With regard to my husband's Black Horse car loan that they couldnt possibly find (think I might have logged this on the other thread - sorry if I have) because we didnt have the agreement number and then HSBC found it for us on our old internet bank statements, well I e-mailed Black Horse with this agreement number and low and behold they found it!!! Can I also ask, as I said earlier, I have been away for a couple of days and came back to a slip for a registered letter that I need to pick up from the post office tomorrow. Its addressed to me and my husband and I cant for the life of me thinkk what it might be - do any of these companies send out any of the letters (or even better cheques I am keeping everything crossed without first telling you what you are getting) registered post? I am so intrigued and cant wait to go and pick it up tomorrow but am telling myself not to get excited as it might be just something that I have forgotten about and not to be disappointed cos it will be something not exciting at all.
Just to let you all know that I picked up the registered letter today and it was the results of a SAR request (I found an old loan when looking through old on line bank statements, I had totally forgotten about it) that I sent off to Direct Line (I dont think they have even cashed the £10 cheque I sent!).
It states that we took out a loan for £6,000 in June 2002 with insurance of £882.82 (total interest £1445.18) over 60 months but we paid it off in September 2005 - the payments were £138.80 per month! When we paid it off we got a refund of interest £150.05 and refund of insurance £91.66.
I am just wonder if it is worth claiming this back from such a long time ago and if so does anyone know roughly how much we should be due back.
Plus does anyone know what Direct Line are like for paying up?
I have sent the FOS form off to them today in any case!0 -

Just like any other finance company if mis sold the insurance you can make a reclaim, and yes I would if this applies to you, they would therefore refund all you paid in PPI minus the refund and interest already paid on settlement, and remember what you should also receive is interest on each payment you paid with the PPI every month, and interest to date, so it will all add up.
I wouldn't say its too old, look at minejust successful from late 1999 cases.

Hi all,
After reading that I could have another crack [geddit] at complaining to Egg about the insurance that just happened to appear on my ex-credit card...
Just got a cheque through today - details of the payments are:
CRP premiums paid = £2090.17
Refund of interest on premiums paid at card rate = £731.69
Interest at the rate of 8% as detailed above = £544.68
Total refund due = £3,366.54
WOW - this payment now makes us totally debt free - and we've got some savings now - Thanks to this website!!!:D:p

Turned down last week by M&S money for PPI on a loan put on hold due to JR. Received a letter last week saying they couldn't find any paperwork about PPI or loan amount. I had one loan update which did not give much information and did not show any breakdown of how the amount was made up. The information it contained was what I had already given them with dates, payments etc.
I sent an email with the points I wished to make and today have received a letter thanking me for the further information I was able to provide and refunding a total of £3,071.43 (PPI of £1341.43 plus interest). Amazing how the paperwork suddenly appeared.
I had sent off a SAR to them to see what I could find out. I do have one other old loan dating back to mid 1990s that I have no paperwork for so if it gives that information will pursue that as well.
So far I have had 9 claims upheld, am waiting on three with the barclays "no quibble" refunds and have one with Citifinancial, passed to Opus, placed on hold for JR and that I cannot get a response to. Have cleared all my credit cards and am hoping the Barclays refunds will clear my 2 loan balances. Feels absolutely brilliant.0 -

Yes totally. That's what is annoying me really the very fact that there isn't any consistency to the way they are dealing with each case. But also someone else on here (can't remember who) pointed out that the 6 years is only from the time that you first became aware that you may have been miss sold so I would have thought that yours would be well within that too.

Intial reseach shows Six years (Statute Barred Limitation) only comes in Six years after You became Aware you were Missold PPI

Guidelines for the calculations for the refund of premiums suggest a baseline of twentytwo years 2011 - 22years = 1989

Earliest court case/example I have been able to find of misselling goes back to 1991
I REPEAT The banks are on a DAMAGE LIMITATION EXERCISE they have all the information they need to deal with your complaint.
They are hoping we/you will get fed up and drop the case.
Once they realise we are up for a fight they will cave in and try and con somebody else.
If I can suggest that you send a copy of their reply to their ceo QUOTING the above points and ask if they are prepared to reconsider their position, or give you their FINAL decison as you are convinced the FOS will NOT uphold their decision if they reject your claim

Yes normally that is all they need.
Is the account still active or settled?
I know with settled accounts they tend to say they are no obliged to send these details out, but in case your not aware, you can still continue to make a reclaim, if you know you were sold PPI and mis sold, then go for it, as you do have the account number.
Follow the link below, to the reclaiming questionnaire on step 3, send to whoever was responsible to selling you the account, head office or their complaints dept, and allow 8 weeks for a decision, remember to keep copies for yourself as well, good luck.
Also just to add, they may write to ask for more time due to backlogs.
