I know he will get totally confused and frustrated, he doesnt deal with banks at all!!! I will be at work!!!
Its a right mess from what I can tell now and I dont know which loan is now the one they are telling us that has no PPI on it - I honestly thought we had it on both anyway.
Any advice from any of you guys would now be really gratefully received.
Also I contacted Barclays to be told that an offer letter had been sent out on 30th August, which I have never received. The lady on the phone said it was for only £55 - now this is for a credit card that I had over ten years and more or less always had a high balance on it. She asked me if I wanted to report that it wasnt correct but I said I would wait for the new letter that she was sending out and see what the figures are, etc. I know for a fact that I had PPI on this and have the statements from the SAR report to prove it. Do you think I am correct in waiting to see what the actual letter states, etc or should I have asked her to report that I wasnt satisffied there and then?0 -

Hi all, I'm a first-time poster and long time lurker!
i just wanted to say a massive thank you to Martin and everyone on here, your invaluable advice has meant that myself and hubby are now £3500 better off. Will go a long way to helping us become debt free :T
One word of advice - if your complaints are upheld by Lloyds, check the figures carefully. Two weeks ago, I received my upheld letter stating that I would be receiving a full refund of ppi plus 8% interest for my credit card. A week ago I received the amount in writing, stating that I would get back £940 but no breakdown of figures. As I don't have any of my statements and no idea what I paid, I didn't know if this was correct so called them for a breakdown (I don't know why but I don't trust them anymore!!!:rotfl:) The chap on the phone said that the interest (£36) looked a "bit low" so he sent it back for re-calculating and today I got told I would be receiving a further £1058.00:beer:
For people interested in timelines:
Original complaint put in 17th May
Upheld letter 26th August
Figures received 31st August
Payment received (£940) 6th September
So it took 16 weeks exactly

The statement of Demands and Needs reflects the customer's circumstances at the time of the application. It also confirms our recommendation of whether or not customers should take PPI and their decision whether to accept or decline our recommendation.
In this instance, the document shows you agreed our recommendation. I enclose a copy for your reference.
In this instance the PPI sale recommendation was correctly made based on known facts provided by them to us; and it also shows you agreed with our recommendation. I enclose a copy for your reference.
FP are admitting to this being an advised sale on this point alone I think the FOS will uphold the claim on the basis of cost.
Who is the full insured on the policy. Joint life single accident etc
At the time of sale what benefits were available to the insured to cover the payments in terms of disability, unemployment, or sickness. (FOS have said the life cover element is insignificant in there previous case studies). 1/30th of your monthly repayment ror every day unemployed max of £2800 per month, for a maximum of 360 days. The same for sickness/accident (doesn't say if there is a maximum period). Also for hospitalisation for any 30 day period.
How long was the insured in that employment at the time of sale 3 months
How long would they recieve full pay and then half pay 12 weeks full pay
In the event of disbility would the insured recieve long term benefits such as early retirement, or payment under a disability fund the employer operated. Accident cover upto £17,500. Life cover upto £23,000.
Was there a redundancy package avaliable, how much would this have paid the insured and for how long. Yes not sure on amount of cover or how long.
What was the cost of the PPI policy.£7347
How much was the total payment for the loan. Loan £30,000, PPI £7347, Total Loan £37,347. Monthly repayments loan £323.63, PPI repayment £79.26, Total repayment £402.89
Is the needs analysis signed by you and your partner and returned to FP or did they just complete over the phone. Over the phone
Did the salesman complete a needs analysis on both of you over the phone. By this I mean did he speak to each of you to complete a needs analysis. Think that only I dealt with the salesman
Listen I am willing to bet that the cost of the PPI policy in its entirety is more than the benefits that can be reasnobly be claimed under the policy.
If you could answer the above questions I will add my two pennies and include some deatil from the FOS handbook.

I need to know who is the fully insured its usually the first name on the loan or the first name to have signed.
The other person only gets the life insurance.
