Sent 3 letters-all on the grounds of pre existing medical condition... 1 to GE Money for a Debenhams store card which had a CCJ on it-rcvd 1st letter statingI had signed initial agreement & saying that I would have to get a letter from my doctor proving my condition-even though the issue is really that they didnt ask.But I got letter and last week recieved notification from GE saying they were at fault ,it was mis sold and in total will pay just over £1800-got to pay off the outstanding debt with that but will recive about £700.Stil waiting after 8 weeks from Barclays for a personal loan PPI-has anyone had any sucess with them?
Finally Barclaycard wrote back same day as receiving and refused point blank and issued final response !Thats gone now to FOS.
So all in a mixed bag but i'd be intersted to hear about other Barclaycard/Barclays experiences.

  • What were you reclaiming: Loan
Who was the provider: Central Trust
How much did you get back: £7,668.30
Did you get it back after a letter or did you go to the Financial Ombudsman: One letter

Sent one letter on 11th November 2008. Central Trust have been brilliant, looked into the matter promptly, accepted liability and have just received news that the cheque has been posted (PPI amount + interest + 8%). Impressive service and obviously very happy.

  • Hi all, new to the site and there are some great things here.
I took out a loan with egg in 2006 and did not want the ppi with it however the lady on the phone convinced me to take it as i would probably not get the loan without it, after reading some of the posts on this forum i think it would probably be worth claiming this back however i cant find the contract for this anywhere(not even online). Should i write to them asking for a copy of the agreement before proceeding with the claim?

    Hi there hun
Was it Egg that actually arranged the loan for you?

Its worth you trying to complain and reclaim on this.

Write to the ones who arranged it and request for a copy of your agreement, you will have to enclose a £1 cheque for this as some charge, you could request ALL your information, but this one is called a Subject access request (SAR) where they must supply you with everything they have on you within 40 days of request, but there is a £10 cheque or postal order payment you would have to request for this.

Next to this thread is the PPI reclaiming discussion thread, if you want to hun post on there or here should be fine to let me know if you want the SAR template, but if its just the agreement your require, write to them and tell them you enclose a payment of £1cheque for a copy of your original agreement for when you had taken out the loan, and also tell them you expect to receive this within 12 days of request.

Always post letters to the finance companies by recorded delivery as this would be your proof of posting and if you check this out online on the Royal mail website - tracking you will know when it reached them.;)

Please post up if you require the SAR template to request everything.

    Cheers hun

Regarding my above post here is a template letter to request a SAR, they should comply within 40 days with everything they have on you on your account with these, this should be useful to help you with any PPI reclaiming, I will add more info in another link below, but start with the SAR here:;)

    SAR - SUBJECT ACCESS REQUEST

    Dear

    Re: Account number:

In the first part under the Data Protection Act 1998:

Under the Data Protection Act 1984 and 1998, and including the right of subject access under these acts, please supply me with a complete list of transactions and charges relating to the above accounts held with you since they were opened.

Additionally where there has been any event in my account history over this period which has required manual intervention by any member of your staff or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention or other evidence of that manual intervention in relation to my business with you.

If you are unable to supply data relating to manual intervention because there has been no such manual intervention then please be kind as to confirm this in your response to this request.

For the avoidance of any and all doubt, I reiterate:

I hereby request that you supply me with any and all historical data in your possession which, in any way appertains to me, including (but not exhaustively) a copy of the original signed executed agreement; statements of account; duplicate statements and/or print outs of all account transactions; all internal and external correspondence sent or received by you including memo’s, logs, notes, screen prints and transcripts; notes of manual interventions such as telephone attendants' notes, copies of stored telephone conversations, internal and external emails; any other information held on any/all types of media in any relevant filing system (microfiche included).

If you have disclosed any information to a third party (with or without my express permission), will you please include details of this in your reply, along with notes of any legal action passed or pending (to include a true copy of default notices, court orders and the like).

Where any information that you provide includes any charges, for example returned payments, late payment fees, and so forth, would you please advise your breakdown of actual costs (liquidated damages) incurred for each charge, and the Term or Condition on which you rely upon to claim such a charge.

I also require that you forward, within the above mentioned time scale, a true copy of the Terms and Conditions that were in force at the time my account was opened, and any subsequent amendments to those Terms and Conditions.

I enclose the statutory maximum fee of £10.00 to access ALL data held by XXXXX about myself. You should be fully aware of your statutory obligations under the Data Protection Act and that any failure to comply with this request will involve a complaint to the ICO as well as potential legal action.

You have 40 days in which to comply with this request.

This communication has been sent Recorded Delivery so I can ensure compliance on these issues within the legislative timeframes.

    Yours Sincerely
