Thanks for this , they have said however that this is their final response and will not enter into any further correspondance regarding this .
Still worth a try do you think ? or should I go to the FOS now ?

    Absolutely worth a try!

FOS backlog is anything from around a year to 18 months at the moment

Whereas they will probably take no more than a month to say "oops, we makea da mistakea!" or "no!" so it's got to be worth a try?

Congratulations to all who have got their PPI back!

    Hi,

I'd be inclined to call them back and ask for a copy of the T and C's for the PPI - I find this "PPI on purchases only" line VERY hard to believe

What would be the point in insurance that only covers one section of the balance owing?

    Do you have any statements?

If not, might be worth trying a SAR

Unfortunately if you dont have a record of the statements its going to be hard going to get them to stump up more

    :(

Thanks for your reply. Initially I was going to accept it but because their £12K has wiped out most of my debt I think i'll fight it just for the sake of something to do,

    Hi and welcome

Thank you as well for posting up your case and so sorry to hear of the messing around you've been going through.

Everything is crossed here for you and I do hope the FOS have some good news for you tomorrow and I totally agree with you throughout, its Barclays that are in the wrong here, good luck and please let us know how you get on, cheers x;)

Update for you. FOS rang again and Barclays are still rejecting my claim. Old application form has that 'opt out of ppi' box, which I never ticked. That form is the only evidence Barclays supplied to FOS. Tried to explain that, as my case was pre-20th April and on hold for duration of JR, this had no relevance anymore as Barclays were paying out on "no quibble" basis. Am I right here? If you look at BBC website, it says "Barclays will contact all unresolved complainants pre- 20 April 2011 and pay up, no questions asked"

FOS now investigating (again) whether I was mis-sold and, as Barclays refused to communicate with me, they are asking them to consider a "goodwill" payment. I think that is only fair and I'll also be contacting them with the same request. Any other info I can throw at them, regarding my claim? Would it appreciate if you could offer me a few tips.

Do you think it's a good idea to complain to FSA? Or, perhaps I've got this all wrong and just wait for FOS decision? (apparently, it will be in a few weeks!)

    Cheers,

    Andy

At this stage they are simply asking you to sign to agree with the method of calculation - i.e. that they will pay you the premiums plus interest. That is all.

When the figures are actually produced you can challenge them if you feel they are wrong.
Its amazing how these banks can't even do simple calculations correctly..............

    Well done and Congratulations!

Yes this does seem to be the norm, they should though send the breakdown before the payout, but I would otherwise contact them to make sure they do this.

If however you think something is wrong or miscalculated I understand you can question them on this anyway, even when the payment have been made, it was like that with one of mine anyway and then resolved. (Different bank).

    Good luck.;)

    Hi Andy

Sorry about that, and yes I believe you are correct, and that is also correct what was said in the media.
I'm sure the FOS will sort this out, and I would be asking for further redress for the distress and inconvenience as well, this just isn't on!

If you want to contact the FSA about this too, there's no harm done.

Keeping everything crossed for you. x:)

    Hi all,

MBNA have refused my claim today as they say I signed the application and was in the age limit of having a card, and was in permenant employment. They have said I can contact FOS if I want to take it further.

I do not recall ticking PPI, but could have.
I was working in my successful family business so had a great sickness redundancy package. I also had sickness and critical illness insurance so there would be no need to pay twice. I had the card from 1998 and when I realised I was paying PPI I cancelled it in 2001, and finally closed the account in 2007.

Any guidance on what to do next and how to word it would be great.:A

On a better note my sister had a letter from MBNA upholding her complaint for £5,600. :T She didn't have PPI when she opened the account in 1998, but in 2001 they added it to her card and she has been paying it to date.

I would like to thank Di, ammersall, niggly and the rest of the people posting advice and encouraging posts.:A You gave me the guidance to encourage my sister to get back what rightfully belonged to her!

Well done to all the winners and good luck to all those waiting, and those of you unsure whether to try...Go for it, my sister had her money back within 3 weeks from complaining!:j

    Hi di3004,

Please you give me some pointers of what I should do after my MBNA rejection, I do not know where to start.

    Thanks in advance:A
