    Thanks for explaining that, seems so simple when you write it down :o

    Well this is where it gets tricky. The loan still isn't paid off as I missed a few payments and it got passed to Blair Oliver and Scott (who I believe are part of Halifax anyway). I set up a payment amount with them and have not missed a payment since. The loan still has a balance of £1,000 at the moment but I was told as the total amount of the loan is based on the original amount including the PPI I didn't even know I had, the payment amounts and missing payments wouldn't matter?

    I have had a reply from halifax saying they are paying and I've sent my signed form back so just waiting for their calculations but was just curious how it was worked out considering my different payment amounts?

    Hi, Just wondered if anyone could advise on this relating to the different payments I made etc?

    Also, after sending the signed acceptance form back to Halifax, can anyone advise how long they have to now reply?

    Unfortunately I don't think there is a right answer. It will probably depend on the circumstances of the transfer of your debt to the DCA.

    If, for example, the DCA only paid the lender a nominal fee for your debt then the lender could argue that they had never been paid for the PPI included in the amount they had to write off and as such are not liable to reimburse it.

    The fact that you have paid the DCA the full amount is probably a matter between you and them and for which the original lender has no liability.
    Its amazing how these banks can't even do simple calculations correctly..............

    Ok thanks, will just wait and see what Halifax write back with and what they offer then go from there, thanks :)

    Just called RBS and the said letter was sent yesterday bud wouldn't tell what it said. All they did say was it's worth waiting till mon or tues for it. What should I make of that response??

    Really, only the person you spoke to could tell you that?

    I finally got my letter from RBS this morning after submitting my claim in July 2010 and I have been successful! Their offer is for £2600 which is way more than I originally thought I would get. Of course there is no apology of admission of any mis-selling on their behalf just an offer of " goodwill ". Strange to make a goodwill offer but be following FSA guidelines on mis-selling payouts!!

    I have sent the acceptance away recorded delivery and they will endeavor to pay this to my account in 28 working days, which I dont think is likely for a minute but the win is the important thing.

    Thank you everyone for your support and advice and thank you Martin as I would never have done this without this website.

    Congratulations to everyone who has had successes. Many thanks to all of the invaluable help posters have given each other and big thanks to Martin Lewis.


    I am still waiting for my calculations from hsbc but to be honest with you just knowing that it was upheld is enough to keep me going, I hope everyone who was genuinely mis-sold PPI gets back every penny they are entitled to.
