One thing that confuses me about the accompanying letter for my cheque. The third par says: "Please be aware that this letter is for information purposes onely. As you have made a previous successful claim on your policy which is greater than the total refund due amount, in line with FSA guidelines no further redress is payable."

It makes no sense to me! I never claimed on the policy as I didn't know it existed?
If you got a cheque, then dont worry :D:D:D:D:D

    Well done

I would question them on this in case you have been given the wrong letter, which seems to be the case, tell them its the first you have known about making a claim, as its only now you realised you had it which is another reason why you made a reclaim, even though its addressed to you.
    Do check, good luck.;)

Will do - thanks! I did wonder if it was referring to my complaint about the first loan, but as that's a smaller amount maybe not.
  • Hi Community,

My names Rob and i'm new to MSE.com... what a great site! I've just been round to see the folks and found a letter from my credit card provider (Halifax) mentioning I had payment protection insurance on my halifax credit card and that it was optional and I should have not felt pressured to purchase the cover... it also goes on to detail the cover and provides a policy conditions hand book dates feb 2008. Ive had this credit card for as long as I can remember and have only recently paid the full balance off after months of paying minimum balance!

Do I have a claim? Ive already gone as far as completing the request for terms and conditions template as cant remember when I took out the card.

Any help would be greatly appreciated!

    Many Thanks, rob :)

Hi and welcome, and cheers for the pm message.;)

The PPI should have been made optional and you should not have been pressurised into taking it out, sometimes they do not make the T&C's clear either, so in your case do give it a go, what happens now is that if your successful you then get to keep all your refund.

You bascially just complete the reclaim questionnaire as on step 3 below, send to the banks complaints or head office address, remember to keep a copy as well in case you need to refer back to this again, and allow 8 weeks for a decision, they should let you know within a week or 2 they received your complaint and give you a timescale of when you should hear.
They may request for more time due to a backlog.

Hope this helps, good luck, I also think it would be a good idea to post your complaint/reclaim questionnaire by signed for recorded delivery as well.;)

Still awaiting a decision from RBS from last October. I had the standard letter telling me to expect a reply by 31st August but in my opinion they're taking the p##s so I have just emailed the CEO demanding a definitive timescale....I'm fed up of it all now and want my money back :-)
  • Hi i got a letter back from Cap 1 so say they wont be upholding my complaint as i had ticked the box requesting ppi, on the application form all the ticks on the form are mine except the one requesting ppi as its not consistant with all the other ticks on the form. So sent a complaint to the ombudsman. Does anyone know how long it normally takes for them to give me a decision. Thankyou in advance x

    Hi,

Unfortunately, the Ombudsman are absolutely drowning in cases at the moment (literally thousands of cases per week, if not day)

So, being realistic I would not expect a decision on your Cap 1 complaint for at least 4-5 months (you can see on here the amount of time many people have had to wait) and possibly a LOT longer

I myself have a complaint with FOS regards an RBS CC that has been with them since early 2010 (started with RBS 2009, rejected, sent to FOS adjudicator, rejected, appealed to FOS Ombudsman final decision team, made a priority case in late January, held up due to the Judicial Review, stilll being processed!)

So as you can see, once sent to the FOS it is a slow process - they are doing their very best in very difficult circumstances, I am sure, but it can be a long, frustrating journey

    :(
