    How long have you been on with this now?,this loan was obviously pre 2005 and your first complaint should have been with the insurer at the beginning.
    Anyway,give FOS the details and they will do the claim for you x.

    Yes they have the original account number and Paragon still have my file as they had to get it sent from storage when I first complained and again last month when I had to call for some more details.

    Loan was from 1999 for 3 years and complaint was first registered with paragon since October 2010. Only sent to the FOS in summer though.

    Have emailed my FOS handler the details (have to say don't have much faith in him if he was unable to get the underwriter details!) and will see what Aviva say but haven't seen too many positive posts about Aviva :-\\

    Not sure what else I can do! Unfortunate, as I have seen so many positive pre-2005 results as well!

    edit: Am wondering if it's worthwhile sending an SAR to Paragon, although not going to change the fact it's pre-2005 and they weren't regulated etc.

    Hi, not sure if it would be worth doing a SAR to Paragon, maybe someone else will know what to do about this? x.

    Thanks, a friend of mine has claimed refund of ppi recently and he gave me the e-mail address of the halifax ceo so I have e-mailed him. Should I fill in the questionnaire, send a letter or phone too or will this just be overkill at this early point? Di x
    Give them a ring :D:D:D:D:D they wont bite, if you need to send a letter they will tell you.

    For sometime now I have been concerned that the banks have been relying on our ignorance and have been making offers just based on the 8% interest addition and not the higher interest rate they charged on the card.
    If my understanding of your calculations is correct the 8% interest is added to by the FOS rulings from the date of the payment made to the card company to the date retitution is made to us
    ie payment x Card interest say 15% x 8%
    not payment x 8% x 8% if you follow me ?

    I have devised my own spreadsheet to project likely returns to ensure that the offer made is near enough correct.
    It appears to me, that offers that are being made often don't say it's the final offer and if accepted they they are getting away with lower settlements, would you agree ?

    Hi All

    Nothing major to report but i know a few people were in the same boat as me so just giving others some hope

    I am dealing with an A& L loan from a few years ago and kept emailing Santander but just getting auto replies back

    Last night i emailed the ceo@santander.co.uk and this morning received a phone call saying that they may have a lil problem finding the archiving files as only go back 5/6 yes but we said well we have the docs so they then went onto say oh we have a good team here leave it with us and someone will be back in touch with you before end of working day

    So my advice here is if you are only getting auto replies like i was take it higher

    There has been a lot of confusion surrounding the 8% interest.

    On Credit Cards, they look at each monthly statment.

    If the removal of the PPI premium and contractual interest in respect of the PPI that month puts you in credit, 8% is added to it for that month only.

    If you have a large debit balance and the removal of the PPI does not put you in credit, you do not get the 8% that month.

    You can see where this becomes a minefield to try and work out yourself.

    The 8% is also simple interest and not compounded.

    Anyway, as far as I recall, I got the Loan from Paragon directly. I have a feeling this is not going to be successful.

    Just for you to be aware, this can be a long drawn out process, but you will get there.

    I am in the same position and mine is also being dealt with via the underwriter, so at first I write to the lender and not the broker and asked them to provide me with the PPI policy booklet details by post, they did so free of charge within a week or so.
    These details are not always enclosed within your loan package copies (the info they send after you take out the loan).

    So I then pursued the insurer (mine Hamilton) and they did not take any liability, but at least you can have this investigated by the FOS as they would have been regulated as being a insurer/underwriter, they will have liabilities there somewhere.
