    Devastated.....just got the email..comprised of letter & loan pack to say that they do not agree we were miss sold.....booooooohoooooooo!! They have sent a long letter to say we could have cancelled, etc, etc.....it is with the FOS also, so i suppose we will have to wait & even then it will probably be a resounding no....its not fair!!:(:( xx

    The FOS will uphold this i am sure,what were the reasons CP gave you for "not guilty" ?.:rotfl::rotfl:
  • HSBC - Good news!!

    I sent 2 questionaires to HSBC covering 7 loans and 2 C/cards on 21-22/6 and fully expected to join the back of the queue and the 16 week extended waiver. 3 weeks later, I started to get a little annoyed that they hadn't even acknowledge receipt of my q'naires, and that week counting would start when they could be bothered to finally reply to me which we were already 3 weeks into.
    On Friday last week I emailed the oft discussed ceo at HSBC having a rant about the slience and within minutes i got an electronic reply apologising and saying they would look into it. Sent another email rant on Monday "still waiting"

    Got a letter this morning (dated 8th July, takes 5 days to fold and post a letter!) listing all my loans and cc's and a blank questionaire asking me to fill in if I hadnt done so already (doh!) and disagreeing with 2 of my 9 claims, then blow me down had a call this afternoon saying everything had been upheld in my favour (may still need to query those 2) and that it was with the calculations team and I would hear very shortly.I shall hold my breath until all sorted, but it may all be settled within a month

    I think cos I made a bit of a stink and have had an a/c with them for a long time they are finally showing a soft, squishy side (yeah right!) and clearly want to get rid of me. I had kept copies of everything that I posted to them which may have helped my case.

    Ohh, it was pages long, saying that on the telephone conversation i stated we had insurance but maybe it was best if we took life insurance..and me asking the persons advice if we really should take it, we could have cancelled, we had the paperwork & should of read it correctly - so we knew what we were accepting..just things like that! I sent her an email back saying as if i would take a PPI that only ran for 60 mnths when the loan ran for 200mnths...i have also asked it to be cancelled as from today, however, she emailed back to say it wasn't them...i have rang white label who say it isnt them either but the broker CP...so i have just emailed her again to state that it is them & i want it cancelled. In the email she sent back - she said she would look forward to the response from the FOS...i knew my luck...the FOS will probably agree with them too!! Do you think i should write a letter back to say i am not happy with the decision or just leave it to the FOS?? Gutted !!:(:( xx

    Well done - it looks like you are well on the way now.

    Just a word of warning though - I was / am in a very similar position,kicked up a fuss (via CEO) which brought results / an offer.
    However...the offer was well short of the FOS guidelines.
    They were only prepared to offer premiums + stat interest....no refund of the associated interest applied to the account by them or redress for the cumulative effect this had on the balance of the account.

    The discussions continue.

    Check the figures offered.

    You were not told this was on the loan for the whole term with interest and this only covered you for 5,also this is a very costly life insurance!!

    just things like that! I sent her an email back saying as if i would take a PPI that only ran for 60 mnths when the loan ran for 200mnths...i have also asked it to be cancelled as from today,
    DO NOT CANCEL THIS!!!!!!!!!!!!!!!!!!!!!!!!! THE PPI WILL STILL BE ON YOUR LOAN WITH INTEREST they will only offer you a small rebate and your loan will stay the same.

    FOS should not agree with this!!!

    Dont think CP will deal with you now as she said they will wait for the FOS response.

    Give FOS ring tomorrow,tell them that you have had a reply and you are not happy with this, (make sure that CP have not cancelled this insurance!)tell them this is an expensive life insurance (as you said) and although you could have cancelled this,you would have done if you had been told the true cost of this ppi and that it only covered you for 5 years but it would still be on the loan to term end with interest.

    You do not believe you were given the full cost and implications of this ppi enough to have made an informed decision,had you been, you would not have taken it.

    Tell the FOS all of this and it will help them in their decision.

    Dont worry about the 6 year rule - its just a fob off - they cant use it.

    Pursue your claim and if they dont play ball send it to the FOS.

    The majority of my claims are for accounts from the mid to late 90's.

    Have had 3 upheld recently.

    I am still waiting a reply from Lloyds about two loans. Sent them an email and they are still looking into it. Felt really spurned on in June when I sent the questionairres as lots of people had had successess. Now I am feeling incredibly despondant as successes are not so great ...it appears and have a bad feeling it's gonna be a resounding no.:(
