  • thanks for your quick response di, i should have said in my post that the fscs sent me a claims form a week ago & i filled it in and posted it back, does that mean i have a case with them or are they just sending the claims forms out to all customers :)

    I take it your going the underwriters direction and that Aviva are those of the underwriter/insurer?

    I have a case ongoing with the FOS with the underwriter, as the broker dissolved back in 2006 from a loan taken out in 2004 which was not then regulated either, but I am aware that my underwriter was that of Hamilton, bought over by Aviva and Direct Group have part of it as well.

    Hiya not a problem.;)

    Going from their website, it does state accounts taken out from Jan 2005, but what I would do in your case is give them a ring next week just to make sure, because you don't want them to be wasting your time if they were not able to deal with it, so in this case then you can then contact the FOS in regards of the underwriter direction.

    Good luck though, see what they have to say x:)

    Refund on premiums £1565
    Refund of Interest @10% £367
    Interest @8% £234
    Total £2166ish

    Not bad at all.

    mmmmm im just wondering with all this talk about santander and store cards its interesting to see that some one has been refunded as i also sort of had my claim through my burtons menswear store card turned down by santander they told me that it was a bread winner policy so my partner if i had one would of been able to claim even if i was a full time student at the time of taking the card out! they also said i had paper work through explaining i had ppi and i could cancel it if i wanted to at the time of taking it out,they said if they are to investigate more they would need proof that i wasnt paying national insurance payments back (waiting to hear back my hm revenue and customs regards this) because i was a full time student, but all this talk has got me wondering are santander giving me the run around as i took my store card out back in 1996/1997 and thay havent said anything about not being covered under fos before 2005,so am i gonna go through all this rigmarole just for them to turn around and said oh no sorry we werent covered back then so you cant have any back???

  • thank you very much di, i will phone them next week & see what they say because i dont know where i stand as my loan was still active in jan 2005 x
  • Just thought I would add my story on here too, I had a 7.5k loan with mbna, have been told I will recieve a refund cheque in next six weeks, however they couldnt tell me how much it should be for over the phone! so just got to wait and see! the loan was a while ago and I have no idea how much the ppi was! she did say they were paying out to all complaints! so just waiting on the letter! :-) and hoping its a decent amount as I really need the money now lol!

    Debt free date at current affordable repayment: 2022 :(
    Need to get this sorted!!
