PPI Reclaiming successes and failures

Hi all,
MBNA have refused my claim today as they say I signed the application and was in the age limit of having a card, and was in permenant employment. They have said I can contact FOS if I want to take it further.:mad:
I do not recall ticking PPI, but could have.
I was working in my successful family business so had a great sickness redundancy package. I also had sickness and critical illness insurance so there would be no need to pay twice. I had the card from 1998 and when I realised I was paying PPI I cancelled it in 2001, and finally closed the account in 2007.
Any guidance on what to do next and how to word it would be great.:A
On a better note my sister had a letter from MBNA upholding her complaint for £5,600. :T She didn't have PPI when she opened the account in 1998, but in 2001 they added it to her card and she has been paying it to date.
I would like to thank Di, ammersall, niggly and the rest of the people posting advice and encouraging posts.:A You gave me the guidance to encourage my sister to get back what rightfully belonged to her!
Well done to all the winners and good luck to all those waiting, and those of you unsure whether to try...Go for it, my sister had her money back within 3 weeks from complaining!:jMortgage Feb 2015 £178,500 END 2043!!

Some good News ....... and some bad news !!
Rang Barclays today , I had 2 complaints with them , one for Barclayloan & one for Barclaycard .
The advisor I spoke today could not have been more helpful , he kindly read back word for word the letters i will recieve.
The good news first .... the Barclayloan has been upheld , they have also gone back through every loan I have had with them .The earliest was in 2000 , they have said in every case , that they were not satisfied that proceedure was followed correctly so have upheld in my favour . The amount of re-dress is £10684 !! very pleased with this of course .
Barclaycard on the other hand have said the exact opposite , I stated the same reasons for my complaint as with the Barclayloan , but they say they have very strict proceedures for the sale of PPI and will not accept that this was not followed and therefore have rejected my complaint . I applied for this card in a branch of Barclays in 1997 , so there will be no telephone transcript to prove that proceedure was followed correctly , so I don't see how they can just reject based on this with no evidence to back it up .
Should I go to the FOS now ?0 -

First of all i wanted to thank Martin & all his team a great Job they do for us all. After reading the articles on here about PPI relaiming i thought i would have a go!
With no paperwork to hand and only Knowing who i took the loan out with, i Made a phone call to FirstPlus, after a few mins discussion with them about PPI reclaiming they said they would send me a form to fill in, After receiving the form and sending it back & waiting sixteen weeks i have now had an offer of settlement of over £14000.00 pound :T, for a loan that a settled back in 2007.
So it was worth the 15 mins waiting on the phone and spending 10 mins filling in a form......! How easy was that.......!
I would encourage everyone to go for it, you have nothing to loose but a lot to gain !0 -

I refer to you reasons to reject my complaint and ask that you consider the FSA's recent PS10/12 document (that your now cancelled Judicial Review action with the BBA referenced):
Appendix 3
Handling Payment Protection Insurance Complaints
3.3.9 G In determining a particular complaint, the firm should (unless there are reasons not to because of the quality and plausibility of the respective evidence) give more weight to any specific evidence of what happened during the sale (including any relevant documentation and oral testimony) than to general
evidence of selling practices at the time (such as training, instructions or sales scripts or relevant audit or compliance reports on those practices).
It is clear from the above that the FSA's position is that your "accepted practice" at the time of sale should not be held as a sole reason to reject my complaint
I also note that whilst this agreement was made in branch at one of your offices you have failed to provide written evidence that such practice was actually put into place (such as my signing documents confirming that a considered assessment was made of my needs for such a policy)
I would now ask that you reconsider providing a positive response to my complaint to avoid the need for reference to FOS and the subsequent £500 penalty such complaint would cause you.-
Congratulations to all who have got their PPI back!

Thanks for this , they have said however that this is their final response and will not enter into any further correspondance regarding this .
