PPI Reclaiming successes and failures

I wrote to Virgin (MBNA) on 1st June 2011 regarding missold PPI on my Virgin Credit Card (long since closed).
I completed the Financial Ombudsman PPI questionnaire and enclosed this with a covering letter.
I received 3 letters between 1st June and 25th August - all saying that they were looking into my complaint and would respond within 28 days. The subsequent ones apologised for the delay and outlined my right to refer the complaint ot the Financial Ombudsman.
Yesterday I received a letter dated 25th August with a cheque enclosed for £2078!!!! (this is in line with what I had calculated I might receive).
Am very pleased :j
3 months from start to conclusion, and, after the initial form filling, pretty much painless!
Keep going for these claims people!!!!!

MBNA certainly seem to be getting their act together now - a lot seem to be getting settled (to full calculation) payment in 8-12 weeks
Whilst this may not quite meet Santanders standards (regularly 1-2 weeks for Abbey and A+L loans), it's not bad whhen compared to the likes of HSBC, Barclays et al-

can i ask what was your reasons for mis-selling, ive just called MBNA -Virgin this morning and had a rejection they said i ticked for ppi and ive signed the agreement. off to the FOS i go!0 -

Woah!
Dont be so quick to head for the FOS - remember you could be easily talking in excess of 1 year for that
You need to write back to them, stating you have noted their points but believe their reasons for rejecting your complaint directly contravene the FSA's principle points:
FSA PS10/12 (latest advice document regards PPI misselling that caused the Judicial Review)
Appendix 3
"Handling Payment Protection Insurance Complaints"
3.3.5 G The firm should not reject a complainant’s account of events solely on the basis that the complainant signed documentation relevant to the purchase of the policy.
And ask that they reconsider to avoid forcing you to refer to FOS and the subsequent £500 charge they will incur-

Hi,
I am hoping there is somebody that can help me with my problem (Amersall or Di maybe??).
Received an offer letter this morning from the Halifax with conveniently no settlement amount mentioned. They are asking me to sign this (offer??) without knowing the amount and I want to know if they can do that? My particular worry is that my loan and ppi in question was paid up via their debt collection section (Albion) in May 2011 and I paid them what they quoted as the settlement figure at that time. I am concerned that they may want to now claw back some of my due refund to pay Albion IF I did not settle the full amount at that time. Where do I stand here, can I insist on receiving the offer amount before signing? Or can I sign and then dispute the amount? Seems a very crafty way of doing business.

First of all well done on your offer.:beer:
Did they actually say they upheld in your favour or an offer of goodwill and still put you back in the position as if you did not have ppi.
Now in my opinion they should NOT claw this back, it would be wrongm but what I would do is contact them and ask them to send you a breakdown, tell them you will consider this but will appreciate being sent the detailed breakdown, if they cannot do this ask if they could then go over with the figures with you over the phone, and the total you will be receiving.
Again personally I think you have a right to know how its being calculated.
You can wait for an opinion from amersall as well if you want to just to be sure on this.

RBS have had my claim since Aug 2010. I know yours was sent in July. Is there anyone on here with an older claim than yours? Following my success with Lloyds I then decided to contact Littlewoods re the extra care advantage (PPI in another name) that is on my account.
I dont ever remember agreeing to this and can find no paperwork relating to it. They have now rung and said that an advisor will be contacting me with a 20 minute questionnaire as to why i think i was mis sold. All I can think is that they added it to may account without my knowledge, has anyone else had the same experience with them???????? I have no idea when it started as I never really took much notice of it on my statements....

At least they are getting in touch with you madastaz, i would hate it if someone rang me as i would fumble..so with that in mind, just write things down now as to reasons why you feel you were mis sold and dont let them put words in to your mouth, as they probably will:cool:, look on some of the last few posts and you will pick up some reasons as to why you might have been mis sold.;) Good luck:)xx
