    Hi,
    I Have had 2 successes so far:2 EGG loans - £710.80 :rotfl:and RBS Credit Card - £52.14!:j
    Egg loan from Sept '05 to July '06 :
    PPI premium on loan £1379.34
    Less any PPI premium refund taken off loan £961.02
    Refund of interest charged on PPI premium at contractual loan rate £87.17

    Egg loan from August '04 to Dec '04 :
    PPI premium on loan £1085.70
    Less any PPI premium refund taken off loan £910.88
    Refund of interest charged on PPI premium at contractual loan rate
    £30.49

    RBS Credit Card - £52.14 as it was an interest free period!

    I'm sure Niggly who seems to be the maths wizard on here would agree that EGG gave me a fair amount back as the loans were both paid off early?!

    I am now going to tackle Lloyds about 2 loans and credit cards,and EGG credit card and Nat west credit card!;)

    Yes everybody on here is very helpful with advice i would agree with that especially the devotees who are some of the experts like di3004 , Amersall & Niggly!;)

    You may be able to clear the following for me too now that I have more info to hand;

    My big loan which I am being refunded the PPI on, the total PPI on this amounted to £6,385.50. I paid it for around 34 months and the PPI I paid on my installments, not including interest, was £2,584.61. I have just called HBOS and was advised that when I settled I was given a PPI rebate of £1,850.38.

    Now, if I do my maths correctly I reckon there is a PPI black hole of about £1,950 which the bank are still due me on top of what I physically paid. Is this correct?

    To summarise, on this particular loan I think I am due back;

    1) The PPI repayments made over the 34 months plus the interest charged on each PPI payment as per the loan agreement.

    2) Simple interest of 8% on each repayment from date paid up to PPI claim settlement date.

    3) The balance of the PPI as explained above.

    4) Simple interest of 8% on the PPI balance at 3) from date of settlement of loan to date of settlement of PPI claim.

    I have a smaller HBOS loan from about eleven years ago which I settled late 2003, I know I am due the thick end of £1,500 to £2,000 on that too but again I think I am likely to be due some PPI back after rebate on this too, the figures I am unclear of though!

    Any help appreciated!!

    Hi all

    Can someone help!!
    I just received a letter form M&S yesterday they are rejecting my claim! They said they have investigated my claim see below:

    1. I completed the application in my own time. M&S money were not present so no advice could have been given to you about the merits of the policy.

    2. By signing the overalll credit agreement you confirmed you were happy with contents of the application form and the account terms and conditions. (we are going back about 20 yrs when this was a storecard)

    3. Details regarding the PPI and the account terms and conditions were attached in the application form.

    4. Policy documents were issued to your detailing the benefits, exclusion and cancellation rights. These should have been consulted to ensure the cover was suitable.

    5. The application required you to tick, sign and print your name to confirm you were happy for PPI to be added to your account, as this was fully completed we processed to add PPI to you card as requested.

    6. In 2003 we wrote to you to inform changing to Mastercard account., and again in 2207 making me aware of changes to PPI policy.

    Due to these reasons they have rejected my claim. I never ticked any box for PPI in was obviously in the small print and I have been paying this for over 20 years!!!
    Is there anything more I can do????:mad::mad::mad::mad::mad:

    I'm waiting my response from M & S and expect it to be the same as yours now.

    Have you got a copy of your agreement. I obtained a copy of mine filled in, in store in 1986. When i looked at it my first reaction was that I did not tick the PPI box but reading it again it says 'If you do NOT want Chargecard protection' tick the box. I think that this is deliberatly mis-leading.

    I'm not very good with this but I'm sure Smitchy and the other wonderful,wise people on here will help us counter- respond with quotes from the FSA. I think the following may be relevent:
    "3.3.5 G The
    [FONT=TimesNewRoman,Italic]firm [/FONT]should not reject a complainant’s account of events solely on the basis

    that the complainant signed documentation relevant to the purchase of the [FONT=TimesNewRoman,Italic]policy[/FONT]."

    "3.3.6 G The
    [FONT=TimesNewRoman,Italic]firm [/FONT]should not reject a [FONT=TimesNewRoman,Italic]complaint [/FONT]because the complainant failed to exercise

    the right to cancel the [FONT=TimesNewRoman,Italic]policy[/FONT]."


    "3.3.11 G The
    [FONT=TimesNewRoman,Italic]firm should consider in all situations whether it communicated information
    to the complainant in a way that was fair, clear and not misleading and with due

    regard to the complainant’s information needs."

    3.3.10 G The [FONT=TimesNewRoman,Italic]firm should not assume that because it was not authorised to give advice (or
    because it intended to sell without making a recommendation) it did not in fact
    give advice in a particular sale. The [FONT=TimesNewRoman,Italic]firm [/FONT]should consider the available evidence
    and assess whether or not it gave advice or made a recommendation (explicitly
    or implicitly) to the complainant

    With this last one could one argue that by having to 'opt out' of the PPI, M & S were 'implicitly' recommending the PPI, maybe?!!!

    Anyway, these store card complaints seem to be the hardest to challenge (probably because there must be millions of them and would cost the banks far too much to refund!......I know I have had at least six of them!!!!!!!:o How daft was I!!!!!!

    So I don't think we should give up although I think it may be a hard won battle!

    Was this the final response or can you go back to them first with further info?

    I will post my decision as soon as I get it. Can I ask when you submitted yours?[/FONT][/FONT]

    Hi I put my claim in in february and just heard last week that they are upholding the claim on 2 loans dating between 1997 and 2004. They have not given an amount and said they would be in touch within 4 weeks with the calculation.

    Hope you hear something soon.
